RESOLUTION
AUTHORIZING ACCEPTANCE OF A DECLARATION OF EASEMENT FOR
SANITARY SEWER AND WATER MAIN PURPOSES FROM KIMBALL-ELGIN,L.L.C.
(120 Kimball Street)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that it
hereby accepts a Declaration of Easement for sanitary sewer and water main purposes from Kimball-
Elgin, L.L.C. for the property legally described therein, a copy of which is attached hereto.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to cause
the Declaration of Easement to be recorded in the office of the Recorder of Deeds of Kane County,
Illinois.

DECLARATION OF EASEMENT
KIMBALL-ELGIN, L.L.C., an Illinois limited liability company ("Grantor"), being the record titleholder
of the parcel of real estate legally hereafter described, does hereby grant and convey to the CITY OF ELGIN, an
Illinois municipal corporation ("Grantee"), a permanent and non-exclusive easement in, over, under, across, and
along the real estate described as follows and shown on Exhibit "A" attached hereto, to install, construct, operate,
use, maintain, locate, upgrade, repair, service, remove, or replace from time to time a municipal water main and
sanitary sewer line:
THAT PART OF LOT 52 IN P. J. KIMBALL ,JR'S SECOND ADDITION TO ELGIN,BEING A SUBDIVISION
OF PART OF SECTIONS 13 AND 14, TOWNSHIP 41 NORTH,RANGE 8 EAST OF THE THIRD PRINCIPAL
MERIDIAN DESCRIBED AS FOLLOWS: COMMENCING AT THE INTERSECTION OF THE WEST LINE
OF DOUGLAS AVENUE WITH THE NORTH LINE OF KIMBALL STREET;THENCE NORTH 00 DEGREES
03 MINUTES 37 SECONDS EAST ALONG THE SAID WEST LINE OF DOUGLAS AVENUE,A DISTANCE
OF 52.00 FEET FOR THE POINT OF BEGINNING; THENCE CONTINUING NORTH 00 DEGREES 03
MINUTES 37 SECONDS EAST,ALONG SAID WEST LINE,A DISTANCE OF 20.00 FEET; THENCE NORTH
89 DEGREES 48 MINUTES 54 SECONDS WEST, PARALLEL WITH THE AFORESAID NORTH LINE OF
KIMBALL STREET,A DISTANCE OF 199.31 FEET TO THE WEST LINE OF AFORESAID LOT 52;THENCE
SOUTH 00 DEGREES 03 MINUTES 47 SECONDS EAST, ALONG SAID WEST LINE OF LOT 52, A
DISTANCE OF 20.00 FEET;THENCE SOUTH 89 DEGREES 48 MINUTES 54 SECONDS EAST, PARALLEL
WITH AFORESAID NORTH LINE OF KIMBALL STREET, A DISTANCE OF 199.31 FEET TO THE POINT
OF BEGINNING,ALSO AN UTILITY EASEMENT OVER THE WEST 10.00 FEET OF THE SOUTH 52.0 FEET
OF SAID LOT 52. BEING SITUATED IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS.
After installation of any such facilities, the grade of the Real Estate shall not be altered in a manner so
as to interfere with the proper operation and maintenance thereof.
IN WITNESS WHEREOF, Grantor has caused this document to be executed by its general
partner this 17th day of November, 2003.
