Collins be and is hereby reappointed as a hearing officer for the City of Elgin administrative adjudication system of violations of traffic regulations concerning the standing, parking or condition of vehicles ordinance . Cogley, Corporation Counsel SUBJECT: Proposed Reappointment of Raymond D. Collins and Appointment of Mark Schuster as Hearing Officers for the City' s Administrative Adjudication System The City Council in 1999 adopted an ordinance providing for the administrative adjudication of traffic regulations concerning the standing, parking and condition of vehicles . Such administrative adjudication system provides for hearing officers to be appointed by the City Council for two year terms . Hearing officers are compensated on an hourly basis . The City Council has previously appointed attorney Raymond D. Collins as the hearing officer for the administrative adjudication system. Mr. Collins is an attorney with his own law firm in Waukegan, Illinois . Mr. Collins has substantial municipal law experience including representing the Village of Round Land Beach. Mr. Collins ' performance as a hearing officer has been exemplary. I recommended that Mr. Collins be reappointed by the City Council as a hearing officer for an additional term. To insure the efficient operation of administrative hearings the city' s ordinance providing for the administrative adjudication system provides that the City Council may appoint more than one hearing officer. Although to date Mr. Collins has been able to attend all scheduled hearing dates it is recommended that an additional hearing officer be appointed by the City Council . I have had discussions with attorney Mark Schuster of the Elgin law firm of Schnell , Bazos, Freeman, Kramer and Schuster regarding this matter. Mr. Schuster would be willing to serve as a city hearing officer. Mr. Schuster has been an attorney since 1975 and has extensive municipal law experience including acting as the village attorney for the Village of Hampshire since 1983 , acting as the village attorney for the Village of Sleepy Hollow since 1995 and prosecuting ordinance violation cases for the Village of South Elgin and the Village of Hampshire. I recommend that Mr. Schuster be appointed by the City Council as a hearing officer. Attached is a draft resolution which would provide for the reappointment of Mr. Collins and the appointment of Mr. Schuster as hearing officers for the city' s administrative adjudication system. I have placed this subject and the - - Olufemi Folarin -2- March 8 , 2002 attached resolution on the City Council executive session and other business agenda for the next City Council meeting on March 13 , 2002 .
