RESOLUTION
AUTHORIZING EXECUTION OF A FIRST AMENDMENT TO THE ANNEXATION
AGREEMENT WITH IGLESIA APOSTOLICA DE LA FE EN CRISTO JESUS IN THE
UNITED STATES INC. AS PROPERTY OWNER
(2600 Hopps Road)
WHEREAS, Iglesia Apostolica de la fee en Cristo Jesus in the United States Inc., the
Owner of certain property commonly known as 2600 Hopps Road, Elgin, Illinois, has proposed
that the annexation agreement between the Owner and the City of Elgin be amended; and
WHEREAS, after due notice as required by law,a public hearing on said proposal was held
by the corporate authorities of the City of Elgin; and
WHEREAS, the proposed First Amendment to Annexation Agreement with the Owner, is
in the best interests of the City of Elgin.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute, on behalf of the City of Elgin, the First Amendment to
Annexation Agreement with Iglesia Apostolica de la fee en Cristo Jesus in the United States Inc.,
a copy of which is attached hereto.

AMENDMENT TO ANNEXATION AGREEMENT
(2600 Hopps Road)
THIS AMENDMENT TO ANNEXATION AGREEMENT made and entered into this
23 day of March , 2022, by and between the City of Elgin, Illinois, a
municipal corporation of the Counties of Cook and Kane, in the State of Illinois (the"City"), and
Iglesia Apostolica de la Fe en Cristo Jesus in the United States Inc., an Illinois not for profit
corporation("Owner").
WHEREAS, the City and Owner entered into an Annexation Agreement covering
property commonly known as 2600 Hopps Road on the 25th day of September, 2019 (the
"Agreement").
WHEREAS, the City and Owner desire to supplement and amend the Agreement in
several respects.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein,the sufficiency of which is hereby acknowledged, the parties hereby agree as follows:
A. There remain certain impact fee payments due to the City from Owner, which are
set forth on Exhibit D of the Agreement("Impact Fees").
B. The City has requested and the Owner agrees to dedicate to the City of Elgin the
north sixty (60) feet of the Owner's property ("Roadway) for future construction
of a city street, as depicted on the Plat of Dedication for 2600 Hopps Road,
prepared by Alan J. Coulson, P.C., dated February 2021, last revised February 16,
2022 ("Plat of Dedication") attached hereto as Schedule 1 and made a part hereof.
C. On execution of this Amendment to Annexation Agreement, the City shall
promptly execute the Plat of Dedication.
D. The City has agreed to credit Owner for the value of the Roadway against the
Impact Fees. The parties agree that the Roadway Credit is Forty Thousand Nine
Hundred Twenty-Seven and 68/100 Dollars ($40,927.68) as set forth on Schedule
2 attached hereto and made a part hereof.
E. The City has agreed to credit Owner for the preparation of the Plat of Dedication.
The parties agree that the Plat of Dedication Credit is Seven Hundred Dollars
($700) as set forth on the Schedule 3 attached hereto and made a part hereof.
F. The Impact Fees net of the Roadway Credit and Plat of Dedication Credit in the
amount of Twenty-Six Thousand Five Hundred Ninety-Eight and 39/100 Dollars
($26,598.39) shall be paid to the City by Owner within 30 days from the final
execution of this Amendment to Annexation Agreement, notwithstanding the
provisions of Paragraph 14 of the Agreement. In the event Owner fails to pay
such Impact Fees net of the Roadway Credit by such thirtieth (30th) day, interest
on such unpaid balance shall accrue at the rate of five percent (5%) per annum,
prorated on a daily basis from the date of this Amendment until the date of full
payment.
G. The parties acknowledge that Owner has completed the installation of the
connection to the existing water line and the installation of a code compliant fire
suppression system in the building on the Subject Property as set forth in
Paragraph 12 of the Agreement.
H. In all other respects, the Agreement as amended herein, shall remain in full force
and effect as originally executed.
IN WITNESS WHEREOF, the Elgin Corporate Authorities and Owner have hereunto set
their hands and seals and have caused this instrument to be executed by their duly authorized
officials and the corporate seal affixed hereto, all on the day and year first above written.
