RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH ARROW ROAD
CONSTRUCTION COMPANY FOR VARIOUS SITE IMPROVEMENTS IN CONNECTION
WITH THE NANCY KIMBALL COBBLESTONE HOUSE
(302 W. Chicago Street)
WHEREAS, the City of Elgin has heretofore entered into a contract with Arrow Road
Construction Company for various site improvements in connection with the Nancy Kimball
Cobblestone House located at 302 W. Chicago Street; and
WHEREAS, it is necessary and desirable to modify the terms of the agreement as is
described in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER No. 1
CONTRACT: Nancy Kimball Cobblestone House Site Improvements
SCOPE: This change order will adjust the time of completion to May 30, 2022. A contract to construct
site improvements, including parking facilities, sidewalks, and ADA access sidewalks,to supplement
the historic masonry building renovations and allow for public access to and use of the Nancy Kimball
Cobblestone House was awarded to Arrow Road Construction Company on November 11, 2021. Since
the award,the onset of winter weather has made construction of the improvements more difficult than
typical. Approval of this change order will add time for the contractor to complete the work next spring,
which staff believes will provide a long-term benefit of higher quality construction.
REASONS FOR CHANGE:
• At the time of the contract award it was anticipated that adequate weather days would be availa-
ble for the specified construction work.
• Oncoming winter weather and colder temperatures have minimized the days when certain con-
struction elements can be performed within specifications.
• The property caretaker (Elgin Historical Society)and contractor are in agreement with staff rec-
ommendation to delay project construction until spring 2022.
• The change is germane to the original contract as signed.
• The change order is in the best interest of the City of Elgin and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: Neither the scope nor cost of the contract
is being amended. The contract amount remains as awarded at$122,645.00. The time for completion is
being extended to May 30, 2022.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract is being amended for time of
completion. There are no amendments for cost or scope.

The original amount of the contract with Arrow Road Construction Company is $122,645.50. Change
Order No. 1 will increase the original contract amount by a total of$0.00 that sum representing 0.00
percent of the original contract amount. The new contract amount, inclusive of all change orders is
$122,645.50.
OTHER CONTRACT PROVISIONS: The Contract provisions are amended such that Article 3, Sec-
tion 3.1 - Work Completion shall be revised to read: "The Work shall be completed as provided in the
Contract Documents. Substantial Completion shall be within 45 calendar days of the revised start date
of April 1, 2022, Final Completion shall be within 60 calendar days of the revised start date of April 1,
2022. In the event of any conflict between these dates and dates elsewhere in the Contract Documents,
these dates shall prevail. Time is of the essence of this Agreement." All other contract provisions re-
main the same.
