RESOLUTION
AUTHORIZING EXECUTION OF A TRAFFIC SIGNAL INTERCONNECTS
AGREEMENT WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION
(McLean Boulevard and Big Timber Road)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Ed Schock, Mayor, be and is hereby authorized and
directed to execute a Traffic Signal Interconnects Agreement on
behalf of the City of Elgin with the Illinois Department of
Transportation for an upgrade of the traffic signal controller at
McLean Boulevard and Big Timber Road, a copy of which is attached
hereto and made a part hereof by reference .

TRAFFIC SIGNAL INTERCONNECTS
THIS AGREEMENT made and entered into between the STATE OF ILLINOIS, Acting by an•
through its Department of Transportation, hereinafter referred to as the "STATE", and the City of
Elgin, State of Illinois, hereinafter called the LA.
WITNESSETH:
WHEREAS, in the interest of public safety, the parties desire to upgrade the traffic signals
interconnected with METRA tracks at McLean Boulevard @ Big Timber Road, said improvement-
to be identified as Section 00-00169-00-TL and STATE Job No. P-91-400-00 for Preliminary
Engineering and C-91-400-00 for Construction and Construction Engineering, hereinafter referre•
to as the PROJECT; and,
WHEREAS, the parties hereto are desirous of utilizing STATE funds which have been mad:
available for the PROJECT; and
THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto
agree as follows: •
I. THE LA AGREES:
1. To perform or cause to be performed, all required installation work as prescribed i

2. To prepare the plans, specifications and detailed estimates of cost. These plans,
specifications and estimates shall be submitted to the STATE and the Illinois Commerce
Commission for their approval within 90 days of the execution of the agreement.
3. To begin work upon written authorization from the STATE to proceed. Upon receipt
of authorization, the LA shall promptly begin the work set forth in the agreement and shall notify in
writing the AGENCIES listed on EXHIBIT A before commencing work.

4. To maintain, for a minimum of 3ears after the completion of the contract, ade u to

books, records, and supporting documents to verify the amounts, recipients, and uses of all
disbursements of funds passing in conjunction with the contract; the contract and all books,
records, and supporting documents related to the contract shall be available for review and audit
by the AUDITOR GENERAL and the department; and the LA agrees to cooperate fully with an
audit conducted by the AUDITOR GENERAL and to provide full access to all relevant materials
Failure to maintain the books, records, and supporting documents required by this section shall
establish a presumption in favor of the STATE for the recovery of any funds paid by the STATE
under the contract for which adequate books, records, and supporting documentation are not
available to support their purported disbursement.
5. To bill the STATE monthly for performance of its work as herein specified, for the
STATE'S 100% share of its expense as incurred.
The LA, upon completion of its work, shall promptly render to the STATE a detailed final
statement of its actual expenses as incurred.
6. To bill the state for preliminary engineering work previously performed by the LA ir
its consultant to determine minimum warning times for METRA'S signal system. This work to
be reimbursed 100% by the STATE.
7. To assure that the traffic signal work is coordinated with METRA and the Illinois
Commerce Commission, and that the final cutover connection with METRA'S signal system is
approved by the Illinois Commerce Commission.
8. To complete the work as shown in Exhibit A on or before July 1, 2001.
9. To certify to the best of its knowledge and belief its officials:
(a) are not presently debarred, suspended, proposed for debarment, declared
ineligible or voluntarily excluded from covered transactions by any Federal
department or agency:
(b) have not within a three-year period preceding this Agreement been convict:d
of or had a civil judgement rendered against them for commission of fraud or
a criminal offense in connection with obtaining, attempting to obtain or
performing a public (Federal, State or local) transaction or contract under a
public transaction; violation of Federal or state antitrust statutes or
commission of embezzlement, theft, forgery, bribery, falsification or
destruction of records, making false statements receiving stolen property;
(c) are not presently indicted for or otherwise criminally or civilly charged by a
governmental entity (Federal, State, local) with commission of any of the
offenses enumerated in item (b) of this certification; and
(d) have not within"a three-year period preceding the Agreement had one or
more public transactions (Federal, State, local) terminated for cause or
default.
10. To include the certifications, listed in item 9 above and all other certifications required by
State statutes, in every contract, including procurement of materials and leases of equipment.
II. THE STATE AGREES:
1. To reimburse the LA for its share of the preliminary engineering, construction and
construction engineering costs upon receipt of a bill from the LA requesting such payment. Th
bills shall contain sufficient cost information and, if said services are performed by a contractor •r
consultant, show evidence of payment by the LA.
2. After the installation is completed, a final inspection will be performed by
representatives of the STATE, the LA and the ILLINOIS COMMERCE COMMISSION.
III. ITIS MUTUALLY AGREED:
1. After the completion of the improvement, the LA will retain jurisdiction and
maintenance responsibility of the completed improvement including perpetual remote acces .
2. The completed traffic signals shall conform to Part VIII of the "Manual on Uniform
Traffic Control Devices for Streets and Highways."
3. That the project will be processed, let, and constructed in accordance with Motor
Fuel Tax (MFT) standards, policies and procedures upon approval of plans and specifications b,
the STATE.
4. Obligations of the STATE shall cease immediately without penalty or further pay ent
being required if, in any fiscal year, the Illinois General Assembly or applicable federal funding
source fails to appropriate or otherwise make available funds for the work contemplated herein.
This agreement shall be binding upon and inure to the benefits of the parties, their successors and
assigns.

Road Name: McLean Boulevard @ Big Timber Road
SCOPE OF WORK:
1. Provide signal plans, cable plans and chart sequences.
2. Replace controller and cabinet complete with CRC security, reservice capabilities,
and phone line for remote monitoring.
3. Replace existing blank-out signs with new fiber optic signs.
4. Install new three conductor railroad interconnect cable.
5. Install pedestrian warning signs at all pedestrian signal locations.
6. Install crosshatch striping for NB McLean at Big Timber Road.
7. Consultant will need to study accident data and count data to check signal phasing
and insure that existing phasing can be maintained.
8. Incidental work necessary to complete the items hereinabove specified.

SUBJECT: Agreement With IDOT For The Upgrade Of The Traffic
Signals at McLean Boulevard and Big Timber Road
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider the approval of an
agreement with the Illinois Department of Transportation (IDOT) to
upgrade the traffic signal controller at McLean Boulevard and Big
Timber Road.
BACKGROUND
The Illinois Commerce Commission (ICC) has initiated a statewide
program to upgrade all traffic signals that are interconnected with
a railroad crossing. The upgrading increases the effectiveness of
the safety systems that ensure the traffic signals never allow
traffic flow to approach the crossing when a train is present or
approaching. Implementation of the upgrade involves changing the
traffic signal controller and the interconnect cable to the
crossing gates and adding new signage and pavement markings in
advance of the crossing. The estimated cost of improvements for
this intersection is $45 , 000 .
The ICC program requires the local agency to make the signal
improvements and then be reimbursed by the ICC. However, trackage
owned by a commuter rail line, namely METRA and CTA, is not
eligible for funding under any ICC program. To ensure that
crossings on commuter rail lines are upgraded as well, IDOT
voluntarily partnered with the ICC to fund those reimbursements .
The attached agreement with IDOT provides for the subject
reimbursement . It should be noted that Section III , paragraph 4 of,
the agreement relieves IDOT of the responsibility to reimburSe us
if the Legislature cuts off the funding for the program in the next
fiscal year. We requested that this language be removed but IDOT
insists that they have no other option since this is not their
program and their participation is voluntary. When pressed by staff

as to the logic of entering in an agreement with such a release
clause, the ICC representative indicated that any signalized
crossings not upgraded by this program will at some date in the
future be cited in violation of the safety requirements and the
agency responsible for maintenance (the City) will be forced to
make the upgrade at their expense . Faced with that alternative,
staff recommends entering into the agreement with IDOT and
proceeding quickly to complete the work. Design and installation of
the upgrade should be complete by the end of the year and
reimbursement by IDOT would be likely.

None.
FINANCIAL IMPACT
Funding for the controller upgrade can be taken from the traffic
signal miscellaneous services account, account number 010-3321-
753 .45-99 . They will be replaced with the reimbursement funds from
IDOT when they are received.

ALTERNATIVES
Take no action at this time and wait to be cited by ICC for a
safety violation at the signalized crossing. Under this scenario
the City would be responsible for the full cost of the signal
upgrade work.
RECOMMENDATION
It is recommended that the City Council approve the agreement and
authorize the Mayor to sign.
