RESOLUTION
AUTHORIZING EXECUTION OF A TEMPORARY CONSTRUCTION EASEMENT
AGREEMENT WITH BARBARA CORTEZ FOR THE PURPOSES OF REPLACING
AND RESTORING AN EXISTING STORM SEWER

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby
authorized and directed to execute a temporary construction easement agreement with Barbara
Cortez for the purposes of replacing and restoring an existing storm sewer,for the property legally
described in the temporary construction easement agreement, a copy of which is attached hereto.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to
cause the temporary construction easement agreement to be recorded in the office of the Recorder
of Deeds of Kane County, Illinois.

TEMPORARY CONSTRUCTION EASEMENT AGREEMENT
THIS TEMPORARY CONSTRUCTION EASEMENT AGREEMENT made and
entered into this 18 day of March X020,, by and between the City of Elgin, an Illinois
municipal corporation(hereinafter referred to as the"City"),and Barbara Cortez,a resident of the
State of Illinois(hereinafter referred to as the"Owner").
WITNESSETH
WHEREAS, the Owner owns the real property depicted on plat of easement
prepared by Vanderstappen Land Surveying, Inc., dated October 8,2018,revised August 9, 2019,
attached hereto as Exhibit A and incorporated herein by this reference, commonly known as 374
N. Crystal Avenue, Elgin, Illinois, and having Permanent Index Number 06-14-130-014
(hereinafter referred to as the"Subject Property");and,
WHEREAS,the City desires to obtain a temporary construction easement from the
Owner for the purposes of replacing and restoring an existing storm sewer servicing the Subject
Property and located on the adjacent property commonly known as 382 N. Crystal Avenue,Elgin,
Illinois, the temporary construction easement area being depicted and legally described on the
above-referenced Exhibit A (hereinafter referred to as the "Temporary Construction Easement
Premises"); and,
WHEREAS, the Owner has agreed to grant such temporary construction easement
to the City for such purposes and pursuant to the terms and conditions of this Temporary
Construction Easement Agreement.

NOW, THEREFORE, for and in consideration of One Thousand One Hundred
Fifty Dollars ($1,150.00) in hand paid to Owners, and other good and valuable consideration,the
receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows:
1. That the Owner does hereby grant to the City a temporary construction
easement allowing access over,within,under,along,across and through,and use of the Temporary
Construction Easement Premises for the purpose of constructing, installing, reconstructing,
replacing, inspecting,maintaining,repairing,or renewing the storm sewer located on the property
adjacent to the Subject Property, together with the right of reasonable and necessary ingress and
egress to and from the Temporary Construction Easement Premises with such personnel and
equipment as may be deemed reasonably necessary in connection with the exercise of the rights
granted herein.
2. That, in addition, the City agrees to and shall replace the existing asphalt
driveway located within the Temporary Construction Easement Premises on the Subject Property
in conjunction with its construction work in the Temporary Construction Easement Premises.
2. The temporary construction easement hereby granted shall begin upon the
date of the commencement of construction activities on the Temporary Construction Easement
Premises, and shall be deemed terminated after the three (3) year period following the
commencement of construction activities on the Temporary Construction Easement Premises.
3. That Owner shall have and retain all rights to use and occupy the Subject
Property except as otherwise herein expressly granted; provided, however, that Owner's use and
occupation of the Temporary Construction Easement Premises may not interfere with the City's
use of the Temporary Construction Easement Premises for the purposes herein described.
4. That following the exercise by the City of any easement rights granted herein,
the City shall promptly repair and restore the Temporary Construction Easement Premises to the
same condition as existed immediately prior to the existence of such rights as is reasonably
practicable, and shall leave the Temporary Construction Easement Premises and surrounding
premises free from debris; provided, however, that the City shall not replace any trees within the

on the Subject Property, the parties agreeing that the amount of consideration to the Owner set
forth herein includes the value of any such damage to or removal of trees on the Subject Property,
and further agreeing that the Owner shall not be entitled to any additional compensation for the
same.
5. That the City for itself, its agents and independent contractors, hereby agrees
to indemnify and hold the Owner and its successors harmless from third party claims for personal
injuries or property damage arising directly as a result of the City's work in the Temporary
Construction Easement Premises during construction or during any subsequent maintenance or
repair thereof. The City further agrees to indemnify and hold harmless the Owner from any and
all liens placed against the Subject Property arising from said construction activities.
6. That no amendment,revision or modification hereof shall be effective unless
it is in writing and signed by all parties hereto.
7. That this Temporary Construction Easement Agreement constitutes the entire
agreement between the parties and is intended as a complete and exclusive statement of the terms
of the parties agreement, and it supersedes all prior and concurrent promises, representations,
proposals, negotiations, discussions and agreements that may have been made in connection with
the subject matter hereof.
8. That this Temporary Construction Easement Agreement shall be governed by
and construed in accordance with the laws of the State of Illinois. Venue for the resolution of any
disputes or the enforcement of any rights pursuant to this agreement shall be in the Circuit Court
of Kane County, Illinois.
9. That the City may utilize the services of third party contractors, employees
or other agents to perform work on the Temporary Construction Easement Premises.
10. That the Owner hereby represents and warrants to the City that it is the fee
simple title holder of the Subject Property and the Temporary Construction Easement Premises,
and that it has the full power and authority to enter into and make the grant of easement as provided
herein.

11. That this agreement shall be binding on the parties hereto, their successors
and permitted assigns and shall run with the land.
12. That this agreement does not and in no event shall be construed to constitute
any waiver or limitation of any existing easement rights that the City has in the Subject Property.
13. That this agreement may be executed in multiple counterparts, each of which
shall be deemed an original,but all of which together shall constitute one and the same instrument.
14. That this agreement shall be recorded by the City at the City's cost with the
Kane County Recorder.
