RESOLUTION
AUTHORIZING EXECUTION OF A SALES AGREEMENT WITH
STEPHEN M. KITE, JR. FOR TRANSFER OF A RETIRED POLICE CANINE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that
an exception to the requirements of the procurement ordinance is necessary and in the best
interest of the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute a Sales Agreement on behalf of the City of Elgin with
Stephen M. Kite, Jr., for transfer of a police canine, a copy of which is attached hereto and made
a part hereof by reference.

SALES AGREEMENT
THIS AGREEMENT is hereby made and entered into this 12th day of February , 2020,
by and between the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as "City")
and Stephen M. Kite, Jr. (hereinafter referred to as "Kite").
WHEREAS, the City owns a 4-year-old German shepherd which was put into service May
2017 (hereinafter referred to as "Tango"); and
WHEREAS, Tango is nearing the end of his service life; and
WHEREAS, Kite is the police officer handler of Tango; and
WHEREAS, the City and Kite have determined that it is appropriate for the City to transfer
and convey_Tan;o to Kite which whereupon Kite shall be responsible for the care of Kite.
NOW, THEREFORE, for and in consideration of the mutual promises and covenants
provided for herein, the sufficiency of which is mutually acknowledged, the parties hereto hereby
agree as follows:
1. The above recitals are incorporated into and made a part of this agreement as if fully
recited herein.
2. Kite shall pay the sum of one dollar($1) to the City.
3. The City hereby transfers and conveys all of its right, title and interest in Tango to
Kite, without any representations or warranties, effective as of the date of this
agreement. Kite understands and agrees that upon such transfer and conveyance that
Kite shall be responsible for all costs of Tango including all care and maintenance.
