HomeMy WebLinkAbout23-141 Resolution No. 23-141 RESOLUTION AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH ELECTRICAL RESOURCE MANAGEMENT(ERM)FOR PHASE II LED STREET LIGHT CONVERSION PROJECT (Bid No. 22-057) WHEREAS, the City of Elgin has heretofore entered into a contract with Electrical Resource Management (ERM) for Phase II LED Street Light Conversion project (Bid No. 22- 057); and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1 attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by reference. s/David J. (Bid No. 22-057) SCOPE: This change order will adjust quantities of materials required towards the completion of the phase II LED street light conversion project which were not known at the time of award. A contract to secure 2,617 LED retrofit light fixtures built to specification to be placed into existing luminaire hous- ings was awarded to Electrical Recourse Management on December 7`s 2022. Since the award and sub- sequent 2023 construction start of the project, one hundred and ninety three(193) luminaire housings have been identified as unsuitable to accept the retrofit fixtures. Approval of this change order will add material quantities towards work germane to the original contract award and project specifications. REASONS FOR CHANGE: The infrastructure conditions necessitating this change order were not reasonably foreseeable at the time the contract was signed. The change is germane to the original contract as signed. • The change order is in the best interests of the City of Elgin and authorized by law SUMMARY OF CHANGES IN CONTRACT AMOUNT: The cost of the contract is being amended to reflect the materials necessary towards completing the pro- ject,which are more fully described in Exhibit A, attached hereto and made a part hereof. ORIGINAL CONTRACT AMOUNT: $1,436,500 CHANGE ORDER No. 1 Additional Materials $58,497 TOTAL FOR CHANGE ORDER NO. 1: ADD $58,497 PREVIOUS CHANGE ORDER(S): No Previous Change Orders $0.00 TOTAL OF PREVIOUS CHANGE ORDERS: ADD $0.00 TOTAL REVISED CONTRACT AMOUNT: $1,494,997 The original amount of the contract with Electrical Resource Management is$1,436,500. Change Order No. 1 will increase the original contract amount by a total of$58,497 that sum representing 4.07 percent of the original contract amount. The new contract amount, inclusive of all change orders is$1,494,997. OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
