RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH SCHROEDER AND
SCHROEDER, INC. FOR THE 2022 SIDEWALK REPAIR PROGRAM
(BID NO. 21-023)
WHEREAS, the City of Elgin has heretofore entered into a contract with Schroeder and
Schroeder, Inc. for the 2022 sidewalk repair program(Bid No. 21-023); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CONTRACT: 2022 Sidewalk Repair Program-Bid 21-023
SCOPE:
This change order will change the 2022 option year of the contract value from$350,000 to $424,852.05,
in order to account for additional work being added to the project for the 2022 construction period.
Bid 21-023 was awarded to Schroeder and Schroeder Inc. in 2021,which included a term of I year with
four (1) year renewal options. 2022 was the first mutually agreed upon renewal option year. Funds
were budgeted in 2022 for the sidewalk repair program in the total amount of$350,000. Additional
work is being added to the 2022 project scope,increasing the contract amount for 2022 by$74,852.05.
REASONS FOR CHANGE:
The scope of work and the amount of territory included in sidewalk repair program were expanded at the
request of citizens and city council input.
The circumstances that necessitate the change in performance described in this change order no. 1 were
not reasonably foreseeable at the time the original contract was signed. The changes provided in this
change order no. 1 are germane to the original contract as signed, and this change order no. 1 is in this
best interest of the City of Elgin and is authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT:
This change order compensates Schroeder and Schroeder Inc. for work additional work to be performed
for 2022 completed under the terms of the contract.

The original amount of the contract with Schroeder and Schroeder Inc. is $350,000. Change order no 1.
will increase the original contract amount by a total of$74,852.05, that sum representing 21.3% of the
original contract amount. The new contract amount, inclusive of all change orders is$424,852.05.
OTHER CONTRACT PROVISIONS: The scope of work and pricing of the original contract for
2022 is amended in accordance with Attachments A,B and C,attached hereto and made a part hereof.
