RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
TENNIS SURFACES COMPANY FOR TENNIS COURT RESURFACING
AT ST. FRANCIS PARK
WHEREAS, the City of Elgin has heretofore entered into a contract with Tennis Surfaces
Company for tennis court resurfacing at St. Francis Park; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS,that Sean R, Stegall, City Manager,be and is hereby authorized and directed to
execute Change Order No. 1,a copy of which is attached hereto and made a part hereof by reference.

CHANGE ORDER No. 1
CONTRACT: Tennis Court Improvements (Bid No. 09-029)
SCOPE: This change order includes two additional tennis courts to be resurfaced. In addition to
the six courts at Judson University, the resurfacing project will include the two courts at St
Francis Park.
REASONS FOR CHANGE: The bid submitted by Tennis Surfaces Company was $11,000
below the amount budgeted for this work. Therefore there are enough funds in the budget to
cover the cost of two additional tennis courts in need of resurfacing at St Francis Park. This
change order is in the best interests of the City of Elgin and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be
amended as to scope and costs to include the improvements outlined above.
ORIGINAL CONTRACT AMOUNT $14,900
CHANGE ORDER No. 1 $ 6,000
TOTAL REVISED CONTRACT AMOUNT: $20,900
The original amount of the contract with Tennis Surfaces Company is $14,900. Change Order
No.1 will increase the original contract amount by a total of$6,000, which represents
approximately forty percent (40%) of the original contract amount. The new contract amount,
inclusive of all change orders, is $20,900.
OTHER CONTRACT PROVISIONS: All other contract provisions remain the same.

SUBJECT: Change Order No. 1 to Contract with Tennis Surfaces Company
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider Change Order No.1 with Tennis Surfaces Company for the resurfacing
of the tennis courts at St. Francis Park.
RECOMMENDATION
It is recommended that the City Council approve Change Order No.1 with Tennis Surfaces
Company in the amount of$6,000,making the total contract amount$20,900.
BACKGROUND
The City Council approved a contract with Tennis Surfaces Company in the amount of$14,900
in order to resurface six tennis courts at Judson University, which will be available to the
residents of Elgin. The 2009 budget has allocated $26,000 for this work. Since the actual
contract award was approximately $11,000 less than the budget allocated, and the two tennis
courts at St. Francis Park were in need of being resurfaced,it was recommended that they should
be resurfaced as part of this contract.
The amount of the change order is reasonable considering that the cost per court of$3,000 for
these additional courts is lower than other recent bids received for court resurfacing. The change
order reflects a 40 percent increase to the original contract.

FINANCIAL IMPACT
The cost of Change Order No. 1 with Tennis Surfaces Company totals $6,000. There are
sufficient funds budgeted ($26,000) and available ($11,100) in the Park Development Fund,
account number 340-0000-795.92-32, project number 509831, Tennis Court Improvements to
pay for the change order.
LEGAL IMPACT
None.
ALTERNATIVES
1. The City Council may choose to approve Change Order No. 1 with Tennis Surfaces
Company in the amount of$6,000.
2. The City Council may choose not to approve Change Order No. 1 with Tennis Surfaces
Company in the amount of$6,000.
