O'NEIL CONSTRUCTION FOR THE CIVIC CENTER PLAZA IMPROVEMENTS (BID NO. 20-030) WHEREAS, the City of Elgin has heretofore entered into a contract with W.E. O'Neil Construction for civic center plaza improvements (Bid No. 20-030); and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1 attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, -be and is hereby authorized and directed to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by reference. s/ David J. Kaptain David J. Kaptain, Mayor Presented:: December 16, 2020 Adopted: : December 16, 2020 Vote: Yeas: 9 Nays: 0 Attest: s/ Kimberly Dewis Kimberly Dewis, City Clerk City of Elgin Change Order 40 MAL ELGIN, ILLINOIS PROJECT: Civic Center Plaza Improvements CHANGE ORDER No. 1 CONTRACT: Civic Center Plaza Improvements (Bid No. 20-030) SCOPE: This change order will amend the contract between the City of Elgin ("City") and W.E. O'Neil Construction ("Contractor") to provide a revised completion date for the above stated contract subject to the terms and conditions in this change order. The project was to be completed on November 27, 2020. The time extension would suspend the project from December 12, 2020, until April 1, 2021 and establish a revised completion date of June 1, 2021, giving the Contractor two months to complete the remaining work on the project including landscape planting, establish turf areas, test irrigation and lighting systems, correct punch list items, complete the commissioning process, and closeout the project per the construction documents. Terms and Conditions of Change Order No. 1 include: • Contractor shall complete by December 11, 2020, all non -landscaping items for the project, except for the following work items: ■ Hemmens Kiosk reinstallation ■ Gifford sculpture relocation • Punch list items to be identified by the City • Contractor shall provide for planting by December 11, 2020, of landscape items identified on Attachment A-1 ("Plants Guaranteed Revised" list dated November 11, 2020 submitted by Landscape Construction Corporation) per contract specifications. Substitution of 9 red pointe maples in place of the skyline honey locusts listed in Attachment A-1, at the locations identified on the plans. City agrees to begin 12 month warranty for these specific trees upon approved planting. • Contractor shall also provide by December 11, 2020, for (1) all turf areas to be graded to eliminate holes, drop-offs and hazardous conditions; (2) winter seed mix and erosion control blanket (per MOT specifications) placed on all turf areas; (3) rough grade soil within all non -turf planting areas; and (3) silt fence placed around all storm water inlets located within soil/turf areas. • Project is suspended from December 12, 2020, until April 1, 2021, with a revised completion date of June 1, 2021. Contractor shall resume work on the project on April 1, 2021. All remaining work for the project, including but not limited to, landscape items, including turf, shall be completed per specifications by the revised completion date of June 1, 2021. • Upon project resumption on April 1, 2021, all remaining landscape areas shall be prepared per contract specifications for planting. • Perimeter chain link security fence to remain in place and maintained by Contractor through project completion. • That as except amended in this Change Order No. 1, the Original Agreement between the City and the Contractor shall remain in full force and effect. REASONS FOR CHANGE: The majority of the hardscape items will be constructed this year, but as the season has progressed the landscape subcontractor has made a recommendation to delay the planting of some plant items until April, 2021 due to their greater vulnerability to colder temperatures. Approval of this change order would allow the Contractor to delay planting of some landscape items until temperature conditions are more favorable to plant survivability which will decrease the possibility of having to replace plantings after the Plaza opens to the public. The change order is germane to the original contract as signed and the change order is in the best interests of the City of Elgin and authorized by law. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The contract is not being amended as to cost. All costs relating to or arising out of this Change Order No. 1 are the responsibility of the Contactor. ORIGINAL CONTRACT AMOUNT: $2,050,174 CHANGE ORDER No. 1 Contract Time Extension $0 TOTAL FOR CHANGE ORDER NO. 1: ADD $0 PREVIOUS CHANGE ORDER(S): None $0 TOTAL OF PREVIOUS CHANGE ORDERS: ADD $0 TOTAL REVISED CONTRACT AMOUNT: $2,050,174 The original amount of the contract with W.E. O'Neil Construction is $2,050,174. Change Order No.1 and previous change orders totaling $0 will increase the original contract amount by a total of $0, that sum representing 0% percent of the original contract amount. The new contract amount, inclusive of all change orders is $2,050,174. EXECUTION: The parties acknowledge and agree that this Change Order No. 1 may also be executed by electronic signature, which shall be considered as an original signature for all purposes and shall have the same force and effect as an original signature.
