RESOLUTION
AUTHORIZING EXECUTION OF A FINAL PLAT OF EASEMENT FROM KANE
HOLDINGS LLC AND ACCEPTANCE FOR OWNERSHIP AND MAINTENANCE
CERTAIN PUBLIC IMPROVEMENTS WITHIN THE SITE LOCATED AT 745 TOLLGATE
ROAD
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized
and directed to execute and accept a Final Plat of Easement for watermain, sidewalk and
stormwater management purposes for 745 Tollgate Road from Tollgate LLC regarding the
property legally described on said plat prepared by R.E. Allen and Associates, LTD. dated
November 5, 2020, last revised on June 7, 2022, a copy of which is attached hereto.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that the City Clerk is hereby authorized and directed to cause said Final Plat of
Easement for 745 Tollgate Road to be recorded in the office of the Recorder of Deeds of Kane
County, Illinois.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that the City of Elgin hereby accepts for ownership and maintenance certain public
improvements within 745 Tollgate Road which will include watermains, valves,vaults, sidewalks
and fire hydrants. Acceptance of the public improvements will add the following City maintained
facilities: Approximately 340 lineal feet of 8-inch watermain; three 8-inch valves in vaults; two
fire hydrants; 336 lineal feet of five-foot-wide sidewalk and their appurtenances to the City
maintained facilities.
