This Agreement is hereby made and entered into this of
,(Q,prlyµ,bLh , 2007, by and between the City of Elgin, Illinois, a
municipal corporation (hereinafter referred to as "City") and the
Elgin Opera Company, a hereinafter
referred to as "Artist") . In consideration of the mutual promises
and covenants contained herein, the sufficiency of which is hereby
mutually acknowledged, the parties hereto hereby agree that the City
engages the Artist to perform the following performances pursuant to
the terms and conditions hereinafter set forth:
The City shall provide ticketing services through its Hemmens Cultural Center for the Artist's "Gala
- -- -- Event" that is scheduled to occur in the lobby of the Hemmens Cultural Center prior to the Artist's
presentation of Elixir of Love on February 9 and 10, 2008, pursuant to an agreement between the
parties hereto dated , 2007, pursuant to the following terms and conditions:
I. Artist shall pay to City a per ticket printing surcharge for each and every ticket printed, including,
but not limited to, those provided by Artist to entities on a complimentary basis, as established
by The Hemmens Cultural Center in the amount of$ .35 per ticket printed. The City shall retain
this amount from box office receipts upon final settlement of Artist's event.
II. A twenty-five cent per admission surcharge shall be collected from every person who purchases
a ticket to the Gala Reception. The City shall retain this amount from box office receipts upon
final settlement of Artist's event.
III. The City shall pay Artist the total amount of the Gala ticket sales, less the aforementioned 35¢
and 25¢ per ticket and per admission surcharges, and any outstanding rental balance if
applicable, within forty-five (45) days of the completion of the event.
IV. The Artist shall be solely responsible for providing all materials, equipment and services
associated with the reception except for those items addressed in the aforementioned
performance contract and lease agreement between the parties hereto, dated September 26,
2007.
V. The Hemmens Cultural Center Box Office shall make available for sale one hundred (100)
$40.00 tickets for the Saturday, February 9, 2008 reception to start at 6:00PM, and one hundred
(100) $40.00 tickets for the Sunday, February 10, 2008 reception to start at 1:30PM.
IN WITNESS WHEREOF, the parties have executed this agreement on the
date first pove written.
