Home My WebLink About06-315 Failed Motion MOTION FAILED Failed Resolution No. 06-315 RESOLUTION FAILED OPPOSING THE PETITION TO INCORPORATE THE VILLAGE OF CAMPTON HILLS PENDING BEFORE THE KANE COUNTY BOARD WHEREAS, the Kane County Board (the "County Board") has adopted a resolution pur- suant to Section 2-3-18 of the Illinois Municipal Code (65 ILCS 5/2-3-18) requiring that before the question of incorporating a village is submitted to the electors, the County Board must first determine that the proposed incorporation is compatible with the official plan for the develop- ment of Kane County the ("County"); and WHEREAS, the County Board is currently considering a petition for the incorporation of the Village of Campton Hills(the"Unincorporated Territory"); and WHEREAS, the Unincorporated Territory fails to comply with components of the official plan for the development of the County, including planning for smart growth principles, priority places and diverse and affordable housing and providing for the continued use of unincorporated farmland; and WHEREAS, the Unincorporated Territory is incompatible with the official plan for the development of the County because it intrudes into the planning areas of existing municipalities and also fails to respect existing municipal boundary agreements; and WHEREAS, the County Board previously determined that the first petition for the incor- poration of the Village of Campton Hills was incompatible with the official plan for the devel- opment of the County because among other things, the proposed village boundaries present in that petition similarly intruded into the planning areas of existing municipalities not unlike the Unincorporated Territory; and WHEREAS, the City of Elgin (the "City")has adopted a comprehensive plan encompass- ing portions of the contiguous Unincorporated Territory adjacent to the City's corporate limits; and WHEREAS, the northern portions of the Unincorporated Territory situated in Plato Township north of Silver Glen Road and generally east of Burlington Road, and in the undevel- oped portions of Campton Township generally north of Silver Glen Road, lie within the planning area of the City's (the "Elgin Planning Area"), and as depicted on the attached map labeled as Exhibit A; and WHEREAS, the City has received two (2) petitions seeking to annex certain portions of the Unincorporated Territory located within the Elgin Planning Area (the"Annexation Parcels"); and WHEREAS, the Annexation Parcels and the balance of the Unincorporated Territory ly- ing within the Elgin Planning Area have been anticipated and planned for within the City's mas- ter plans for utility service, making it feasible for the City to extend utility services to the An- nexation Parcels and the Unincorporated Territory lying within the Elgin Planning Area; and WHEREAS, the County has previously determined that the development occurring within the Elgin Planning Area adjacent to and surrounding the Unincorporated Territory is con- sistent with the official plan for the development of the County; and WHEREAS, the proposed development of the Annexation Parcels and the Unincorpo- rated Territory lying within the Elgin Planning Area will be consistent with the official plan for the development of the County. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF ELGIN, ILLINOIS: 1. That the petition to incorporate the Village of Campton Hills is inappropriate and should be denied because the petition is not consistent with the official plan for the development of Kane County, particularly with respect to the Unincorporated Territory's intrusions into the Elgin Planning Area. 2. That the City does not object to the incorporation of the Village of Campton Hills pro- vided the boundaries of any such proposed village do not encroach into the Elgin Plan- ning Area, and with the recognition that the more appropriate jurisdiction for the parcel commonly referred to as the "Corron Farm" is within any proposed Village of Campton Hills despite that parcel's location within the Elgin Planning Area. 3. That the City respectfully requests that the Kane County Board exercise its legislative authority to deny the petition to incorporate the Village of Campton Hills for the reasons set forth in this resolution.
