RESOLUTION
AUTHORIZING EXECUTION AND ACCEPTANCE OF A GRANT OF EASEMENT
FOR SANITARY SEWER PURPOSES FROM ROBERT H. SCOTT
(339-341 North Lyle Avenue)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that
Ed Schock, Mayor, and Dolonna Mecum, City Clerk,be and are hereby authorized and directed to
execute a grant of easement for sanitary sewer purposes from Robert H.Scott for the property legally
described therein, a copy of which is attached hereto.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to cause
the grant of easement to be recorded in the office of the Recorder of Deeds of Kane County,Illinois.

GRANT OF EASEMENT
This Grant of Easement is made and entered into this 1 1 st ,day of February ,2004 by
and between Robert H.Scott(hereinafter referred to as"Grantor")and the City of Elgin,an Illinois
municipal corporation(hereinafter referred to as the"City").
WITNESSETH
For and in consideration of Ten Dollars($10.00)in hand paid,the mutual undertakings as contained herein
and other good and valuable consideration,the receipt and sufficiency of which is hereby acknowledged,
the parties hereto agree as follows:
1. The grantor as owner of the property legally described herein does hereby grant to the City,a permanent
and exclusive easement to install,construct,operate,use,maintain,service,upgrade,repair or replace a
sanitary sewer line and appurtenances relating thereto in the property hereinafter referred to as the
"Easement Premises"depicted on Attachment A hereto and legally described as follows:
A SANITARY SEWER EASEMENT OVER THAT PART OF LOT 3 OF HOOVER'S RESUBDIVISION
DESCRIBED AS FOLLOWS:COMMENCING AT A POINT ON THE WEST LINE OF SAID LOT 3
THAT IS 129.61 FEET NORTHERLY OF THE OF THE SOUTHWEST CORNER THEREOF;THENCE
SOUTH 85 DEGREES 06 MINUTES 56 SECONDS EAST ALONG A LINE IF EXTENDED WOULD
INTERSECT THE EAST LINE OF SAID LOT 3 AT A POINT 134.81 FEET NORTHERLY OF THE
SOUTHEAST CORNER THEREOF,A DISTANCE OF 45.22 FEET TO A POINT ON A LINE THE IS
45.00 FEET EASTERLY OF AND PARALLEL WITH THE WESTERLY LINE OF SAID LOT 3;
THENCE NORTH 85 DEGREES 06 MINUTES 56 SECONDS WEST,A DISTANCE OF 20.10 FEET
TO A POINT IN A LINE THAT IS 25.00 FEET EASTERLY OF AND PARALLEL WITH THE

PARALLEL LINE,A DISTANCE OF 13.45 FEET TO THE NORTH LINE OF SAID LOT 3;THENCE
NORTH 89 DEGREES 28 MINUTES 33 SECONDS EAST ALONG SAID NORTH LINE,A DISTANCE
OF 20.00 FEET TO A LINE THAT IS 45.00 FEET EASTERLY OF AND PARALLEL WITH THE
WESTERLY LINE OF SAID LOT 3;THENCE SOUTH 00 DEGREES 40 MINUTES 54 SECONDS
EAST ALONG SAID PARALLEL LINE,A DISTANCE OF 120.24 FEET TO THE POINT OF
BEGINNING,IN THE CITY OF ELGIN,KANE COUNTY,ILLINOIS.

2. That the Grantor shall not construct any buildings,structures or other physical improvements on
the Easement Premises nor undertake any other activities which unreasonably interfere with the
Easement Premises and the City's intended use thereof.
3. That this agreement shall be binding on the parties hereto and their respective successors and
assigns and shall run with the land.
4. This agreement shall be recorded by City at City's expense.
