RESOLUTION
AUTHORIZING REQUEST TO INTERVENE BY THE CITY OF ELGIN IN A
PROCEEDING INVOLVING ELGIN RIVERBOAT RESORT PENDING BEFORE THE
STATE OF ILLINOIS PROPERTY TAX APPEAL BOARD
WHEREAS,the City of Elgin is a municipal corporation operating and existing pursuant to
the laws of the State of Illinois and has the statutory power and authority to levy real property taxes
pursuant to the laws of the State of Illinois; and
WHEREAS,the property commonly known as 250 South Grove Avenue,Permanent Index
Numbers 06-13-358-003 and 06-13-359-040,is located within the City of Elgin(hereinafter"Subject
Property"); and
WHEREAS,the City of Elgin is the owner of the subject property; and
WHEREAS, Elgin Riverboat Resort is the lessee of the Subject Property; and
WHEREAS, Elgin Riverboat Resort has filed an appeal with the State of Illinois Property
Tax Appeal Board (hereinafter "PTAB") seeking to reduce the assessed valuation of the subject
property with such appeal being identified in the PTAB records as Docket Numbers 02-00667.001-
C-3 and 02-00667.002-C-3; and
WHEREAS,the requested assessment reduction will effect the ability of the City of Elgin to
obtain necessary income to operate and maintain the programs and services offered by the City of
Elgin by reducing its property tax base; and
WHEREAS,it is in the best interests and financial integrity of the City of Elgin to intervene
in the above-referenced proceedings before the PTAB.
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, as follows:
Section 1. That the city's Special Counsel in this matter Attorneys Michael F.Baccash and
Robert M. Sarnoff and the law firm of Sarnoff and Baccash of Chicago, Illinois be and are hereby
authorized to take any and all action necessary to intervene in the above referenced matter.
Section 2. That the city's Special Counsel for this matter Attorneys Michael F. Baccash
and Robert M. Sarnoff and the law firm of Sarnoff and Baccash of Chicago, Illinois be and are
hereby authorized to provide any and all legal services deemed necessary to protect the interests of
the City of Elgin in the above referenced matter.
Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same
are hereby repealed, and this resolution shall be in full force and effect immediately and forth with
upon its passage.
