RESOLUTION
AUTHORIZING EXECUTION OF A RELEASE OF A SANITARY SEWER EASEMENT
(Hunters Ridge Apartments)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk,
be and are hereby authorized and directed to execute on behalf of
the City of Elgin a Release of a Sanitary Sewer Easement to
MREF II Property III, L.L.C. for the property located at Hunters
Ridge Apartments, a copy of which is attached hereto and made a
part hereof by reference.

prolongation of the last described course, a
distance of' 26.44 feet for the point of beginning,
this line hereafter referred to as line "A"; thence
, Southeasterly, being along a line that forms an
angle of 96 degrees 06 minutes OS seconds to the
right with; the prolongation of the last described
course, a distance of 5 . 03 feet to the intersection
with a line that is 5 . 00 feet, as measured.

A Plat Releasing a Sanitary Sewer Easement
dated May 10, 2001, is hereby attached hereto as
Exhibit A and incorporated into this Release of a
Sanitary Sewer Easement.
The City of Elgin releases to MREF II the easement
described above, it being the intention of the parties to
terminate such easement and vest Ownership of the
above-described property in MREF II .

SUBJECT: Vacation of Sanitary Sewer Easement at Hunters
Ridge Apartments - 1009 Big Timber Road
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the vacation of a
sanitary sewer easement .
BACKGROUND
(0P- The owners of the Hunters Ridge Apartments, MREF II Property III,
LLC, have relocated a public sanitary sewer and its easement to
accommodate the construction of a clubhouse within the apartment
complex. The clubhouse, now completed, is situated in an area
where the former sanitary sewer existed. The former sanitary sewer
has been abandoned and the owners are now requesting its easement
to be abandoned. The attached release of a sanitary sewer un-
encumbers the property upon which the club house exists .
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
None.
INANCIAL IMPACT
All costs associated with the recording fees will be the
responsibility of the owners, MREF II Property III, LLC.

RECOMMENDATION
It is recommended that the release of an easement at Hunters Ridge
Apartments be accepted by the City.
