RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 AND FINAL WITH
SCHROEDER AND SCHROEDER INC. FOR 2021 NEIGHBORHOOD SIDEWALK REPAIR
PROGRAM
(BID 21-023)
WHEREAS, the City of Elgin has heretofore entered into a contract with Schroeder and
Schroeder Inc. for 2021 neighborhood sidewalk repair program (Bid 21-023); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 and Final attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9)the City Council
hereby finds that an exception to the requirements of the procurement ordinance is necessary and in
the best interest of the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed to execute
Change Order No. 1 and Final, a copy of which is attached hereto and made a part hereof by
reference.

CONTRACT: 2021 Neighborhood Sidewalk Repair Program -Bid 21-023
SCOPE:
The city annually programs sidewalk repairs to address deficiencies in neighborhoods outside of areas
identified within yearly capital improvement projects. In 2021,29,760 square feet of sidewalk was cho-
sen to be included within program scope. During the course of the project,which began in July of 2021,
additional deficient sidewalk locations were brought to the city's attention and were added to the scope
of the contractors work. This change order addresses the cost for these additional locations which were
not included within the original agreement.
REASONS FOR CHANGE:
The neighborhood sidewalk program, which mobilizes a contracted firm annually to repair deficient
sidewalk, incorporates repairs city wide based on resident reports and preemptive areas identified by city
staff. During the 2021 program, additional work was added to the scope of the project as the city re-
ceived requests from residents who noticed work taking place in their neighborhood and after inspec-
tion,met criteria to be included in the project. An additional project was identified by the parks and rec-
reation department at the southeast corner of N. State St. and Kimball Ave that necessitated sidewalk
repairs that weren't known at the time of the project bid and aided in the ascetics of a project at the same
location. The original contract called for 29,760 total square feet of sidewalk to be removed and re-
placed. This change order covers the cost of the additional 2,963 square feet added to the project scope.

I The circumstances that necessitate the change in performance described in this Change Order No. 1 and
Final were not reasonably foreseeable at the time the original contract was signed. The changes provided
in this Change Order No. 1 and Final are germane to the original contract as signed,and this Change
Order No. 1 and Final is in this best interest of the City of Elgin and authorized by law."
SUMMARY OF CHANGES IN CONTRACT AMOUNT:
Schroeder and Schroeder Inc. completed 2,963 square feet of additional concrete sidewalk work in addi-
tion to work identified within the original contract document. This change order compensates Schroeder
and Schroeder Inc. for work additional work completed

The original amount of the contract with Schroeder and Schroeder Inc. is$332,550 Change Order No 1.
and Final will increase the original contract amount by a total of$25,370.25 that sum representing 7.63
percent of the original contract amount. The new contract amount, inclusive of all change orders is
$357.920.25
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
