RESOLUTION
AUTHORIZING EXECUTION AND ACCEPTANCE OF A GRANT OF EASEMENT
FOR SANITARY SEWER PURPOSES
(Woodbridge Commercial Subdivision)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City
Clerk, be and are hereby authorized and directed to execute
and accept a grant of easement for sanitary sewer purposes
from LaSalle Bank National Association for the property
legally described on the grant of easement, a copy of which is
attached hereto and made a part hereof by reference .
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to cause the Grant of Easement to be
recorded in the office of the Recorder of Deeds of Kane
County, Illinois .

This Grant of Easement made and entered into this io day of July, 2000 by and
between LASALLE BANK NATIONAL ASSOCIATION, as Successor Trustee to AMERICAN
NATIONAL BANK AND TRUST COMPANY OF CHICAGO, Trustee under Trust Agreement
dated September 29, 1989,as known as Trust 109526-044Elgin BB LLC,an Illinois limited liability
company,Halle Enterprises,L.L.C.,an Arizona limited liability company,Menard,Inc.,a Wisconsin
corporation(hereinafter collectively referred to as"Grantor")and the CITY OF ELGIN, an Illinois
municipal corporation (hereinafter referred to as the "CITY").
WITNESSETH
`tf For and in consideration of Ten Dollars($10.00)in hand paid,the mutual undertakings
as contained herein and other good and valuable consideration,the receipt and sufficiency of which
is hereby acknowledged, the parties hereto agree as follows:
1. The Grantor as the owner of the property legally described herein does hereby
grant to the City of Elgin, a municipal corporation, a permanent and exclusive easement to install,
construct, operate, use, maintain, repair, service, upgrade or replace a sanitary sewer line and
appurtenances relating thereto and a water line and appurtenances relating thereto in the property

hereinafter referred to as the "Easement Premises" and legally described and depicted on the legal
descriptions with attached exhibits hereto attached as Group Exhibit A.
2. That Grantor shall not construct any building, structures or other physical
improvements on the Easement Premises, with the exception of paving and curb and gutter for a
surface parking lot and a monument sign at the southwest corner of Randall Road and Bowes Road,
nor undertake any other activities which unreasonably interfere.with the Easement Premises and the
City's intended use thereof. In•the event in the opinion of the City the removal of the aforesaid
monument sign from the Easement Premises is required to allow the City to perform work within the
Easement Premises the City shall not be liable for any costs associated with the removal or
replacement of such monument sign.
3. That this agreement shall be binding on the parties hereto and their respective
successors and assigns and shall run with the land.
