RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 AND FINAL WITH TRINE
CONSTRUCTION CORPORATION FOR LORD STREET BASIN COMBINED SEWER
SEPARATION PHASE 5
(BID 19-027)
WHEREAS,the City of Elgin has heretofore entered into a contract with Trine Construction
Corporation for Lord Street basin combined sewer separation phase 5 (Bid 19-027); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 and Final attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS,that pursuant to Elgin Municipal Code Section 5.02.020B(9)the City Council
hereby finds that an exception to the requirements of the procurement ordinance is necessary and in
the best interest of the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS,that Richard G.Kozal,City Manager,be and is hereby authorized and directed to execute
Change Order No. 1 and Final, a copy of which is attached hereto and made a part hereof by
reference.

CONTRACT: Bid No. 19-027-Lord Street Combined Sewer Separation-Phase V
SCOPE:
During excavation along Illinois Route 31 for the proposed 18-inch PVC sanitary sewer,the contractor
encountered challenging ground conditions which caused unexpected curb damage on the west side of
Illinois Route 31. These ground conditions required additional landscape restoration, in addition to the
concrete curb repair. This change order addresses the cost for these additional items.
REASONS FOR CHANGE:
The proposed 18-inch PVC dedicated sanitary sewer line was installed on the west side of Illinois Route
31 between Lord Street and Orange Street at a depth of approximately 20.0-feet from existing grade. The
existing ground is made up of mostly bank run soil. The bank run consists mostly of sand, dirt, and
variable sizes of stone. Once this is disturbed,it is very difficult to maintain trench integrity as the ground
continuously falls into the trench. The ground conditions are not stable. At depths of 20.0-feet,it becomes
more difficult to maintain the stability of the trench walls. The existing curb along the west side of Illinois
Route 31 was undermined and fell into the trench during the necessary excavation activities. The larger
trench due to soil instability also increased the area required for landscape restoration, and this caused a
cost increase.
The changes provided in this Change Order No. 1 and Final are germane to the original contract as signed
and this Change Order No. 1 and Final is in the best interest of the City of Elgin and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT:
The additional cost is for the installation of approximately 300.0—linear feet of barrier curb and additional
landscaping required for restoration of the affected area on Illinois Route 31 between Lord Street and
Orange Street due to poor ground conditions.

The original amount of the contract with Trine Construction is $3,722,353.00. Change Order No. 1 and
Final totaling $41,413.97 will increase the original contract amount by a total of$41,413.97, that sum
representing approximately one and eleven hundredths of a percent (1.11%) of the original contract
amount. The new contract amount, inclusive of all change orders is $3,763,766.97
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.
