HomeMy WebLinkAbout02-146 Resolution No. 02-146 RESOLUTION AUTHORIZING EXECUTION OF A SERVICE CONTRACT AGREEMENT WITH THE CHILDREN' S HOME AND AID SOCIETY OF ILLINOIS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Olufemi Folarin, Interim City Manager, be and is hereby authorized and directed to execute a Service Contract Agreement on behalf of the City of Elgin with the Children' s Home and Aid Society of Illinois for a domestic violence prevention program, a copy of which is attached hereto and made a part hereof by reference. s/ Ed Schock Ed Schock, Mayor Presented: April 24 , 2002 Adopted: April 24 , 2002 Omnibus Vote : Yeas : 7 Nays : 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk SERVICE CONTRACT AGREEMENT THIS AGREEMENT is made and entered into on this 10th day of April ,2002,by and between the City of Elgin,Illinois,a Municipal Corporation(hereinafter referred to as"City"),and the Children's Home and Aid Society of Illinois in Carpentersville,a not-for-profit corporation(hereinafter referred to as "CHASI")for the provision of case management services designed to address the needs of children and families who have been affected by domestic violence. WHEREAS,City has determined that domestic violence is a serious social problem,which adversely impacts families and places children at higher risk for abuse and neglect. The parties hereto have entered into this collaborative effort in order to achieve a number of outcomes including the reduction of violence toward children and adults. NOW,THEREFORE,in consideration of the mutual promises and covenants contained herein,the sufficiency of which is hereby acknowledged,the parties hereto hereby agree as follows: 1. CHASI shall provide case management interventions(as defined in the following paragraph#2)for children and families impacted by domestic violence that have been referred by the City and approved/ opened for services by the Department of children and Family Services(DCFS). The case manager shall have responsibility for 2 cases at any given time and a maximum of 8 cases over a 12 month period. 2. CHASI shall provide a full range of case management services for referred clients including assessment and service planning,individual and family counseling,advocacy,and linkage to other community resources. Services shall also include referrals and contacts with medical providers, substance abuse treatment programs,and long-term counseling programs as needed. The case manager will meet with families face to face on average weekly and more frequently as warranted. 3. CHASI case manager and/or supervisor will meet with collaborative partners on a monthly basis to coordinate service planning and to address any policy or procedural issues that may be presenting barriers to successful client/program outcomes. Collaborative partners are those agencies involved in the"EFVERT"program and other community service agencies in which the family shall be involved with. 4. CHASI Supervisor will oversee the delivery of services and provide weekly-formalized supervision along with informal case consultation on an ongoing basis with the designated CHASI case manager. The supervisor will assess and address CHASI staff training issues including the need for education in the areas of domestic violence,child welfare laws and policy,safety,substance abuse and mental health. CHASI staff will be knowledgeable in crisis intervention,stress management,risk assessment, assessment and goal setting,communication skills;anger management;problem solving;referral strategies and termination issues. • 5. CHASI will maintain a file for each client admitted to the program and documentation requirements shall include completion of a comprehensive assessment,Child Endangerment Risk Assessment Protocol(CERAP),service plans;case notes regarding all contacts with each family member,courts and other service providers;and a discharge summary upon termination with the program. If unusual incidents occur,hotline reports to DCFS will be initiated immediately and unusual incident forms will be completed. 6. CHASI Supervisor will submit a quarterly report to the City of Elgin with client and program outcomes. A financial statement will be attached to the report. 7. CHASI will receive reimbursement from the City of Elgin,Illinois for services at a rate of$7,500.00 within 30 days following the receipt of each quarterly report and financial statement. The total amount of reimbursement for the 12-month period will be$30,000.00 8. CHASI agrees that no person shall,on the grounds of race,color,national origin,sex,age,disability handicapped status or religion be excluded from participating in,or be denied benefits of,or be subjected to discrimination under any service,program,or activities funded with any portion of the • funds received by CHASI under this Agreement. 9. The City or CHASI shall have the right to cancel this Agreement providing 30 days written notification. 10. The Agreement shall terminate on June 30,2002,unless otherwise terminated as provided herein. 11. The terms of this Agreement shall be severable. In the event any of the terms or provisions of this agreement are deemed to be void or otherwise unenforceable for any reason,the remainder of this Agreement shall remain in full force and effect. 12. This Agreement shall not be constructed so as to create a partnership,joint venture,employment or other agency relationship of any kind between the parties hereto. 13. This agreement shall be subject to and governed by the laws of the State of Illinois. Venue for the enforcement of any rights on the resolution of any disputes arises out of or in connection with this Agreement shall be in the Circuit Court of Kane County Illinois. 14. In the event of breach by CHASI or termination of the Agreement for any reason,CHASI shall refund to Cityanyunused funds paid by City on a pro rata basis,and City shall not be liable to CHASI for any further reimbursements or other payments.
