OF NORTH AMERICA FOR THE ENVIRONMENTAL REMEDIATION OF CITY OF ELGIN PROPERTY AT 40 ANN STREET, ELGIN, ILLINOIS WHEREAS, the City of Elgin has heretofore entered into a contract with Ramboll Americas Integrated Solutions, Inc. f/k/a O'Brien & Gere, Inc. of North America for environmental remediation of City of Elgin property at 40 Ann Street, Elgin, Illinois; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1 attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interest of the city; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. SCOPE: Provide for additional soil remediation services and remove specified unnecessary scope of work items for the city -owned property at 40 Ann Street, Elgin, IL, pursuant to the Consultant's proposal dated December 3, 2020, attached hereto as Exhibit A. REASONS FOR CHANGE: Additional contaminated soils were encountered beyond the anticipated limits of excavation in a remediation area at the southwest portion of the subject property. Additional excavation and removal of these contaminated soils is appropriate. Several other scope of work items are no longer necessary and will be removed from the agreement. • The circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed • The change is germane to the original contract as signed • The change order is in the best interests of the City of Elgin and authorized by law SUMMARY OF CHANGES IN CONTRACT pursuant to this Change Order No. 1 as follows: ORIGINAL CONTRACT AMOUNT: CHANGE ORDER No. 1 Additional remediation services TOTAL FOR CHANGE ORDER NO. 1: TOTAL REVISED CONTRACT AMOUNT: AMOUNT: The cost of the contract is being increased $55,828.00 ADD $55,828.00 $1,275,195.00 $1,331,023.00 The original amount of the contract with O'Brien & Gere, Inc. of North America Inc is $1,275,195.00. Change Order No. 1 totaling $55,828.00 will increase the original contract amount by a total of $55,828.00, that sum representing 4.2 percent increase of the original contract amount. The new contract amount, inclusive of all change orders is $1,331,023.00. SCHEDULE: Consultant will conduct the additional work authorized pursuant to this Change Order No. 1 within four weeks after receipt of authorization to proceed, weather permitting. Wacker Drive Suite 2700 BACKGROUND Chicago, IL60606 USA ELGIN PUBLIC WORKS YARD - 40 ANN STREET T 312-288-3800 Under our existing contract dated August 16, 2020 with the City of Elgin, soil www.ramboll.com remediation services at the 40 Ann Street site were initiated in late August 2020 and have proceeded to a point nearing completion. Of the six Soil Remediation Areas (SRAs) on the site, all have been excavated to the originally planned limits Ref. 1950100024/61925 or slightly further. As the excavation continued in the far southwest portion of the site, denoted by Ramboll as SRA#4 and is closest to the Fox River, soils were encountered beyond the anticipated limits of excavation. Soils impacted with elevated Lead and Polynuclear Aromatic Hydrocarbon (PNA) concentrations continue to exceed the residential remediation objectives. In fact, as the excavation continued south toward the south boundary (i.e., property line between 40 Ann Street and the Gail Borden Library), the PNA and Lead impacts encountered were at higher concentrations than the estimated source area. Visual observations indicated a high degree of discolored soil and debris, such as old bottles, intermixed with the fill material. This is contrary to the conceptual site model that identified the primary source material in this SRA to be releases related to past petroleum tanks (either aboveground or underground) that were associated with the former Reinhart Oil facility, located in the northern portion of SRA#4. Exhibit A, attached, depicts the additional soil remediation area that is recommended for removal to attain the City's redevelopment objectives. To proceed with the remediation and meet the City's objectives for minimal restrictions on the property, Ramboll proposes this Change Order #1 to provide funding for additional soil remediation services. SCOPE OF SERVICES Ramboll will perform the following additional remediation services site. 1/3 C0#1-Elgin 40 Ann Street Addl Remediation.docx • Advance the excavation of SRA #4 further south to the property boundary with the Gail Borden Library. East-West limits of the excavation will be defined by a clean soil boring to the west, DB-12 and a previously collected confirmation soil sample, SRA4-EW-063R. This area is triangular in shape with nominal dimensions of 60 by 65 feet and the expected depth will not exceed 8 feet. The additional excavation area will stay within the property boundary owned by the City. The target area is depicted in Exhibit A, attached. The estimated additional work quantities are as follows: — 1,350 tons of impacted soil for removal and landfill disposal — 1,700 tons of CA-6 backfill — 100 tons of clean topsoil for restoration — 190 tons of additional on -site concrete that was previously encountered on -site — 1 lot of tree root balls, cut up on site and disposed of as impacted material — 1 remobilization to the site • Attendant with this additional work, Ramboll personnel will be present during excavation to continue field oversight for up to three additional days of service. • Additional soil samples will be required for the expanded excavation area. However, the current budget for laboratory work is sufficient to address approximately eight samples, so no additional budget is requested. Since the remediation work is 95% complete, the following work items are removed from the scope of services in the form of a scope modification. These work items have not been needed to date and are no longer anticipated. Removal of these items from the scope frees up the corresponding budget so that it can be applied to the additional soil remediation work that was found to be necessary. These items are itemized below: • Removal and replacement of 100 LF of 24-inch storm sewer • Removal and replacement of 100 LF of 36-inch storm sewer • Provision for one frac tank to containerize on -site groundwater • Collection and disposal of 42,000 gallons of impacted groundwater. The sewers cited above did not require removal and replacement. Remediation work was able to be performed around the existing storm sewers that discharge to the Fox River. Ramboll's subcontractor was able to excavate to the required depths in each SRA without employing external tankage and containerization of groundwater for off -site disposal. This was generally a factor of a low groundwater table and more limited precipitation during the remediation work. BUDGET CHANGE Ramboll proposes to complete the additional soil remediation work as described herein on a time and materials/unit cost basis with a Change Order amount not -to -exceed $58,828. This is a net cost change in consideration of the extra work and the deduction of selected scope items that are not anticipated. The Change Order includes our subcontractor's costs, Ramboll's professional labor costs, travel and direct expenses required to complete this scope of work. All unit rates for subcontract work will be held the same as the original contract and Ramboll will maintain the same labor rates through June 20, 2021. Services will be performed in accordance with the terms and conditions of the Agreement between the City of Elgin and O'Brien & Gere Inc. of North America dated August 26, 2020. SCHEDULE Ramboll will conduct the work within 4 weeks after receipt of authorization to proceed, weather permitting.
