HomeMy WebLinkAbout02-287 Recorded • Resolution No. 02-287 RESOLUTION AUTHORIZING EXECUTION AND ACCEPTANCE OF A WATER MAIN EASEMENT FROM U-STOR-IT (ELGIN) LLC (830 Steel Street) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a water main easement from U-Stor-It (Elgin) LLC for the property legally described on Exhibit A, a copy of which is attached hereto. Water Main Easement The Grantor,U-Stor-It(Elgin) LLC,an Illinois limited liability company("Grantor"),in consideration of the sum of one Dollar and other valuable consideration,receipt of which is hereby acknowledged,hereby grants and conveys to the City of Elgin, an Illinois municipal corporation (referred to herein as "Grantee"), its licensees, successors and assigns, a permanent, non-exclusive easement in, through and under the property legally described on Exhibit"A" and as depicted on Exhibit"B" (the "Easement Area") to construct, operate,repair,maintain,modify,reconstruct, replace and remove,water pipes and other facilities used in connection with an underground water main and water -d distribution. This Easement does not preclude U-Stor-It from improving the Easement Area, including, but not d limited to, landscaping the Easement Area, provided that such improvements do not damage or burden the water ( ) facilities located there. Permanent structures shall not be placed in, upon or over the Easement Area without prior written consent of the Grantee. After installation or repair of any facilities by Grantee,the grade of the property shall be returned to its state prior to such construction and shall not be altered in a manner so as to interfere with the use, operation and maintenance of the Easement Area by Grantor.
