Dorgan, City Manager IAV Janice Ward, Senior Planner SUBJECT: City Support for Pace Dial-a-Ride Service PURPOSE The purpose of this memorandum is to transmit a request to the Mayor and members of the City Council from Pace, the suburban bus service, for 2005 support of the Dial-a-Ride Program. RECOMMENDATION r It is recommended that the City Council approve the local share agreement with Pace in the amount of$31,298. BACKGROUND Pace provides Dial-a-Ride service in Elgin and the surrounding area. This service is available to senior citizens age 65 and over and persons with a disability. Service is available only with a 24- hour advance reservation and only in the morning and afternoon, Monday through Friday. The Dial-a-Ride service goes beyond the requirements of the Americans with Disabilities Act. Commencing in January, 1994, the City Council has approved a series of one-year agreements with Pace for the City to provide a local share for Dial-a-Ride service. This resulted from the City being approached by Elgin Township officials who were unable, for financial reasons, to continue the support for the service. Elgin Township had supported the prograrb since 1993. Prior to that, the service was part of the City-provided bus service. Arotind the area, municipalities pay the local share of the Dial-a-Ride services as opposed to townshis. Cost estimates provided by Pace show the proposed 2005 program costing $102,136, with revenue covering 19.6%, Pace subsidizing 49.8% and the City funding 30.6% or $3 ,298. CityrSupport for Dia -a d-Ri e Service Sppo 0 l December 10, 2004 Page 2 COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED The Fox Valley Center for Independent Living has indicated this service provides a critical link for residents to maintain their independence. 914/NFINANCIAL IMPACT The City of Elgin's share is a maximum of$31,298 and will be paid out of the Ri erboat Fund, account number 275-0000-791.80-43, Pace Contributions. The local share not-to-e' ceed cost for 2004 was $27,481. In the Proposed 2005 Budget only $38,000 was allocted for D al-a-Ride and support for Route 554. The costs for both efforts is estimated at $47,150 for 200•. In order to provide for this, $9,200 will be transferred from "Special Projects", account num ler 275-0000- 791.47-00. This budget adjustment will be reflected in the 2005 Adopted Budget. wriLEGAL IMPACT None. rALTERNATIVES 1. The City Council could choose not to fund the Dial-a-Ride program. 2. The City Council could choose to fund the Dial-a-Ride program for a limited number of vehicle hours of service. Respectfully submitted for Council consideration. JAW Attachments r • PACE PARATRANSIT LOCAL SHARE AGREEMENT City of Elgin rThis agreement is made this day of , 2004, by and between tie Suburban Bus Division of the Regional Transportation Authority (RTA) operating under the name of and hereinafter referred to as "Pace", an Illinois municipal corporation, and the City of Elgin, an'Illinois municipal corporation, hereinafter referred to as the "City'. NOW THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby mutually acknowledged,the parties hereto hereby agree as follows: 1. TERM-This agreement will be in effect beginning January 1, 2005 and ending December 31,2005. 2. SERVICE DESCRIPTION-The City will participate in the financial support of the transportation service described in the attached Exhibit W. Exhibit "A" is hereby incorporated and rr1adea part of this Agreement. 3. REPORTING - Pace will provide to the City on a monthly basis, a report with the fbllowing: A. Number of one way trips. B. Total Vehicle service hours (provided for Dial-A-Ride service as outlined in Exhibit "A" of this Agreement). C. A billing for Local Share, determined as outlined in Section 4 of this Agreemant. 4. LOCAL SHARE FUNDING-The City agrees to reimburse Pace monthly for the Lodal Share incurred in r operating the service described in Exhibit"A"of this Agreement. The Local Share Will be calculated in the following manner: y A. The Total Expense of the project will be calculated by multiplying the actua number of vehicle service hours attributed to service delivered per this Agreement by the hou rate for providing service. Operating Deficit will be defined as Total Expense less fare revenu . B. The Pace Contribution will be the lesser of 1)75% of the actual Operating Deficit attributed to a maximum of 5,125 vehicle hours of service, 2) $2.25 multiplied by the dumber of one-way passenger trips, or 3) $50,838. The Pace Contribution shall be calculated monthly on a year-to-date basis to adjust for actual vehicle hours of service and ensure that the annual Pace Contribution is not depleted in advance before the end of the term of this agreement. The Local Share is the Total Expense,as described in Section 4.8.1.,minus fres,minus the Pace Contribution. Charges to the City for service provided under this Agreerient will not exceed $31,298. C. The City shall pay Pace within thirty(30)days of receiving the monthly bill fdr service costs. r 2005 LSA Page 1 City of Elgin . . , . . 5. AMENDMENT- This Agreement constitutes the entire Agreement between.the parties hereto. Any proposed changes in this Agreement shall be submitted to Pace for its prior approval. Except for minor r service changes, no modification, addition, deletion, revision, alteration or other change to this Agreement shall be effective unless and until such changes are reduced to writing and executed by the authorized representatives of parties hereto. 6. TERMINATION-This contract can be terminated upon thirty(30)calendar days w ' en notice by Pace, if: 1) sufficient funds have not been appropriated to cover the estimated requirem nts by Pace or by any other agency funding the service;2)Pace develops alternative public transportation services which, as determined by Pace will better meet the transportation needs of the public; or, 3) the City fails to make payments as required by Section 4 of this agreement. 7. FAILURE TO PERFORM - Pace shall not be liable for any failure to provide service due to circumstances beyond the reasonable control of Pace. Pace shall make every reasonable effort to have service restored as soon as practical under the circumstances. No fees ‘Ivill be charged for service not performed. 8. INDEMNIFICATION - Pace agrees to and shall defend, indemnify, and hold harmless the City, and other municipalities or townships which contribute to the payment of the City's Lobal Share and their respective officers,agents,and employees from all and any liability,losses,costs,damage or expense, or injury to person or property, including reasonable attorneys fees, and other reasonable costs of defense,arising out of or resulting from this Agreement or from the services provided or to be provided under this Agreement. 9. RESOLUTION OF DISPUTES-Venue for the resolution of any disputes and the nforcement of any rights arising out of or in connection with this agreement shall be in accordance frith the laws of the State of Illinois.
