Parker, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Amendment to Grant Agreement on behalf of the City of Elgin with the Community Crisis Center for the purchase and installation of air conditioning, a copy of which is attached hereto and made a part hereof by reference . s/ Ed Schock Ed Schock, Mayor Presented: February 13, 2002 Adopted: February 13 , 2002 Omnibus Vote : Yeas : 7 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk • AMENDMENT TO GRANT AGREEMENT BETWEEN CITY OF ELGIN AND COMMUNITY CRISIS CENTER THIS AMENDMENT, made and entered into this /J,64 day of 742444.407 , 2001, by and between the City of Elgin, an Illinois municipal corporation (hereinafter referred to as "City") and Community Crisis Center, an Illinois not-for-profit corporation (hereinafter referred to as "Grantee" ) and hereby amend the Prior Agreement of July 26, 2001 . WHEREAS, the City and Grantee have previously entered into an Agreement dated July 26, 2001 (hereinafter referred to as the "Prior Agreement" ) by which City agreed to award Grantee $30 , 000 for the purchase and installation of air conditioning at Grantee ' s shelter facility; and WHEREAS, said grant was conditioned upon the grant being expended by Grantee by December, 2001 ; and WHEREAS, the Grantee desires an extension of the date within which the above grant must be expended until June 30, 2002 , because Grantee is required to receive approval from the Illinois Historic Preservation Agency before beginning work; and WHEREAS, the City and Grantee acknowledge that it is in the best interests of those persons who utilize the shelter facility for said grant to be extended. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby acknowledged, the parties hereto hereby agree to amend the Prior Agreement as follows : • 1 . Paragraph 2 of the Prior Agreement is hereby amended to provide as follows : "All monies granted for this Program shall be expended grantee by June 30 , 2002 . All monies awarded pursuant to this amended agreement shall be expended in accordance with the terms and provisions of this agreement . " 2 . The remainder of the Prior Agreement shall remain in full force and effect . IN WITNESS WHEREOF, the undersigned have placed their hands and seals upon and executed this amended agreement in triplicate as though each copy thereof was the original and that there are no other oral agreements that have been reduced to writing in this statement . Parker, City Manager SUBJECT: Amendment to Grant Agreement between City of Elgin and ' Community Crisis Center PURPOSE The purpose of this memorandum is to provide the Mayor and the members of the City Council with information about a request from Community Crisis Center to amend an existing agreement with the City of Elgin relative to the disbursement of funds received under a grant award from the city. BACKGROUND At its June 13 , 2001 Committee of the Whole meeting, the City Council approved a recommendation from the Funding Application Review Committee to award $30, 000 to the Community Crisis Center for purchase and installation of air conditioning for the shelter facility. A grant agreement was subsequently executed, including the provisions that the funds awarded be spent by December 31, 2001 . In December, the agency submitted a request to extend the date of disbursement to June 30, 2002 . The delay in the disbursement, it was explained, is due in part to a delay in the approval of the project by the Illinois Historic Preservation Agency. Approval by this state agency is necessary since the agency is housed in a historically significant building. The approval process is currently underway. The other factor in the delay is the need to coordinate the installation of the air conditioning with other renovation being done . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None . Grant Agreement Community Crisis Center January 18 , 2002 Page 2 FINANCIAL IMPACT Funds were allocated to this project in 2001 totaling $30, 000 from Account no. 275-0000-791 . 84-01 . Should the grant agreement amendment be approved, a budget adjustment will be required to carry forward the funds to 2002 . LEGAL IMPACT WPVone . ALTERNATIVES 1 . Approve the amendment to the existing grant agreement to extend the time period in which the funds may be spent . 2 . Request return of funds awarded since said funds could not be expended within the time period stipulated in the grant agreement . RECOMMENDATION It is recommended that the City Council approve amendment of the existing grant agreement with the Community Crisis Center to extend the date within which the grant must be expended until June 30 , 2002 .
