Rudd, P.E., Engineer II�'', Subject: Plat of Dedication for Public Street 1635 West Highland Avenue St. Thomas Moore Church and School I am in the process of trying to clear up a number of easements and plats of dedication that Moud Ahmad was working on prior to being laid off last year and I came across the attached signed mylar. In looking through the records I have found that this document was accepted by the City Council on April 12, 2006 per Resolution No. 06-78. The mylar has been signed by the owner and Mayor Schock but in searching the Kane County Records Land Search I cannot find that it was ever recorded. I would request that you please review your files and see if a recorded copy does exist (if so I would appreciate a bond copy). If not please include it in future documents that need to be recorded in Geneva. Once recorded please provide me a bond copy for my files. RECOMMENDATION It is recommended that the City Council accept the right-of-way dedication and authorize the Mayor to execute the plat of dedication on behalf of the City. BACKGROUND In early 2005, St. Thomas More Church applied to the City for permits to expand their facility located at Thomas More Drive and Highland Avenue. As part of that permitting process, Engineering Division staff requested the same dedication of right-of-way that has been required of the various developers along Highland Avenue, including the new bank located at McLean and Highland. Highland Avenue is built in a 66' side prescriptive easement, 33 feet from each property adjacent to the roadway. Property owners are requested to dedicate that easement as right-of-way plus add an additional seven feet. The long term goal is to establish an eighty foot wide (40 feet from the property on each side) right-of-way along the entire length of Highland Avenue. The right-of-way will facilitate the planned future improvements. Although the church was not required to dedicate the right-of-way, they were willing to do so as long as the dedication did not impact their building set back, they could utilize an existing water service, the City prepared and recorded the plat at its cost, and the City would postpone stormwater requirements for the entire property until a proposed future project. As noted above, the Church is willing to dedicate the right of way if the City prepared the plat and recorded it at the City's expense. The cost of preparing the plat was $1,320.50 and has been paid from the Engineering Division operating budget (010-3311-752.30-03). The recording fee will be approximately $60.00 which will be charged to the General Fund, Engineering Division budget, account number 010-3311-752.32-05, "Legal Recording Fees" where there is currently $500.00 budgeted and available. wlEGAL IMPACT None ALTERNATIVES r 1.
