HomeMy WebLinkAbout00-192 Recorded Resolution No . 00-192 RESOLUTION AUTHORIZING EXECUTION AND ACCEPTANCE OF A GRANT OF EASEMENT FOR SANITARY SEWER PURPOSES (Woodbridge Commercial Subdivision) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute and accept a grant of easement for sanitary sewer purposes from LaSalle Bank National Association for the property legally described on the grant of easement, a copy of which is attached hereto and made a part hereof by reference . That Grantor shall not construct any building, structures or other physical improvements on the Easement Premises, with the exception of paving and curb and gutter for a surface parking lot and a monument sign at the southwest corner of Randall Road and Bowes Road, nor undertake any other activities which unreasonably interfere.with the Easement Premises and the City's intended use thereof. In•the event in the opinion of the City the removal of the aforesaid monument sign from the Easement Premises is required to allow the City to perform work within the Easement Premises the City shall not be liable for any costs associated with the removal or replacement of such monument sign. 3. That this agreement shall be binding on the parties hereto and their respective successors and assigns and shall run with the land.
