RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 AND FINAL WITH
MARTAM CONSTRUCTION, INC. FOR GIFFORD ROAD WATER MAIN
IMPROVEMENTS PHASE I
(Bid No. 22-032)
WHEREAS, the City of Elgin has heretofore entered into a contract with Martam
Construction, Inc. for Gifford Road Water Main Improvements Phase I project(Bid No. 22-032);
and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 and Final attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1 and Final, a copy of which is attached hereto and made a part
hereof by reference.

CHANGE ORDER No. 1 and Final
CONTRACT: Bid No. 22-032—Gifford Road Water Main Improvements—Phase I
SCOPE:
The Gifford Road Water Main Improvements Phase I project objective was to begin the installation of
multiple water mains along Gifford Road to reduce the impact of water main breaks on businesses. The
scope of work called for installation of new Ductile Iron(DIP)water main in the west parkway of
Gifford Road from Gasket Blvd to just north of Spaulding Road,and the rehabilitation of the existing
water main,through Cured-In-Place-Pipe(CIPP)water main lining from South of Gasket Blvd to north
of Spaulding Road. The project included new fire hydrants, in-line valves, service connections to the
new west-side main,and miscellaneous roadway and parkway restoration.
REASONS FOR CHANGE:
The Project was awarded at the July 13,2022 City Council Meeting. The Cook County Highway Depart-
ment Permit was received on October 13, 2022, and the Notice to Proceed (NTP) for this project was
issued to Martam Construction on October 17,2022.This significant delay between award and NTP was
not foreseen during the bidding process, and caused significant productivity delays to the project due to
weather,and scheduling delays due to the federal holidays encountered. Additionally,the availability of
asphalt for final patching and surfacing cannot be completed until the asphalt plants re-open in April.
Martam Construction, Inc. is requesting an extension of time to the original contract substantial comple-
tion date of January 15,2023 to February 21,2023;and an extension of time to the original contract final
completion date of February 15, 2023 to June 2, 2023. Martam Construction, Inc. will not receive addi-
tional compensation.
The circumstances said to necessitate the change in performance time were not reasonably foreseeable at
the time the contract was signed; the changes provided in this Change Order No. 1 are germane to the
original contract as signed and this Change Order No. 1 and Final is in the best interest of the City of Elgin
and authorized by law.

The original substantial and final completion dates of the contract with Martam Construction are January
15,2023 and February 14,2023,respectively.Change Order No. I and Final totaling an additional 27 and
107 Calendar Days will extend the original contract substantial completion date to February 21,2023 and
the original contract final completion date to June 2,2023.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
