IN THE CITY OF ELGIN
WHEREAS, on January 30, 2020, the World Health Organization declared the outbreak of
COVID-19 virus to be a public health emergency of international concern and on March 11, 2020
declared a.worldwide pandemic; and
WHEREAS, on January 31, 2020, the U.S. Health and Human Services Secretary declared
a public health emergency for the United States; and
WHEREAS, on March 9, 2020, the.Governor of the State of Illinois has issued a disaster
proclamation due to the impact of the COVID-19 virus and has activated the State Emergency
Operations Center; and
WHEREAS, the State Emergency Management Agency has declared a public health
emergency due to the impact of the COVID-19 virus; and
WHEREAS, on March 13, 2020, the President of the United States declared a national
emergency due to the impact of the COVID-19 virus; and
WHEREAS, Chapter 2.76 of the Elgin Municipal Code, 1976, as amended, provides for
and clarifies the authority of the City of Elgin and its officers and employees with regard to
emergency and disaster situations; and
WHEREAS, Section 2.76.030 of the Elgin Municipal Code provides in part that whenever
a disaster or emergency exists, the Mayor may by written proclamation declare a state of
emergency after signing, under oath, a statement finding that conditions constituting a disaster or
emergency exist, setting forth facts to substantiate such findings and describing the nature of the
emergency; and
WHEREAS, the City of Elgin is a home rule unit pursuant to Article VII Section 6 of the
Illinois Constitution; and
NOW, THEREFORE, it is hereby proclaimed by Mayor David J. Kaptain as follows:
1. Incorporation of Recitals: The foregoing recitals are hereby incorporated into this
proclamation in their entirety.
2. Declaration of a State of Emergency. Pursuant to the power granted to me by Chapter
2.76 of the Elgin Municipal Code, 1976, as amended, I, Davi&J. Kaptain, Mayor of the City of
Elgin, Illinois, hereby declare the existence of the state of emergency in the City of Elgin related
to the COVID-19 virus.
3. Statement of Emergency. The emergency is related to the COVID-19 virus which is
causing or anticipated to cause widespread impacts on the health of members of the community.
In this matter, 1 am relying upon each and every matter recited in the recitals hereto.

4. Powers During Emergency. Pursuant to Chapter 2.76 of the Elgin Municipal Code,
including, but not limited to, Sections 2.76.040 and 2.76.120 thereof, I hereby delegate to and
authorize the City Manager to perform the following emergency powers:
A. To procure by purchase or lease, such goods and services are deemed necessary for
the city's emergency response effort. A full written account and records regarding
such procurements shall be made and provided by the City Manager pursuant to the
Elgin Municipal Code Section 2.76.120.
B. The power to lease real property, structures,or both., when the City Manager deems
necessary for the continued operation of city government.
C. In consultation with the Mayor, the power to promulgate rules and orders to
implement and clarify this mayoral proclamation exercising emergency powers.
D. In consultation with the Mayor, the power to close city buildings and facilities in
whole or in part and the power to prohibit or limit the number of persons who enter
into or gather or congregate in any city building or facility.
E. In consultation with the Mayor, the power to adopt rules for the expeditious
issuance of permits necessary to address issues which arise from the emergency.
F. In consultation with the Mayor, to the extent sufficient funds are available and
budgeted, to redirect City funds to pay expenses incurred as a result of responding
to the state of emergency.
5. Additional Powers and Duties of the City Manager-as Director of Disaster Services.
Pursuant to Section 2.76.080 of the Elgin Municipal Code, the City Manager is the City's Director
of Disaster Services and shall also be responsible for the performance and supervision of
performance of all duties in connection with coordinating and carrying out the City's part in
furnishing services during this emergency all as provided in Section 2.76.080 of the Elgin
Municipal Code. Pursuant,to.Section 2.76.100 of the Elgin Municipal Code, the City Manager, as
the Director of Disaster Services for the City be and is hereby authorized to perform the other
specific powers and duties of the City's Director of Disaster Services including, but,not limited to
the following emergency powers:
A. Control and direct emergency training activities.
B. Maintain a liaison with other municipal, county, state,regional and Federal disaster
services agencies.
C. Marshal, after the declaration of a state of emergency, all necessary personnel,
equipment and supplies from any department of the City to aid in carrying out the
emergency operations plan.
D. Prepare under the direction of�the Mayor and in consultation with the Corporation
Counsel, all necessary emergency proclamations, rules and orders, pursuant to _

Sections 2.76.030 and 2.76.040 of Chapter 2.76 of the Elgin Municipal Code, and
implement the emergency management plan.
E. Coordinate in consultation with the Corporation Counsel the drafting of proposed
mutual aid agreements.
F. Serve as an operations officer for any joint or mutual emergency operation
administration.
G. Assume other emergency responsibilities as assigned by the Mayor or City Council.
6. Reports. The City Manager shall, within three months of the conclusion of the emergency,
formally communicate any emergency expenditures in a full-written account to the City Council.
The City Manager shall also, as circumstances permit during this state of emergency, make
periodic reports to the City Council regarding emergency response efforts and the impact of the
emergency on city operations.
7. Filing and Posting. The City Manager is hereby directed to file this proclamation and
statement with the City Clerk as soon as practicable. The City Manager or his designee, shall also
provide copies of this proclamation to the members of the City Council, City staff, the news media
and shall post copies at the police station, fire stations and city hall.
8. Effective Date and Termination. This proclamation and declaration of emergency is
effective on March 13, 2020, at �-'. /�o'clock, p.m. This proclamation and the
declaration of the state of emergency in the City of Elgin shall remain in effect until withdrawn by
the Mayor or the City Council.
