This agreement is made and entered into this 1St day of April, 2002 by and between the COMMUNITY CRISIS CENTER, INC. of Elgin, an Illinois not-for-profit organization (hereinafter referred to as the"Grantee") and the CITY OF ELGIN, Illinois, a municipal corporation(hereinafter referred to as the"Grantor"). Whereas,the parties hereto have each determined it to be in their best interests to enter into this agreement to facilitate the effectiveness of the City of Elgin Police Department Domestic Violence Response Program; the purpose of which is to provide a cooperative law enforcement and social service response to victims, child witnesses, and perpetrators of domestic violence. The outcomes of such response to efficiently reduce further and escalated violence, insure the safety of victims and child witnesses, insure arrest and prosecution when probable cause exists and to provide individuals with safe shelter and increased resources to cope and seek assistance. Thus, this program directly contributes to the reduction of crime and the improvement of public safety and welfare. Now, therefore, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby acknowledged, the parties hereto hereby agree as follows: 1. The Grantee shall provide 24 hour a day, seven day a week crisis line for domestic violence victims who need help to resolve an immediate crisis or who just need to talk about the violence in their lives. (This service shall be available limited hours in Spanish.) 2. The Grantee shall provide emergency shelter for victims of Domestic Violence and their children in the Domestic Violence Response Program for a minimum of one night and a maximum of six weeks upon recommendation from the Domestic Violence Response Program and the desire of the victim. (This applies as long as the victim remains in compliance with the shelter rules.) 3. The Grantee shall provide domestic violence counseling as needed (individual and group) for victims and their children in the Domestic Violence Response Program. Our Mission is to advocate for a healthy, non-violent environment for all people and provide the resources and support necessaryto helpindividuals move through crisis to develop and pursue their own goals. information, pP 4. The Grantee shall provide court advocacy as needed in the Elgin Branch court, Rolling Meadows Court, and the Kane County Judicial Center for domestic violence victims in the Domestic Violence Response Program. 5. The Grantee shall provide follow-up calls and/or letters to all victims of domestic violence who have received a police response from the Elgin Police Department. 6. The Grantee shall provide group counseling for men and women who have been Abusive to their partners and who are entered into the Domestic Violence Response Program. The Grantee shall make available limited scholarships for this program based on the advice of the Domestic Violence Response Board and funding available. 7. The Grantee shall provide a domestic Violence Response liaison that shall participate on the DVR Board. 8. The Grantee shall make referrals of appropriate families to the DVR Board, according to its guidelines for inclusion in the program. 9. The Grantee shall abide by the City of Elgin's procurement ordinance and any other applicable ordinances. 10. The Grantor shall provide the Grantee with $20,000 in one payment in the first month of the grant through billing by the Grantee. These funds shall be drawn from the Elgin Police Department Budget. 11. Funding provided to the Grantee shall be utilized to purchase 2 computers @ $5,000, increase the Abuser Treatment Clinical Director to a full time position($12,650), and subsidize abuser treatment fees ($2, 350). 12. Grantee shall provide Grantor with reports monthly, which reports shall contain, but not be limited to, a specific accounting of all funds expended pursuant to this agreement, and statistical data on services provided. 13. The terms of this agreement shall be severable. In the event any of the terms or conditions of this agreement are deemed to be void or otherwise unenforceable for any reason,the remainder of this agreement shall remain in full force and effect. 14. This agreement shall be subject to and governed by the laws of the State of Illinois. Venue for the resolution any disputes or the enforcement of any rights arising out of or in connection with this agreement shall be in the Circuit Court of Kane County, Illinois,unless jurisdiction shall be exclusively federal as required by law. 15. Grantee warrants that it shall conform to all requirements of law, including but not limited to any and all applicable federal or state statues and regulations. In the event Grantee fails to conform to such regulations and statutes, Grantee shall refund all payments made to Grantee upon 30 days written notice. Such refund shall not constitute or be construed as a waiver of any right otherwise available to Grantor by law. 16. Grantee shall hold harmless and indemnify Grantor from and against any and all suits, claims for damages, causes of action, and any and all other liability, including but not limited to reasonable attorney's fees arising out of or resulting from Grantee's reckless or negligent performance of this agreement or failure to conform to any requirement of law or regulation applicable to the subject matter of this agreement or payment of funds associated therewith. 17. This agreement shall not be construed as creating a joint venture,partnership, employment or other agency relationship between the parties hereto. 18. This agreement shall terminate on July 30, 2002; upon 30 days written notice by Grantor; or upon operation of law as maybe mandated by federal or state law or • Regulation. City Clerk , DOMESTIC VIOLENCE RESPONSE BUDGET COMMUNITY CRISIS CENTER AUGUST 1, 2001 —JULY 30, 2002 Equipment 2 computers $5,000 Client fees Abuser Treatment Subsidies $2,350 Personnel Director of Abuser Treatment Services $12,650 Total $20,000 BUDGET NARRATIVE—JUSTIFICATION FOR PERSONNEL LINE ITEM The Clinical Director of Abuser Treatment Services is responsible for conducting assessments, coordinating group placement, reviewing cases of persons in the abuser treatment program, and supporting, informing, training, and supervising group facilitators as well as providing some group services. We have increased the number of abuser treatment groups, including the addition of a group for female abusers, in the past year and have doubled the time needed for assessments but have not increased the clinical director's time. In addition to the additional time needed for the direct services she provides, her availability to group leaders for support and updating them on new information and developments is crucial to the success of the program.
