RESOLUTION
CONCERNING THE ANNEXATION OF CERTAIN TERRITORY
(PORTION OF THE GATHMAN PROPERTY)
WHEREAS,the City of Elgin has entered into an Annexation Agreement dated November 9,
2005 regarding the Residential Land Fund Development(the"Subject Annexation Agreement");and
WHEREAS, the Subject Annexation Agreement provides in part for the annexation of a
portion of the Gathman Property,such property being annexed into the City of Elgin being referred
to in the Annexation Agreement as the Gathman Parcel and being legally described in Exhibit A to
the Subject Annexation Agreement; and
WHEREAS,the Gathmans have requested and the City has agreed that during the term of the
Subject Annexation Agreement that the City would agree not to annex the balance of the real estate
adjacent to the Gathman Parcel of which the Gathmans are the current owners without the written
consent of the then record owner of such adjacent real estate.
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that during the term of the Subject Annexation Agreement referred to herein that
the City of Elgin agrees not to annex the following described real estate without the written consent
of the then record owner of such real estate:
The East Half of the Southeast Quarter of Section 35,Township 41 North,
Range 7 East of the Third Principal Meridian, in the Township of Plato, Kane
County, Illinois, excepting therefrom the Westerly 300 feet thereof, as measured
perpendicular to the Westerly line thereof,and also excepting therefrom the South
300 feet thereof, as measured perpendicular to the Southerly line thereof.
