RESOLUTION
ACCEPTING A GRANT OF EASEMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that it hereby accepts a plat of grant of easement from Howard Bruce Andersen and
Marilyn C. Andersen for the property legally described as follows:
Lot 144 in Valley Creek Unit No. 5 in the City of Elgin, Kane County,
Illinois; and also that part of Lot 430 of Valley Creek Unit No. 10, being a
subdivision of part of Section 9, Township 41 North, Range 8 East of the
Third Principal Meridian, lying southerly of a line described as follows:
Beginning at the southwesterly corner of said Lot 430; thence South 87
degrees 35 minutes 00 seconds East, a distance of 122.33 feet to a point on
the northeasterly line of said Lot 430 that is 15.64 feet, as measured along
said northeasterly line, northwesterly of the most easterly corner of said
Lot 430 for the terminus of said described line, being situated in the City
of Elgin, Kane County, Illinois.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed
to cause the Grant of Easement hereby accepted to be recorded in the office of the
Recorder of Deeds of Kane County, Illinois.

GRANT OF EASEMENT
THIS Grant of Easement made and entered into this 8th day of
December, 1988 , by and between HOWARD BRUCE ANDERSEN and MARILYN C .
ANDERSEN, his wife, (hereinafter called Andersen) and The CITY OF
ELGIN, an Illinois Municipal Corporation, (hereinafter called City) .
WITNESSTH
WHEREAS , Andersen is the owner of the real estate described
herein on Exhibit A, which is improved with a single family residence ;
WHEREAS , Andersen desires to grant and City desires to receive an
easement for public utilities , water and sewer purposes over the
northerly five feet of the real estate described on Exhibit A;
NOW, THEREFORE , in consideration of the premises and covenants
contained herein, the receipt and sufficiency of which is hereby
acknowledged, it is agreed as follows :
1 . Andersen, joint and severally, hereby convey and grant to
City, their successors and assigns an easement over the northerly five
feet of the real estate described on Exhibit A for the purposes of
installing, operating and maintaining utility lines and mains thereon ,
together with the right to trim and/or cut or remove any trees and/or
brush and the right to locate guy wires , braces and anchors wherever
necessary, for said installations , operations or maintenance; together
with the right to install , operate and maintain gas and water mains ,
sewer lines , culverts, and drainage ditches , and other services and
appurtenances thereto .
2 . All provisions of this Grant , including the benefits and
burdens , run with the land and are binding upon and inure to the
benefit of the heirs , assigns , successors , and personal
representatives of the parties hereto .
IN WITNESS WHEREOF, the parties have hereunto executed this Grant
of Easement on the date above written.

Dear Ms. Yearman:
For your reference I have enclosed herein a copy of Ralph L.
Ridley' s correspondence to me dated November 22 , 1988 on the
above matter.
Accordingly I have enclosed herein the original Release Of
Easement duly executed by my clients which needs to be executed
by the City of Elgin and then recorded.
Secondly, I have enclosed the original Grant Of Easement which
has been duly executed by my clients. This needs to be recorded
along with the Release Of Easement .
Mr. Ridley suggests in his correspondence that you will see that
these documents are recorded. In the event that you wish me to
do the recording, kindly return both original documents to the
undersigned.
In any event , I would like to see these documents recorded at the
earliest possible time and thus I ask for your prompt attention
to this matter .
If in fact you do the recording, kindly forward to me a copy of
your lette • .f transmittal to the Kane County Recorder ' s Office.
