RESOLUTION FOR TERMINATION AND DISCONTINUANCE
OF THE NORTHWEST SUBURBAN MASS TRANSIT DISTRICT
WHEREAS,the NORTHWEST SUBURBAN MASS TRANSIT DISTRICT was created on
February 26, 1971 pursuant to the Local Mass Transit District Act of the State of Illinois by the
participating municipalities of Bartlett, Bensenville, East Dundee, Elgin, Elmwood Park Hanover Park,
Itasca, River Grove, Roselle, Schaumburg, Streamwood,and Wood Dale;
WHEREAS,the Board of Trustees of the District have determined that other adequate services
are available for acquiring, constructing, owning,operating and maintaining mass transit facilities for
public service and subsidizing the operation thereof within the geographic area served by the District;
WHEREAS,the Board of Trustees of the District have determined that it is in the best interest of
the District and the participating municipalities as well as the municipalities affiliated with the District
that the District terminate its existence;
WHEREAS, Section 9 of the Local Mass Transit District Act of Illinois provides for the
termination of the District.
NOW THEREFORE, be it resolved that the Board of Trustees of the District adopts the foregoing
findings;
FURTHER RESOLVED,that the District shall terminate its existence on March 31, 2006, subject
to the approval of such discontinuance by the participating municipalities and their authorization to the
District to discontinue its services and wind up its affairs.
FURTHER RESOLVED,that the Secretary of the District is hereby authorized and directed to
provide a certified copy of this resolution to the municipal clerk of each of the participating municipalities
as well as those other municipalities affiliated with the District and the Secretary of State of Illinois.
FURTHER RESOLVED,that all in accordance with Section 9 of the Local Mass Transit District
Act,the Chairman, Vice-Chairman,Treasurer and Secretary of the District are hereby authorized and
directed to take any and all actions necessary and convenient to terminate and discontinue the existence of
the District,to discontinue the services and programs provided by the District,to wind up and close up
the business affairs of the District,to repay in whole or prorata funds advanced to the District by the
participating municipalities(if any funds were so advanced),and to pay the balance, if any, prorata
according to the length of scheduled transportation route miles operated in the several municipalities and
unincorporated areas of the several counties during the year preceding the actual termination of District.

organized and existing Illinois municipal corporation.
The above resolution is a true recitation of a resolution adopted by the Board of Trustees of such corporation on
December 15, 2004 and is in conformity with the Local Mass Transit District Act of the State of Illinois(70 ILCS
3610/1 et. seq.)and bylaws of the corporation,has never been modified or repealed,and is in full force and effect as
of the date of this certificate.

SUBJECT: Resolution of Support Regarding Dissolution of Northwest Suburban Mass
Transit District
At the August 24, 2005, Council meeting, Millie Kelly addressed the Council presented the
attached Resolution for Termination and Discontinuance of the Northwest Suburban Mass
Transit District effective March 31, 2006. An excerpt of the relevant portion of that meeting is
attached.
Recently she contacted my office and stated that it is necessary for each municipality in the
transit district to adopt a resolution approving and supporting the dissolution of the district. A
copy of the resolution adopted by the Village of River Grove was faxed to me this morning and
is attached as an example.
As discussed this morning, please prepare an appropriate resolution and place it on the Council
agenda for the October 26, 2005, meeting under"Other Business."

COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on August 24, 2005, in
the Council Chambers. The meeting was called to order by Mayor Schock at 7:12 p.m. The
Invocation was given by Pastor John Eirmann from the Willow Creek Association and the
Pledge of Allegiance was led by Councilmember Robert Gilliam.
ROLL CALL
Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor,
Walters and Mayor Schock. Absent:None.
MINUTES OF THE AUGUST 10, 2005, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Walters made a motion, seconded by Councilmember Figueroa,to approve the
August 10, 2005, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, Walters and Mayor Schock.
Nays: None.
COMMUNICATIONS
Proclamation Recognizing the 60th Annual "Slop Hill"Amateur Golf Tournament
Mayor Schock read and presented a proclamation recognizing the 60`h Annual "Slop Hill"
Amateur Golf Tournament taking place on September 11, 2005. The"Slop Hill"golf invite is
believed to be the oldest continuous amateur tournament in the State of Illinois.
Information on the Resolution Adopted for the Termination and Discontinuance of the Northwest
Suburban Mass Transit District
Mildred "Millie" Kelly stated that she has been honored to serve as Elgin's representative and
trustee to the Northwest Suburban Mass Transit District. She presented the Council with a copy
of the Resolution for Termination and Discontinuance of the Northwest Suburban Mass Transit
District adopted by the District's Board of Trustees in alliance with the communities concerned
and the Illinois Secretary of State. She stated that there are still some grants pending. The
District will be officially discontinued as of the end of the fiscal year, March 31, 2006. Mayor

Schock, on behalf of the City Council,thanked Millie Kelly and her late husband Ed for serving
the City of Elgin so well on this committee. He stated that our community benefited from their
work, and the City has been the recipient of the grants which helped with the improvements to
Elgin's commuter train station.
RECOGNIZE PERSONS PRESENT
Paul Rosen addressed the Council regarding an incident which occurred to him in April 2005
concerning the Elgin Police Department. He stated that certain members of the Elgin Police
Department aided and abetted a known drug felon in having false charges filed against him;
which the State's Attorney dropped the charges based on their having no merit for prosecution.
He believes there is an endemic problem with certain members of the police department and their
relationship with the public. The police sergeant involved told Mr. Rosen he files too many
complaints. He hopes the new Police Chief will make some changes, and she advised him that
there will be an internal investigation. He believes more oversight is needed at the Elgin Police
Department, and he hopes the Elgin Council will also look into this matter.
Police Officers Darren Hood and James Rod, advisors for the City of Elgin Police Explorer Post
#1445, stated that members of the post are here to make a presentation. Ryan Edwardson,
President of Explorer Post#1445, thanked the City Council for its past and continuous support of
the Explorer Post, which has been very beneficial to its members. A conference was held in
Peoria, Illinois, recently which included seminars and various competitions. Three teams from
the Elgin Post participated in competitions and presented the trophies won in bond search
compliance,traffic stops, building searches, crime prevention, physical fitness and fire arm
simulator. Officer Hood also thanked the City Council for its support and announced that the
trophies will be on display at the Police Department Facility.
Mayor Schock stated that the Explorer Post is composed of young men and women who may be
contemplating careers in law enforcement. This gives them an opportunity to work with the
members of the Elgin Police Department in a variety of functions throughout the year including
traffic control and directional assistance, and they do an excellent job.
PETITION 53-05 APPROVED REQUESTING FINAL PLAT APPROVAL FOR TALL
OAKS SUBDIVISION—UNIT ONE; PROPERTY LOCATED AT 101 RUSSELL ROAD;
BY WYNDHAM DEERPOINT HOMES,AS APPLICANT AND OWNER
Community Development Director Deering stated that Tall Oaks Subdivision - Unit One features
166 homes sites, a neighborhood park area, and stormwater managements areas.
Councilmember Figueroa made a motion, seconded by Councilmember Walters,to approve
Petition 53-05, subject to conditions. Upon a roll call vote: Yeas: Councilmembers Figueroa,
Gilliam, Kaptain, Rodgers, Sandor, Walters, and Mayor Schock. Nays:None.
