I DO FURTHER CERTIFY that the attached is a full, true, and correct copy of: RESOLUTION NO. 05-306 RESOLUTION APPROVING THE DISSOLUTION OF THE NORTHWEST SUBURBAN MASS TRANSIT DISTRICT adopted by the Elgin City Council at its legally convened meeting held on October 26, 2005. Wjah-,/,—C City Clerk (SEAL) Resolution No. 05-306 RESOLUTION APPROVING THE DISSOLUTION OF THE NORTHWEST SUBURBAN MASS TRANSIT DISTRICT WHEREAS,the Northwest Suburban Mass Transit District was created on February 26, 1971 pursuant to the Local Mass Transit District Act of the State of Illinois by the participating municipalities of Bartlett, Bensenville, East Dundee, Elgin, Elmwood Park, Hanover Park, Itasca, River Grove,Roselle, Schaumburg, Streamwood and Wood Dale; and WHEREAS, the Board of Trustees of the District have determined that other adequate services are available for acquiring, constructing, owning, operating and maintaining mass transit facilities for public service and subsidizing the operation thereof within the geographic area served by the District. WHEREAS, Section 9 of the Local Mass Transit District Act of Illinois provides for the termination of the District. WHEREAS,on December 15,2004,the Board of Trustees of the Northwest Suburban Mass Transit District adopted a resolution that the Northwest Suburban Mass Transit District shall terminate its existence on March 31, 2006, subject to the approval of such discontinuance by the participating municipalities and their authorization to the district to continue its services and wind up its affairs; and WHEREAS, the Northwest Suburban Mass Transit District has requested that the City of Elgin adopt a resolution approving the discontinuance of the Northwest Suburban Mass Transit District and requesting the City of Elgin's authorization to the District to discontinue its services and wind up its affairs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that the City of Elgin hereby approves the discontinuance and dissolution of the Northwest Suburban Mass Transit District and hereby provides the City of Elgin's authorization to the Northwest Suburban Mass Transit District to discontinue its services and wind up its affairs. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City Clerk be and is hereby authorized and directed to send a certified copy of this resolution to the Executive Secretary of the North Suburban Mass Transit District.
