RESOLUTION
AUTHORIZING EXECUTION OF AN AGREEMENT WITH
PATRICK ENGINEERING INC. FOR CONSULTING SERVICES IN REVIEWING
THE MIDWEST COMPOST, LLC APPLICATION REQUESTING SITING APPROVAL FOR
A SOLID WASTE TRANSFER STATION AT 1320 SPAULDING ROAD, ELGIN, ILLINOIS
WHEREAS,Midwest Compost,LLC has filed an application requesting siting approval for a
solid waste transfer station at 1320 Spaulding Road, Elgin, Illinois; and
WHEREAS, Section 9.33.050 of the City of Elgin Pollution Control Facility Siting
Ordinance provides that the Mayor with the consent of the City Council may retain consultants to
advise the city with respect to the application,evidence adduced at the public hearing,and comments
received by the city, with the costs of such consultants to be paid by the applicant proposing the
siting of a pollution control facility.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby
authorized and directed to execute an agreement on behalf of the City of Elgin with Patrick
Engineering Inc. for consulting services in reviewing the Midwest Compost, LLC application
requesting siting approval for a solid waste transfer station at 1320 Spaulding Road,Elgin,Illinois,a
copy of which is attached hereto and made a part hereof by reference.

AGREEMENT
THIS AGREEMENT, made and entered into this 28th day of January,
2004, by and between the CITY OF ELGIN, an Illinois municipal
corporation (hereinafter referred to as "CITY" ) and PATRICK
ENGINEERING INC. , an Illinois corporation (hereinafter referred to
as "CONSULTANT" ) .
WHEREAS, the CITY has received an application from Midwest Compost,
LLC requesting siting approval for a proposed solid waste transfer
station at the property commonly known as 1320 Spaulding Road,
Elgin, Cook County, Illinois (hereinafter referred to as the
"SUBJECT APPLICATION" ) ; and
WHEREAS, the CITY desires to engage the CONSULTANT to furnish
certain professional consulting services in reviewing the SUBJECT
APPLICATION (hereinafter referred to as the "PROJECT" ) ; and
WHEREAS, the CONSULTANT represents that it is in compliance with
Illinois Statutes relating to professional registration of
individuals and has the necessary expertise and experience to
furnish such services upon the terms and conditions set forth
herein below.
NOW, THEREFORE, for and in consideration of the mutual undertakings
as set forth herein, and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, the
parties hereto agree as follows :
1. SCOPE OF SERVICES
A. All work hereunder shall be performed under the direction
of the CITY' s Corporation Counsel
B. CONSULTANT shall perform and provide the services in
connection with the PROJECT as set forth in CONSULTANT's
proposal submitted to the CITY entitled "Professional
Engineering Services for Review of a Proposed Solid Waste
Transfer Station" dated January 8, 2004 attached hereto
as Exhibit A. Such services shall include, but not be
limited to, reviewing the SUBJECT APPLICATION for
compliance with the provisions of 415 ILCS 5/39 .2 and the
provisions of the City of Elgin Pollution Control
Facility Siting Ordinance. Services related to
Criteria Three and Criteria Six will be provided through
subcontracts with a real estate appraiser, a professional
land use and planning firm and a traffic specialist. The
specific subcontractors shall require the advance written
approval of the CITY' s Corporation Counsel .
2 . SCHEDULE
CONSULTANT shall provide the services to be provided pursuant
to this Agreement according to the schedule as directed by the
CITY' s Corporation Counsel and in order to comply with the
dates and deadlines required under the Illinois Environmental
Protection Act and the City of Elgin Pollution Control
Facility Siting Ordinance. CONSULTANT will submit to the
CITY' s Corporation Counsel status reports as required by the
CITY' s Corporation Counsel .
3. WORK PRODUCTS
All work products prepared by the CONSULTANT pursuant hereto
including, but not limited too, reports, designs,
calculations, work drawings, studies, photographs, models and
recommendations shall be the property of the CITY and shall be
delivered to the CITY upon request of the CITY' s Corporation
Counsel provided, however, that the CONSULTANT may retain
copies of such work products for its records . Such work
products are not intended or represented to be suitable for
reuse by the CITY on any extension to the PROJECT or on any
other project, and such reuse shall be at the sole risk of the
CITY without liability or legal exposure to the CONSULTANT.
4. PAYMENTS TO THE CONSULTANT
A. For services provided by the CONSULTANT pursuant to this
Agreement the CONSULTANT shall be reimbursed at the
hourly rates according to CONSULTANT' s 2003 fee schedule
as set forth in Exhibit A. Total fees and expenses shall
not exceed $92 , 000 without written approval of the CITY.
B. For outside services provided by other firms or
subconsultants, the CITY shall pay the invoiced fee for
such services with a five percent (5%) markup.
C . The CITY shall make periodic payments to the CONSULTANT
based upon actual progress within forty-five (45) days
after receipt and approval of an invoice.
5. INVOICES
A. The CONSULTANT shall submit invoices in a format approved
by the CITY. Progress reports will be included with all
payment requests .
B. The CONSULTANT shall maintain records showing actual time
devoted and cost incurred. The CONSULTANT shall permit
the authorized representative of the CITY to inspect and
audit all data and records of the CONSULTANT for work
done under this Agreement . The CONSULTANT shall make .
these records available at reasonable times during the
Agreement period, and for a year after termination of
this Agreement .

6. TERMINATION OF AGREEMENT
Notwithstanding any other provision hereof, the CITY may
terminate this Agreement at any time upon fifteen (15) days
prior written notice to the CONSULTANT. In the event that this
Agreement is so terminated, the CONSULTANT shall be paid for
services actually performed and reimbursable expenses actually
incurred prior to termination, except that reimbursement shall
not exceed the amounts set forth under Paragraph 4 above.
7 . TERM
This Agreement shall become effective as of the date the
CONSULTANT is given a notice to proceed and, unless terminated
for cause or pursuant to Article 6, shall be deemed concluded
on the date the CITY determines that all of the CONSULTANT' s
work under this agreement is completed. A determination of
completion shall not constitute a waiver of any rights or
claims which the CITY may have or thereafter acquire with
respect to any term or provision of the Agreement.
8. NOTICE OF CLAIM
If the CONSULTANT wishes to make a claim for additional
compensation as a result of action taken by the CITY, the
CONSULTANT shall give written notice of his claim within 15
days after occurrence of such action. No claim for additional
compensation shall be valid unless so made. Any changes in
the CONSULTANT' s fee shall be valid only to the extent that
such changes are included in writing signed by the CITY and
the CONSULTANT. Regardless of the decision of the DIRECTOR
relative to a claim submitted by the CONSULTANT, all work
required under this Agreement as determined by the DIRECTOR
shall proceed without interruption.
9. BREACH OF CONTRACT
If either party violates or breaches any term of this
Agreement, such violation or breach shall be deemed to
constitute a default, and the other party has the right to
seek such administrative, contractual or legal remedies as may
be suitable to the violation or breach; and, in addition, if
either party, by reason of any default, fails within fifteen
(15) days after notice thereof by the other party to comply
with the conditions of the Agreement, the other party may
terminate this Agreement .
10. INDEMNIFICATION
To the fullest extent permitted by law, CONSULTANT agrees to
and shall indemnify, defend and hold harmless the CITY, its
officers, employees, agents, boards and commissions from and
against any and all claims, suits, judgments, costs, attorneys
fees, damages or other relief, including but not limited to

workers compensation claims, in any way resulting from or
arising out of negligent actions or omissions of the
CONSULTANT in connection herewith, including negligence or
omissions of employees or agents of the CONSULTANT arising out
of the performance of this Agreement . In the event of any
action against the CITY, its officers, employees, agents,
boards or commissions, covered by the foregoing duty to
indemnify, defend and hold harmless such action shall be
defended by legal counsel of the CITY' s choosing. The
provisions of this paragraph shall survive any expiration
and/or termination of this Agreement .
11. NO PERSONAL LIABILITY
No official, director, officer, agent or employee of either
the CITY or the CONSULTANT shall be charged personally or held
contractually liable under any term or provision of this
Agreement or because of their execution, approval or attempted
execution of this Agreement . _
12 . INSURANCE
A. Comprehensive Liability. The CONSULTANT shall provide,
pay for and maintain in effect, during the term of this
Agreement, a policy of comprehensive general liability
insurance with limits of at least $1, 000, 000 aggregate
for bodily injury and $1, 000 , 000 aggregate for property
damage.
The CONSULTANT shall deliver to the DIRECTOR a
Certification of Insurance naming the CITY as additional
insured. The policy shall not be modified or terminated
without thirty (30) days prior written notice to the
DIRECTOR.
The Certificate of Insurance which shall include
Contractual obligation assumed by the CONSULTANT under
Article 10 entitled "Indemnification" shall be provided.
This insurance shall apply as primary insurance with
respect to any other insurance or self-insurance programs
afforded to the CITY. There shall be no endorsement or
modification of this insurance to make it excess over
other available insurance, alternatively, if the
insurance states that it is excess or prorate, it shall
be endorsed to be primary with respect to the CITY.
B. Comprehensive Automobile Liability. Comprehensive
Automobile Liability Insurance covering all owned, non-
owned and hired motor vehicles with limits of not less
than $500, 000 per occurrence for damage to property.
C . Combined Single Limit Policy. The requirements for
insurance coverage for the general liability and auto

exposures may be met with a combined single limit of
$1, 000, 000 per occurrence subject to a $1, 000, 000
aggregate .
D. Professional Liability. The CONSULTANT shall carry
Engineers Professional Liability Insurance Covering
claims resulting from error, omissions or negligent acts
with a combined single limit of not less than $1, 000, 000
per claim. A Certificate of Insurance shall be submitted
to the DIRECTOR as evidence of insurance protection. The
policy shall not be modified or terminated without thirty
(30) days prior written notice to the DIRECTOR.
13 . NONDISCRIMINATION
In all hiring or employment made possible or resulting from
this Agreement, there shall be no discrimination against any
employee or applicant for employment because of sex, age,
race, color, creed, national origin, marital status, of the
presence of any sensory, mental or physical handicap, unless
based upon a bona fide occupational qualification, and this
requirement shall apply to, but not be limited to, the
following: employment advertising, layoff or termination,
rates of pay or other forms of compensation and selection for
training, including apprenticeship.
No person shall be denied or subjected to discrimination in
receipt of the benefit of any services or activities made
possible by or resulting from this Agreement on the grounds of
sex, race, color, creed, national origin, age except minimum
age and retirement provisions, marital status or the presence
of any sensory, mental or physical handicap. Any violation of
this provision shall be considered a violation of a material
provision of this Agreement and shall be grounds for
cancellation, termination or suspension, in whole or in part,
of the Agreement by the CITY.
14. ASSIGNMENT AND SUCCESSORS
This Agreement and each and every portion thereof shall be
binding upon the successors and the assigns of the parties
hereto; provided, however, that no assignment shall be made
without the prior written consent of the CITY.
15. DELEGATIONS AND SUBCONTRACTORS
Any assignment, Adelegation or subcontracting shall be subject
to all the terms, conditions and other provisions of this
Agreement and the CONSULTANT shall remain liable to the CITY
with respect to each and every item, condition and other
provision hereof to the same extent that the CONSULTANT would
have been obligated if it had done the work itself and no
assignment, delegation or subcontract had been made. Any

proposed subcontractor shall require the CITY' s advanced
written approval .
16. NO CO-PARTNERSHIP OR AGENCY
This agreement shall not be construed so as to create a
partnership, joint venture, employment or other agency
relationship between the parties hereto.
17 . SEVERABILITY
The parties intend and agreed that, if any paragraph, sub-
paragraph, phrase, clause or other provision of this
Agreement, or any portion thereof, shall be held to be void or
otherwise unenforceable, all other portions of this Agreement
shall remain in full force and effect .
18. HEADINGS
The headings of the several paragraphs of this Agreement are
inserted only as a matter of convenience and for reference and
in no way are they intended to define, limit or describe the
scope of intent of any provision of this Agreement, nor shall
they be construed to affect in any manner the terms and
provisions hereof or the interpretation or construction
thereof .
19 . MODIFICATION OR AMENDMENT
This Agreement and its attachments constitutes the entire
Agreement of the parties on the subject matter hereof and may
not be changed, modified, discharged or extended except by
written amendment duly executed by the parties . Each party
agrees that no representations or warranties shall be binding
upon the other party unless expressed in writing herein or in
a duly executed amendment hereof, or change order as herein
provided.
20. APPLICABLE LAW
This Agreement shall be deemed to have been made in, and shall
be construed in accordance with the laws of the State of
Illinois . Venue for the resolution of any disputes or the
enforcement of any rights pursuant to this agreement shall be
in the Circuit Court of Kane County, Illinois .
21. NEWS RELEASES
The CONSULTANT may not issue any news releases without prior
approval from the DIRECTOR, nor will the CONSULTANT make
public proposals developed under this Agreement without prior
written approval from the DIRECTOR prior to said documentation
becoming matters of public record.

22 . COOPERATION WITH OTHER CONSULTANTS
The CONSULTANT shall cooperate with any other consultants in
the CITY' s employ or any work associated with the PROJECT.
23 . INTERFERENCE WITH PUBLIC CONTRACTING
The CONSULTANT certifies hereby that it is not barred from
bidding on this contract as a result of a violation of 720
ILCS 5/33E et seq. or any similar state or federal statute
regarding bid rigging.
24. SEXUAL HARASSMENT
As a condition of this contract, the CONSULTANT shall have
written sexual harassment policies that include, at a minimum,
the following information:
A. the illegality of sexual harassment;
B. the definition of sexual harassment under state law;
C. a description of sexual harassment, utilizing examples;
D. the vendor' s internal complaint process including
penalties;
E. the legal recourse, investigative and complaint process
available through the Illinois Department of Human
Rights, and the Illinois Human Rights Commission;
F. directions on how to contact the department and
commission;
G. protection against retaliation as provided by Section 6-
101 of the Human Rights Act .
A copy of the policies must be provided to the Department of
Human Rights upon request 775 ILCS 5/2-105 .
25. WRITTEN COMMUNICATIONS
All recommendations and other communications by the CONSULTANT
to the DIRECTOR and to other participants which may affect
cost or time of completion, shall be made or confirmed in
writing. The DIRECTOR may also require other recommendations
and communications by the CONSULTANT be made or confirmed in
writing.
26. NOTICES
All notices, reports and documents required under this
Agreement shall be in writing and shall be mailed by First
Class Mail, postage prepaid, addressed as follows :

1.0 STATEMENT OF INTEREST
1.1 STATEMENT OF The City of Elgin will review and consider a siting application(Application) for
UNDERSTANDING the proposed solid waste transfer station to be located within the City's
jurisdiction. The City and Midwest compost LLC will review and consider the
Application under Section 39.2 of the Illinois Environmental Protection Act
(the Act),pursuant to which the City will review the Application for local siting
within a specified period of time, hold one or more public hearings,and make a
decision to approve or disapprove the request by the applicant.
Patrick Engineering Inc. (Patrick) is interested in providing professional
engineering services to Elgin for technical review of the siting Application.
Our services will include addressing the regulatory requirements (nine criteria
established in the Act), as well as other services authorized by the City of Elgin
•
Pollution Control Facility Siting Ordinance(Ordinance).
1.2 APPROACH AND If selected,Patrick will perform the following tasks on behalf of the City of
METHODOLOGIES Elgin
Task 1. Siting Application Review for the Nine Criteria. Patrick will review
the Application for local siting approval for compliance with Section 39.2 of the
Act and with the Ordinance. The review of the Application will consist of a
technical evaluation of the Application against each of the nine criteria in
Section 39.2 of the Act and the Ordinance. This review of the nine criteria will
include the following:
1. Need for the facility. Patrick will review the Applicant's Needs
Assessment to determine if proper methods are used in the
evaluation, including the definition of the service territory,the
estimation of the waste quantities from the service area, the
available waste disposal capacity, and if appropriate,
economics.
2. Design/operation of the facility. Patrick will review the waste
flow pattern of the facility,the storm water management plan,
the proposed operations, the sizing of the tipping floor,the
internal traffic patterns and the facility location to ensure that
the facility is designed and proposed to be operated to protect
public health and safety. Patrick will pay special attention to
the stacking of trucks on the property and the handling of storm
water prior to discharge onto adjacent properties. Patrick will
compare the applicant's design and planned operation to
generally accepted practices and engineering principals to
provide an opinion on this criterion.
3. Compatibility of the facility with the surrounding area. Patrick
will manage subconsultants for the review of the Application's
real estate assessment and the land use study to determine if

these items are prepared according to accepted procedures.
Patrick will subcontract this service to a qualified real estate
appraiser and a professional land use/planning firm.
4. Proximity to floodplains. Patrick will evaluate whether the facility
is in the floodplain. Patrick has performed groundwater
management and Elgin Quad geological mapping studies on
nearby properties.
5. The proposed plan of operations of the facility. Patrick will
engage our personnel that have previously operated transfer
stations to comment on the appropriateness of the plan. Patrick
will review the fire prevention plan,the emergency plans,the
spill plans, and other pertinent operational plans to minimize
the danger to the surrounding area from fires and other
operational accidents.
6. Traffic impacts. Patrick will subcontract and manage the
review of the Applicant's traffic evaluation in order to
determine if the traffic patterns are designed to minimize
impact on existing traffic flows.
7. Disposal of hazardous waste. Patrick will evaluate the
Applicant's plan to detect hazardous waste and to properly
handle the waste if it is found at the site.
8. Consistency with the Cook County Solid Waste Management
Plan and any subsequent updates or amendments. Patrick will
specify the plan component that makes the facility consistent or
inconsistent with the plan.
9. Whether the facility is located within a regulated recharge area,
and if so, whether applicable requirements of the Illinois
Pollution Control Board have been met.
Notwithstanding anything contained herein to the contrary,Patrick's review and
evaluation of the Application in connection with its conclusions,opinions,and
advice to the City will be limited only to the nine siting criteria in Section 39.2
of the Act.
Patrick will utilize the expertise of its hydrogeologists,water resources
engineers, traffic engineers, environmental engineers,and civil engineers to
review the Application. This staff is experienced with transfer station siting,
permitting, design, and operation. A summary of the review by each
professional will be background for use in any reports prepared by Patrick.
Task 2. Draft Report. Patrick will prepare a draft report summarizing the
initial findings of the Application review. The draft report will include a list of
questions regarding each criterion for use during the siting hearing. Any
perceived deficiencies in the completeness of the Application may be addressed

by the applicant during their testimony at the hearing or in subsequent
amendments to the Application.
Task 3. Prepare Final Draft Report. As directed, Patrick will prepare a fmal
draft report summarizing the Application review and addressing any comments
by the City of Elgin. The fmal report will include Patrick's opinion,to a
reasonable degree of engineering certainty,as to whether each of the nine siting
criterion have been satisfied.
Task 4. Attend Hearing(s)and Testify. Patrick will attend the hearings,
including preparing questions to ask at the hearing. Patrick will provide senior
engineers as requested by the City to listen to testimony, provide technical
comment to the City's legal counsel, provide a list of questions for the applicant
or to provide testimony. It is anticipated that one project manager and one
technical specialist from Patrick will attend hearings and will provide assistance
during the hearing. Chris Burger will be available to testify as an expert
witness, if requested by the City or its counsel. Such testimony will be with
respect to its final report.
Task 5. Review Hearing Transcript and Provide Written Comments for the
Record. Patrick will review the transcript of the hearing and any subsequently
received written comments. Patrick will prepare a list of possible siting
conditions and possible problems with the Application, if any.
1.3 SCHEDULE/TIMELINE Patrick will be available immediately upon selection by City of Elgin and will
commence review services upon executing a professional services agreement.
Patrick will commit the resources necessary to prepare a thorough siting
Application review.
1.4 TERMS AND CONDITIONS Patrick has worked with Elgin in the past and foresees no unusual terms or
conditions beyond typically agreed to by each party. Patrick will utilize the
contract proposed by the City, which includes reference to this dated proposal.
Patrick will use its 2003 Fee Schedule for this project. The Fee Schedule is
provided in Attachment B.

1.0 STATEi1ENT OF INTEREST
1.1 STATEMENT OF The City of Elgin will be required to perform a review of a siting application for
UNDERSTANDING a proposed solid waste transfer station within the City's jurisdiction. It is the
City's responsibility, under Section 39.2 of the Illinois Environmental
Protection Act (the Act), to review the application for local siting within a
specified period of time, hold one or more public hearings, and make a decision
to approve or disapprove the request by the applicant.
Patrick Engineering Inc. (Patrick) is interested in providing professional
engineering services to Elgin for technical review of the siting application. Our
services will include addressing the regulatory requirements(nine criteria
established in the Act), as well as providing comments and expertise during and
after the hearings.
1.2 APPROACH AND When selected, Patrick will perform the following tasks on behalf of the City of
METHODOLOGIES Elgin
Task 1. Siting Application Review for the Nine Criteria. Patrick will review
the application for local siting approval for compliance with Section 39.2 of the
Act and with the City of Elgin Siting Ordinance. The review of the application
will consist of a technical evaluation of each of the nine criteria required in the
application. This review of the nine criteria can include, the following:
1. Need for the facility. Patrick will review the Applicant's Needs
Assessment to determine if proper methods are used in the
evaluation, including the definition of the service territory, the
estimation of the waste quantities from the service area, the
available waste disposal capacity, and if appropriate,
economics.
2. Design/operation of the facility. Patrick will review the waste
flow pattern of the facility, the storm water management plan,
the proposed operations, the sizing of the tipping floor, the
internal traffic patterns and the facility location to ensure that
the facility is designed and proposed to be operated to protect
public health and safety. Patrick will pay special attention to
the stacking of trucks on the property and the handling of storm
water prior to discharge onto adjacent properties. Patrick will
compare the applicant's design and planned operation to
generally accepted practices and engineering principals to
provide an opinion on this criterion.
3. Compatibility of the facility with the surrounding area. Patrick
will manage subconsultants for the review of the Application's
real estate assessment and the land use study to determine if
these items are prepared according to accepted procedures.
Patrick will subcontract this service to a qualified real estate
appraiser and a professional land use/planning firm.

4. Proximity to floodplains. Patrick will evaluate whether the facility
is in the floodplain. Patrick performed groundwater management
and Elgin Quad geological mapping studies on nearby properties,
and is,therefore,most qualified to perform the evaluation of this
criterion.
5. The proposed plan of operations of the facility. Patrick will
engage our personnel that have previously operated transfer
stations to comment on the appropriateness of the plan. Patrick
will review the fire prevention plan, the emergency plans, the
spill plans, and other pertinent operational plans to minimize
the danger to the surrounding area from fires and other
operational accidents.
1 6. Traffic impacts. Patrick will subcontract the review of the
Applicant's traffic evaluation in order to determine if the traffic
patterns are designed to minimize impact on existing traffic
flows.
7. Disposal of hazardous waste. Patrick will evaluate the
Applicant's plan to detect hazardous waste and to properly
handle the waste if it is found at the site.
8. Consistency with the Cook County Solid Waste Management
Plan and any subsequent updates or amendments. Patrick will
specify the plan component that makes the facility consistent or
inconsistent with the plan.
9. Whether the facility is located within a regulated recharge area.
Patrick will communicate with the IEPA to identify any new
regulated recharge areas since our previous review of a siting in
mid-2003. Based on experience, it is highly unlikely that the
site is located within a regulated recharge area.
Patrick will utilize the expertise of its hydrogeologists, water resources
engineers, traffic engineers, environmental engineers, and civil engineers to
review the application. This staff is experienced with transfer station siting,
permitting, design, and operation. A summary of the review by each
professional will be background for use in any reports prepared by Patrick.
Task 2. Draft Report. If requested by the City and its outside counsel, Patrick
will prepare a draft report summarizing the initial findings of the application
review. The draft report will include a list of questions regarding each criterion
for use during the siting hearing. Any perceived deficiencies in the
completeness of the application may be addressed by the applicant during their
testimony at the hearing or in subsequent amendments to the application.
Task 3. Prepare Final Draft Report. As directed Patrick will prepare a final
draft report summarizing the application review and addressing any comments
by the City of Elgin.

Task 4. Attend Hearing(s). Patrick will attend the hearings, including
preparing questions to ask at the hearing. Patrick will provide senior engineers
as requested by the City to listen to testimony, provide technical comment to
the City's legal counsel, provide a list of questions for the applicant or to
provide testimony. It is anticipated that one project manager and one technical
specialist from Patrick will attend hearings and will provide assistance during
the hearing.
Task 5. Review Hearing Transcript and Provide Written Comments for the
Record. Patrick will review the transcript of the hearing and any subsequently
received written comments. Patrick will prepare a list of possible siting
conditions and possible problems with the application, if any.
1.3 SCHEDULE/TIMELINE Patrick will be available immediately upon selection by City of Elgin and will
commence review services upon executing a professional services agreement.
Patrick will commit the resources necessary to prepare a thorough siting
application review.
1.4 TERMS AND CONDITIONS Patrick has worked with Elgin in the past and foresees no unusual terms or
conditions beyond typically agreed to by each party. Patrick can utilize a
contract proposed by the City. This can be negotiated after selection. Patrick
will use its 2003 Fee Schedule for this project. The Fee Schedule is provided in
Attachment B.

1.5 DISCLOSURE STATEMENT At present,Patrick is performing work for the following solid-waste-related clients:
• Illinois Environmental Protection Agency State Sites Program. Patrick
currently is investigating site conditions for the IEPA at the closed
Paxton I and Paxton II Landfills in Chicago, Illinois, and the Lewis
Landfill in Cass County, Illinois. Patrick's scope of services has been
expanded to include closure and post-closure analysis, designs,
monitoring, construction quality assurance, landfill gas design, and
general consulting. Patrick has completed work at the Western Lion
Landfill and Service Disposal Landfill in Coles County, Illinois.
1 Patrick is under contract with the IEPA through 2006 to provide
environmental services. IEPA has asked Patrick to prepare a remedial
design for Ocoya Landfill and has engaged Patrick to assist in a number
of other environmental projects. This commitment by the IEPA to
' Patrick demonstrates our ability to provide quality services that protect
public health and safety.
• Archdiocese of Chicago and Sexton Sand& Gravel Corp. Patrick is
performing peer review work for two closed Archdiocese landfills in
unincorporated Cook County.
• Allied Waste Industries. Patrick is handling groundwater permitting
issues at Brickyard Landfill, Danville, Illinois. Patrick has performed
groundwater, air and other analysis and permitting services for this
facility since 1994. In addition, Patrick performs groundwater analyses
for Wayne County Landfill and Lee County Landfill.
• City of Carthage. Patrick is developing a remedial design for the
existing closed landfill.
• Tazewell County. Patrick is developing a remedial design for the
abandoned landfill and providing ongoing consultation.
• Kankakee County. Patrick has recently reviewed the siting applications
submitted by Town& Country Utilities, Inc. and Waste Management
I Inc.
• City of West Chicago. Patrick is providing siting review services to the
City of West Chicago to review the West DuPage Recycling and
Transfer Facility siting application submitted to DuPage County.
To the best of its knowledge Patrick does not have any current engagement or
business relationship that creates a conflict of interest or the appearance of
conflict of interest. Patrick will apply its unbiased, independent professional
judgment to the scope of services described in the Approach and Methodologies
section. Furthermore, Patrick represents and warrants that if it is awarded the
contract, it will not, during the course of its services for City of Elgin, accept
any engagement which would create a conflict of interest or the appearance of a
conflict.

2.0 STATENIENT OF QUALIFICATIONS
2.1 COMPANY OVERVIEW Patrick is a multi-disciplinary consulting firm providing a wide range of
services in the fields of solid waste planning; civil, transportation,
environmental, geotechnical, hydraulic, water resources and structural
engineering; architecture; surveying; geology; and archaeology. Our
capabilities include field investigations and surveys, technical analysis,
feasibility and technical reports, systems and facilities design, materials testing,
construction surveillance, and project management.
Patrick is an Illinois corporation with offices in Springfield, Lisle and Chicago,
Illinois. Founded in 1979, Patrick has been serving the needs of a variety of
public organizations and private sector clients throughout the United States,
Canada and Latin America. Patrick is proud to have been recognized as one of
the top 500 consulting engineering design firms by Engineering News Record
Magazine each year since 1993.
Patrick has an excellent reputation at the Illinois Environmental Protection
Agency(IEPA), especially in the Bureaus of Land, Water, and Air. Patrick is
currently under contract with the IEPA to develop remediation plans for
landfills in central and northern Illinois.
2.2 PROJECT TEAM Currently, Patrick has over 240 employees located in several offices. Patrick
has environmental and civil engineers, geologists, and surveyors experienced in
the design, siting and permitting of solid waste transfer and disposal facilities.
Patrick has provided these services for both the applicant and the reviewing
body. This experience"on both sides of the fence" allows Patrick to be both
objective and thorough in the review of facility operations and overall
performance.
The following Patrick personnel will be made available to Elgin for the review
of the Siting Application and to provide expert testimony at public hearings.
Included in Table 1 are the specific tasks that each one will perform.

2.3 PROJECT TEAM Reviewing a siting application requires a range of experience including
EXPERIENCE engineering, hydrology, and planning. Patrick's project team includes
professionals with the necessary work experience and educational backgrounds.
The proposed project team members have reviewed and/or developed SB 172
siting applications, have been directly involved in the design, siting and
installation of transfer station and/or recycling systems, have been involved in
solid waste planning services including preparing needs assessments,
groundwater impact studies, and traffic impact analyses. Additional staff or
subconsultants may be added to the above list of project personnel as necessary
to accommodate the needs of the City.
The following text describes the work experience of each project team member.

JEFFREY C. SCHUH, P.E., SENIOR VICE PRESIDENT
Mr. Schuh has over 20 years professional experience and directs the activities
of over 60 engineers and technicians. He has extensive experience performing
reviews of solid waste management facility design and providing expert
testimony for public hearings. He has directed technical reviews of surface
water control systems, groundwater management systems, and has prepared
permit applications for solid waste transfer and disposal facilities. Specific
transfer station review projects include: The Wheeling Township Transfer
Station and a confidential location near Lake in the Hills.

LAWRENCE L. HOLISH, P.E., GEOSCIENCES ENGINEER
Mr. Holish has been with Patrick for 5 years and has over thirty-eight years of
extensive expertise in Geotechnical engineering, multi-discipline project
management, environmental assessment, and regulatory compliance for a
L comprehensive list of commercial, industrial and governmental clients in the
United States and seven foreign countries. He manages geosciences
engineering projects and Hydrogeologic studies, and provides technical
direction for the evaluation of landfill sites and waste-to-energy projects. He is
responsible for writing proposals and preparing and/or modifying contract
documents to provide innovative, alternative lower-cost construction
alternatives without impairing the essential functions and characteristics of the
facility. The innovative alternatives are focused to enhance service life,
reliability, economy of operation, ease of maintenance, necessary standardized
features, desired appearance, and design standards. Mr. Holish also manages a
staff of engineers and scientists responsible for the development of geosciences
and environmental remediation work plans; health-based exposure/risk
characterization studies; waste-to-energy projects; minimization and pollution
' prevention programs; and design and selection of remedial/treatment/cleanup
assignments.
CHRIS J. BURGER, P.E., ENVIRONMENTAL ENGINEER
Mr. Burger has been with Patrick for 11 years. He is responsible for the siting,
review, design, permitting, construction and remediation of waste management
facilities. Mr. Burger has recently managed one siting review for West
Chicago, one review for McHenry County, two siting reviews for Kankakee
County, one siting review for Jackson County, one pre-siting review for
Jackson County, one siting review for McDonough County, and a pre-siting
review for the City of Urbana. He has assisted in developing the findings of
fact for a transfer station siting process. He has also been a project manager for
and provided expert witness testimony during the SB 172 process of two
transfer stations, evaluated facility needs assessments,prepared facility
operating plans, and evaluated traffic impacts of a proposed transfer station
Ifacility.
BOB L. GAY, P.E., CIVIL ENGINEER
L Mr. Gay has over 20 years of professional experience in construction
management, civil engineering services and geotechnical investigations. He is
involved in reviewing siting applications, construction observation, construction
materials testing, resident engineering services and geotechnical projects for
1 solid waste facilities. Mr. Gay has also assisted in the preparation of several
siting applications for sites in LaSalle, Lee, Vermilion and Saline Counties. He
has served as Construction Quality Control Officer for the construction of the
Wheeling Transfer Station.
BILL W. TAYLOR, TECHNICAL SPECIALIST
Mr. Taylor provides the personal experience of Operations Manager of a solid
waste transfer station. He has over 20 years of professional experience in
project/construction management and 10 years experience with Waste
Management of North America in a project management/operations capacity.

Mr. Taylor was Waste Management's owner's representative for the design and
construction of the Clearing Transfer Station(1200 TPD) in Stickney, Illinois;
Banner Western Transfer Station(600 TPD) in Rockdale, Illinois and the
Northwest Material Recovery and Transfer Station(1500 TPD) in Chicago,
Illinois. Upon completion of construction of the Northwest facility during start-
up, he became plant manager in charge of recycling and transfer operations for
a period of 1 year.
Although each of the project team members identified may not be required to
contribute large amounts of time to this project,each will be available to
provide necessary assistance in a manner that efficiently serves the City.
Expertise of other Patrick employees may be requested during the review
process. Other engineers are available for this project, if needed. The
personnel assigned to this project will be available throughout the review
process for the City. Patrick is committed to providing the necessary personnel
resources to complete the scope of work on schedule.

2.4 RELEVANT SITING Patrick has extensive experience and qualifications with respect to Illinois's SB
EXPERIENCE 172 siting law. Since the enactment of the law in 1981, Patrick has provided
assistance in the preparation(on behalf of the applicant) and review (on behalf
of the unit of local government) of 30 siting applications for pollution control
facilities (see map at the end of this section showing the counties and proposed
facilities). Although we have a unique blend of experience with"both sides"of
the siting process which makes us uniquely qualified to provide SB 172 related
services, in recent years we have focused our work more for municipal and
county governments.
Our SB 172 review related experience involves a wide range of technical
services available to units of local government. We are qualified to provide the
following services:
• Conduct a thorough technical review of the information
submitted in the siting application for compliance with each of
the applicable siting criteria;
t • Conduct site visits with our experienced engineers and
geologists;
• Attend the public hearings and provide assistance to local legal
staff in interpreting technical data,prompting questions for the
applicant or its technical staff, and cross-examining expert

SERVICES FOR LOCAL GOVERNMENT IN SB 172 LOCAL SITING PROCEEDINGS

West Chicago 2003 Transfer Station Siting Patrick reviewed the siting application for a transfer station proposed to be located in unincorporated DuPage
County next to West Chicago's municipal boundary. Tasks included providing technical guidance to the legal
team of West Chicago; providing written comments and analyses relating to the need, location, operation of
the facility;and testifying and providing assistance during the hearing.
Kankakee County 2003 Landfill Siting Review Patrick reviewed Criterion 2, especially groundwater impact, of the proposed Town & Country Landfill,
provided written comments and testified during the hearing.
McHenry County 2003 Transfer Station Siting Patrick reviewed the siting application for a transfer station proposed for McHenry County. Tasks also
include attending hearings relating to the siting application, preparing a report for the County siting
committee,and making recommendations to the committee about the technical issues of the application.

Review of the BFI DuKane Proposed Transfer Station
Application, City of West Chicago, West Chicago, Illinois
IPatrick conducted a thorough review of the siting application to assess the
proposed facility in DuPage County as measured against the nine criteria
in Section 39.2 of the Environmental Protection Act. Our staff then
evaluated the potential for odor generation and analyzed the management
of waste at the site and its affects on surrounding areas.
Illi Patrick also provided recommendations to the City of Elgin for site
improvements, such as the use of different materials in the construction of the
facility for improved noise reduction. As part of the contractual services to
fl the City,Patrick attended meetings with city officials and prepared technical
diagrams for the evaluation of the transfer station and to provide summaries
of activities.
IIPatrick's environmental engineers also prepared an off-site cleanup plan
for the surrounding areas outside of the fenced operating area.

Southern Illinois Transfer Station, Harrisburg, Illinois
Southern Illinois Transfer Stations Inc. retained Patrick to help implement
a cost-effective disposal solution for the City of Metropolis and Massac
County.
I, Patrick conducted a siting reconnaissance to identify the best site for the
facility and the optimum site plan. Patrick prepared the siting application
to comply with Section 39.2 of the Environmental Protection Act. Patrick
testified in the hearing to all nine criteria.
As components to the siting process,Patrick developed a conceptual design of
the transfer station based on projection of waste quantities generated from the
area served. Patrick then performed an economic feasibility analysis utilizing
various scenarios concerning waste quantities. Additional information was
gathered to develop a public presentation. The public presentation was then
conducted to outline the need for the facility and to show the advantage of the
facility.
Patrick developed an informational brochure to educate policymakers and
residents about transfer stations. Issues such as the amount of waste
generated in the region, the decline in the number of landfills available
after numerous closures, and the cost of transporting waste to the
remaining landfills were addressed in the brochure. A conceptual design
of the facility was also presented in the brochure.
The focus of the brochure was to inform the local officials and the public
about the transfer station and related solid waste issues in layman's terms.
Glenview Transfer Station, Solid Waste Agency of Northern Cook
County, Glenview, Illinois
Patrick provided expert witness testimony at numerous public hearings
during the process of assisting SWANCC with obtaining both local siting
approval and an IEPA development permit for the facility.
LPatrick was the prime consultant for the siting, design, permitting and
construction of the 91,300-sq.-ft. solid waste transfer station. The transfer
station is designed to receive and bale 1,650 tons per day of municipal
solid waste. Local siting approval was granted by the Cook County
Zoning Board of Appeals, after which the Illinois Environmental
Protection Agency(IEPA) issued a development permit allowing
construction of the transfer station. Construction of the facility began in
July 1992. Operations at the facility commenced in February 1994.
Patrick was the prime consultant for the preliminary and final building
design phases of the project. The tipping floor area, baling area and
employee/visitor areas are the three major components of the building.
The tipping area accommodates solid waste tipping, temporary

stockpiling, and inspection of the solid waste. The baling area includes
three solid waste balers, automated bale-loading machines, truck docks,
equipment rooms and maintenance/storage areas.
Patrick conducted the initial site investigations, including a topographic
survey, utility verification, zoning research and code compliance reviews.
Regulatory setback compliance, traffic flow, and equipment layout were
major considerations in the building location and design.
Patrick engineers and architects developed the site plan and facility design for
the 1,650-ton-per-day baling transfer station on the approximately 7.5-acre site.
Patrick provided all services related to process equipment specification
and layout within the facility incorporating three large-volume solid waste
baling modules, waste infeed conveyors, 55-ton-per-hour balers and
automated bale loading equipment.
The Chicago Metropolitan Chapter of the American Public Works
Association(APWA) recognized the Glenview Transfer Station(formerly
known as the Wheeling Township Transfer Station) as the 1994 Regional
Project of the Year. The award was given in recognition of the project's
innovative design and construction methods, timeliness of completion,
resolution of difficulties, steps taken to minimize inconvenience to
citizens, and joint cooperation between agencies.
Crown Disposal Inc., Transfer Station and Material Recovery
Facility, Groot Industries,Elk Grove Village, Illinois
Crown Disposal, a subsidiary of Groot Industries, Inc., contracted with
Patrick for preparation of design and construction documents for an
addition and modifications to their McCook facility. Prior to the recent
addition to the building, the transfer station processed approximately 500
tons per day of mixed commercial and residential solid waste. Recovery
rates of recyclable materials from the incoming waste stream were low,
being that no dedicated sorting systems were in place immediately prior to
the tipping floor
The building addition and associated sorting/baling equipment
configurations allow Crown Disposal to substantially improve their
recovery of recyclable materials while increasing the throughput capacity
of the overall transfer facility.
Patrick provided complete architectural design for the 9,000-sq.-ft. state-
of-the-art materials recovery facility addition to the existing solid waste
` transfer station.
Existing building and site conditions dictated the final shape of the
building. The basic materials utilized for construction were concrete and
steel. Steel columns, roof framing, and wall panels bear on 4-foot-high
concrete wall/foundations and floor slab. Overhead doors, translucent wall
panels and built-up roofing complete the closure. Steel overhead doors

allow truck and front-end loader access at various points within the
�. building. Modifications to the existing building included new concrete
pushwalls, a concrete put, and closure of two open bays and miscellaneous
alterations.
Coordination of structural and civil designers as well as electrical,
mechanical, and plumbing consultants was involved.
Baling Transfer Station #1, Solid Waste Agency of Northern Cook
County, Rolling Meadows, Illinois
The Solid Waste Agency of Northern Cook County(SWANCC) received
local siting approval from the City of Rolling Meadows, Illinois for a
53,500-sq.-ft. baling transfer station to be built in an industrial park within
the corporate limits of the Village of Rolling Meadows. SWANCC also
received a project development permit from the Illinois Environmental
Protection Agency.
Patrick was the prime consultant for the preliminary and final design
phases of the project.
Patrick conducted initial site investigations including a topographic
survey, utility verification, zoning-related research and code compliance
reviews.
Patrick's engineers and architects developed the site plan and facility
design for a 900-ton-per-day baling transfer station on an approximately
5.4-acre site.
Patrick provided all services related to process equipment specification
1 and layout within the facility incorporating two large-volume solid waste
balers.
Patrick also provided expert witness testimony at numerous public
hearings and assisted SWANCC in obtaining the local siting approval and
an IEPA Development Permit for the facility.
Material Recovery Center, City of Evanston,Illinois
Patrick assisted the City of Evanston with the development of a materials
recovery center(MRC). The MRC has a capacity of 90 tons per day to
handle residential recyclables from the City's recycling programs as well
. as commercial recyclables from the Private Industry Council of Northern
Cook County, a partner in the MRC.
Patrick developed the site plan, building floor plan and operating plan for
the MRC. Patrick also prepared the equipment specifications for the
required recycling equipment purchases.
Patrick served as the project liaison between the City of Evanston and the Private
Industry Council and mediated the project use agreements between the two
' organizations.

Senior Project Manager for the in situ remediation of land band(Agent

performance through reduction and consolidation of waste volumes,recycled
waste streams to other industries or operations,processed or treated wastes for

Managed and provided technical consultation for the site cleanup using low
temperature thermal desorption of 21,000 c.y. of soils contaminated with
heating and fuel oils, and directed special waste contractors for the abatement
of friable and non-friable asbestos in former hospital buildings and 2,500 feet
of ancillary steam tunnels. The property was developed under the existing
designated City of Chicago Brownfields program legislation. Negotiated clean
