Project Sponsor: City of Elgin 2. Project Title:Illinois Hammond Park The City of Elgin hereby certifies and acknowledges that it has 100%of the funds (local project sponsor) necessary(includes cash and value of donated land)to complete the pending OSLAD/LWCF project within the timeframes specified herein for project execution,and that failure to adhere to the specified project timeframe or failure to proceed with the project because of insufficient funds or change in local recreation priorities is sufficient cause for project grant termination which will also result in the ineligibility of the local project sponsor for subsequent Illinois DNR outdoor recreation grant assistance consideration in the next two(2)consecutive grant cycles following project termination. Acquisition Projects It is understood that the project sponsor has up to twelve(12)months following project approval to acquire the subject property(petition to condemn must be filed for acquisitions involving eminent domain)and three(3)months following acquisition closing to submit a final reimbursement billing request to the IDNR(excluding eminent domain cases). Development Proiects It is understood that the local project sponsor has six (6) months following project approval to initiate project development and a total of 24 months to complete said development with a Final Billing request submitted to IDNR within three(3)months following completion. The City of Elgin further acknowledges and certifies that it will comply with all (local projects nsor) terms,conditions and regulations of 1)the Open Space Lands Acquisition and Development(OSLAD)program(17 IL Adm. Code 3025)or federal Land&Water Conservation Fund(LWCF)program(17 IL Adm.Code 3030),as applicable,2)the federal Uniform Relocation Assistance&Real Property Acquisition Policies Act of 1970(P.L.91-646)and/or the Illinois Displaced Persons Relocation Act(310 ILCS 40 et. seq.),as applicable, 3)the Illinois Human Rights Act(775 ILCS 5/1-101 et.seq.),4) Title VI of the Civil Rights Act of 1964,(P.L.83-352),5)the Age Discrimination Act of 1975(P.L.94-135),6)the Civil Rights Restoration Act of 1988,(P.L. 100-259)and 7)the Americans with Disabilities Act of 1990(PL 101-336);and will maintain the project area in an attractive and safe conditions,keep the facilities open to the general public during reasonable hours consistent with the type of facility,and obtain from the Illinois DNR written approval for any change or conversion of approved outdoor recreation use of the project site prior to initiating such change or conversion;and for property acquired with OSLAD/LWCF assistance,agree to place a covenant restriction on the project property deed at the time of recording that stipulates the property must be used,in perpetuity,for public outdoor recreation purposes in accordance with the OSLAD/LWCF programs and cannot be sold or exchanged, in whole or part,to another party without approval from the Illinois DNR. This Resolution of Authorization has been duly discussed and adopted by the City of Elgin n� (local project sponsor) at a legal meeting held on the own day of duly 20 08 (Aut orized Signature) Mayor of Elgin ATTESTED BY: (title) City Clerk (title) Rev. 1/01 4 r_ • July 3, 2008 TO: Mayor and Members of the City Council FROM: Olufemi Folarin, City Manager Randy Reopelle, Parks and Recreation Director SUBJECT: OSLAD Grant Application for Park Improvements at Illinois-Hammond Park PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to approve an OSLAD grant application through the Illinois Department of Natural Resources to assist with the development of City-owned property at Illinois and Hammond Streets. RECOMMENDATION It is recommended the City Council approve the OSLAD grant application through the Illinois Department of Natural Resources to assist with the development of City-owned property at Illinois and Hammond Streets. BACKGROUND The City of Elgin's Parks and Recreation Master Plan has as one of its highest priorities the development of additional neighborhood parks in the southeast portion of the City. The City owns just over one acre of vacant land located at Illinois and Hammond Streets. These parcels were acquired over the past 11 years as part of an effort to purchase and remove homes located in the floodplain. The neighborhood situated south of Route 20 and east of Route 25 contains 1,424 residents. Given the City's park standards, there should be at least 14 acres of park land to serve this neighborhood. Currently there are no parks. The closest neighborhood park is about 1/2 mile from this new park and it is difficult for the residents of this neighborhood to use it because it is north of Route 20, which acts as a major barrier between the residents and the park location. For years, the neighborhood group representing this section of town, Neighbors of Southeast Elgin, have desired a neighborhood park be located on these parcels. The Parks and Recreation Board hosted neighborhood input meetings for this park site at their March 18, April 29, May 27 and June 24 regularly scheduled meetings. Based on the input from OSLAD Grant Application for Illinois Hammond Park July 3, 2008 Page 2 the Board and neighborhood residents, the attached concept plan was created and was recommended by the Parks and Recreation Board at their June 24 meeting. The attached concept plan includes the following recreation elements — three basketball goals, picnic shelter, "nature adventure course" playground, two horseshoe pits, youth soccer goal for practice shots, nature information kiosk and a trail link connection to a future path. Based on the City's current park inventory, there is a deficit in the number of these elements in the community. Because of these deficits, the lack of a neighborhood park in this area and the higher percentage of low/moderate income households residing in this neighborhood, staff anticipates that this project will qualify for an Illinois Department of Natural Resources' OSLAD grant. The estimated budget for these park improvements is $397,536. The request for funding through the OSLAD grant could be up to 50% of the total costs or $198,768. The remaining 50% funding has yet to be identified but would need to come from another funding source such as park impact fees or riverboat revenue. The City should be notified by fall, 2008 if the grant application is a finalist at which time approval to move forward with the project will be requested from the City Council. The process of applying for the grant does not obligate the City to expend funds or construct the park. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Neighbors of this park site were notified and attended three Parks and Recreation Board planning meetings for the park site. FINANCIAL IMPACT The City will be required to pay 100% of the project costs upfront, which is estimated to be $397,536. Currently there are no funds budgeted for neighborhood park improvements in the 2008-2102 Five Year Financial Plan and approximately $60,000 available in neighborhood Park Impact Fees. Upon successful project completion, and assuming the grant application is successful, the City will be reimbursed up to $194,029 by the State of Illinois. The Council may choose to approve the application for an OSLAD grant to help fund the development of the Illinois-Hammond Park. 2.
