EDWARD CENTRAL CATHOLIC HIGH SCHOOL BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an easement agreement for water main and sanitary sewer purposes from St . Edward Central Catholic High School for the property legally described on Exhibit A, a copy of which is attached hereto. EDWARD CENTRAL CATHOLIC HIGH SCHOOL, conveys to Grantee, CITY OF ELGIN,an Illinois municipal corporation,of 150 Dexter Court,Elgin, Illinois, its agents or successors, a permanent,exclusive easement for constructing,operating, altering,replacing, and maintaining sanitary sewer pipelines and/or water supply pipelines, on, through and under the land belonging to Grantor, located in the City of Elgin, County of Kane, described as ibllows: LEGAL DESCRIPTION: See attached Plat of Easement. Nothing in this Easement Agreement shall be construed to preclude Grantor from improving the easement area described herein, provided that such improvements do not damage or burden any public utilities in said easement,and provided further that no permanent structures are erected upon said easement area_ The City shall promptly restore the easement arca to its pre-existing condition in the event that it perforans any alteration, replacement,repair,or maintenance in the Easement area which disturbs the existing condition. It is understood and agreed that Grantor shall be responsible for any restoration necessitated from the construction of the sanitary sewer pipelines, or water supply pipelines, in the easement area.
