RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH ENGINEERING
ENTERPRISES, INC. AND JOEL KENNEDY CONSTRUCTION CORP. FOR 2021 LEAD
SERVICE LINE REPLACEMENT PROGRAM
(Bid No. 21-004A)
WHEREAS, the City of Elgin has heretofore entered into a contract with Engineering
Enterprises, Inc. and Joel Kennedy Construction Corp. for 2021 Lead Service Line Replacement
Program (Bid No. 21-004A); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER NO. 1 AND FINAL
CONTRACT: 2021 Lead Service Line Replacement Program(Bid No. 21-004A)
SCOPE: As part of the existing project scope, new copper service shall be installed downstream of the
meter to the point of the (new or existing) downstream ball valve. Elgin's plumbing code requires the
installation of a drain valve between the meter and the downstream ball valve. The drain valve was not
included in the bidding documents as drain valves were not anticipated to be installed.
In addition, during the home assessment phase of the construction contract, staff has encountered a few
copper water services upstream of the meter (i.e., between the foundation and the meter), though it is
suspected to be lead between the house and the b-box. To be certain, the contractor will pothole the
service downstream of the b-box to confirm the service line material. If found to be copper, a fee for
potholing the service will be warranted. If lead or galvanized,the potholing fee is waived the service will
be replaced. Potholing was not included in the bidding documents as it was anticipated all services were
known to be lead on the private side.
REASONS FOR CHANGE:
• The circumstances said to necessitate the change in performance in this change order were not
reasonably foreseeable at the time the contract was signed.
• The changes provided in this changer order are germane to the original contract as signed.
• The change order is in the best interests of the City of Elgin and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract amount is revised to add cost
and quantity for the installation of 275 drain valves at$90.00 per valve installed, and for 25 potholes at
$250 for each performed, for a total estimated change in contract amount of$31,000, as follows:
ORIGINAL CONTRACT AMOUNT: $4,221,307.00
CHANGE ORDER NO. 1 AND FINAL
Installation of Drain Valve $24,750.00
Pothole Water Services $6,250.00

The original amount of the contract with Joel Kennedy Constructing Corp. is $4,221,307.00. Change
Order No. I and Final will increase the original contract amount by a total of$31,000.00, that sum
representing 0.73% of the original contract amount. The new contract amount, inclusive of all change
orders, is$4,252,307.00.
OTHER CONTRACT PROVISIONS: All other contract provisions shall remain the same.
