HomeMy WebLinkAbout07-278 Resolution No. 07-278 RESOLUTION APPROVING CHANGE ORDER NO. 3 AND FINAL IN THE CONTRACT WITH BRANDENBURG INDUSTRIAL SERVICES FOR DEMOLITION OF VARIOUS CITY OWNED BUILDINGS WHEREAS, the City of Elgin has heretofore entered into a contract with Brandenburg Industrial Services, for demolition of various city owned buildings; and WHEREAS,it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 3 and Final, attached hereto. Chicago, IL, an Illinois corporation, dated June 27, 2006 for the Demolition of Various Buildings. This Change Order No. 3 and final, will provide for the removal of additional debris along McBride St. and at Water Road. These items could not be seen until demolition was well under way therefore removal was unforeseen at the time of the award of the original contract. REASONS FOR CHANGE: This Change Order No. 3 and final, is in the best interests of the City and is authorized by law. The necessity for the changes was unforeseen at the time of the original agreement, and the changes contemplated hereby are germane to the original agreement. SUMMARY OF CHANGES IN CONTRACT AMOUNT: The original contract will be amended as to scope and costs to include additional work as in attachment A and summarized below: Water Road—additional debris removal $3,950.00 McBride St.—Removal of additional debris $14,160.00 Ann St. —Credit for not seeding - $2,000.00 Total $16,110.00 The original contract with Brandenburg Industrial Service Co. was $720,200.00. By reason of Change Order No. 1 and 2 the contract for the Demolition Project was increased in the amount of $135,205.96 or approximately 19%of the original contract amount. The new contract amount, inclusive of all three Change Orders is eight hundred seventy one thousand five hundred fifteen and 96/100 dollars ($871,515.96). This results in a total increase over the original amount of approximately twenty-one percent(21%). OTHER CONTRACT PROVISIONS: All other contract provisions shall remain the same. RECOMMENDATION It is recommended that the City Council approve Change Order # 3 with Brandenburg Industrial Service of Chicago, IL, in the amount of$16,110 for additional work related to the demolition and site cleanup at 51 N. State Street (Unilever), 40 Ann Street (former Public Works site) and the Water Road park. BACKGROUND A contract in the amount of $720,200 was awarded to Brandenberg Industrial Services at the June 14, 2006 City Council meeting for demolition at various sites. Change order # 1, in the amount of $19,140.96, was approved on September 27, 2006 for ComEd costs related to transformer removal at the Unilever site. Change order # 2, in the amount of $116,065 was approved on November 29, 2006 for tank removal and sod installation at the Unilever site and extra debris removal at Ann Street. As work wrapped up on the sites some unforeseen issues were discovered. Additional debris was found buried near the barn at Water Road and on the old Public Works site seeding was not completed due to the need for environmental work. Additional debris was also removed along McBride Street near the Public works site. The new and final amount of Brandenburg's contract, including previous change orders will total $871,515.96. A copy of the change order is attached for your review. There are sufficient funds budgeted ($661,000) and available ($37,539) in the Riverboat Fund, account number 275-0000-791.92-32, "Capital Additions/Land Improvements," project number 030099 "Property Demolition,"to pay for the cost of this change order. LEGAL IMPACT None ALTERNATIVES 1. Approve Change Order#3 with Brandenburg Industrial Services. 2. Reject the Change Order and stop the project. Respectfully submitted for Council consideration.
