FOR THE SAFE SUMMER CURFEW PROGRAM BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Joyce A. THIS AGREEMENT is made and entered into this -,��� day of /�/�"� ,2000 by and between the COMMUNITY CRISIS CENTER, INC. of Elgin, an Illinois not-for-profit organization (hereinafter referred to as the "Grantee") and the CITY OF ELGIN, Illinois, a municipal corporation (hereinafter referred to as the "Grantor"). WHEREAS, the parties hereto have each determined it to be in their best interests to enter into this agreement to facilitate the effectiveness of the City of Elgin Police Department Safe Summer Curfew Program. The purpose of this program being to provide a cooperative law enforcement and social service response to juvenile offenders of the city's curfew ordinance and their families. The outcomes of such response to efficiently reduce further and escalated delinquent behavior, decrease victimization rates to youth by reducing their presence in high- risk situations at night, and to provide families with increased resources to cope and seek assistance. Thus, this program directly contributes to the reduction of crime and the improvement of public safety and welfare. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency of which is hereby acknowledged, the parties hereto hereby agree as follows: 1. The Grantee will provide a drop-off center for juveniles and their families. An officer of the Elgin Police Department will remain with the juvenile until such time as a parent or guardian is present. 2. The Grantee will provide a counselor/casemanager to be available from 11:00 p.m. through 7:00 a.m. seven days a week, including holidays, from May 27, 2000 through October 15, 2000. 3. The counselor will conduct a crisis assessment of the curfew violator and their parent/guardian, make any appropriate referrals and/or interventions. 4. The Grantee will conduct follow up contact with each family as circumstances allow. 5. The Grantor shall provide the Grantee with up to $17,787 payable on a pro-rated monthly basis through billing by the Grantee. These funds shall be drawn from the Elgin Police Department Budget Line 010-2301-731.30-99, Professional Services/Misc. Professional Services. 6. Funding provided to the Grantee shall be utilized to support operating expenses directly related to the Curfew Program. 7. Grantee will provide Grantor with reports monthly, which reports shall contain, but not be limited to, a specific accounting of all funds expended pursuant to this agreement, and statistical data on services provided. 8. The terms of this agreement shall be severable. In the event any of the terms or conditions of this agreement are deemed to be void or otherwise unenforceable for any reason, the remainder of this agreement shall remain in full force and effect. 9. This agreement shall be subject to and governed by the laws of the State of Illinois. Venue for the resolution any disputes or the enforcement of any rights arising out of or in connection with this agreement shall be in the Circuit Court of Kane County, Illinois, unless jurisdiction shall be exclusively federal as required by law. 10. Grantee warrants that it shall conform to all requirements of law, including but not limited to any and all applicable federal or state statues and regulations. In the event Grantee fails to conform to such regulations and statutes, Grantee shall refund all payments make to Grantee upon 30 days written notice. Such refund shall not constitute or be construed as a waiver of any right otherwise available to Grantor by law. 11. Grantee shall hold harmless and indemnify Grantor from and against any and all suits, claims for damages, causes of action, and any and all other liability, including but not 9 • • limited to reasonable attorney's fees, arising out of or resulting from Grantee's reckless or negligent performance of this agreement or failure to conform to any requirement of law or regulation applicable to the subject matter of this agreement or payment of funds associated therewith. 12. The Grantor shall also hold harmless and indemnify the Grantee from and against any and all suits, claims for damages, causes of action, and any and all other liability, including but not limited to reasonable attorney's fees, arising out of or resulting from Grantor's reckless or negligent performance of this agreement or failure to conform to any requirement of law or regulation applicable to the subject matter of this agreement or payment of funds associated therewith. 13. This agreement shall not be construed as creating a joint venture, partnership, employment or other agency relationship between the parties hereto. 14. This agreement shall terminate,on October 30, 2000, upon 30 days written notice by Grantor, or upon operation of law as may be mandated by federal or state law or regulation. Parker, City Manager SUBJECT: Cooperative Service Agreement with the Community Crisis Center for Safe Summer Curfew Program PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council information to consider entering into a Cooperative Service Agreement for services with the Community Crisis Center for the Safe Summer Curfew Program. BACKGROUND A Safe Summer Curfew Program has been established to provide a cooperative law enforcement and social service response to juveniles for violating the Curfew Ordinance. The Community Crisis Center provides 24-hour, 7 days per week drop off assistance. A caseworker assigned to meet with the juvenile and family will assess the circumstances and make referrals to appropriate agencies, (i . e. , drug or alcohol abuse, physical abuse, family counseling) . In 1998 and 1999, monies were expended by the City of Elgin Police Department for assistance from the Community Crisis Center. During the summer of 1999, 56 minors and their families were seen at the Community Crisis Center as part of the curfew intervention program. The overall evaluation of the program from parents/guardians was that it was helpful and supportive to speak with a Crisis Center counselor. ' There was both surprise and appreciation that the "police cared so much." In addition to curfew, the assistance also opened communication with those families on other issues as well . The Safe Summer Curfew Program provides an efficient response to the community and important interventions with youth-at-risk, which may otherwise not occur. ALTERNATIVES Discontinue the coordinated effort with the Community Crisis Center completely or request the Community Center provide the assistance without funding from the City of Elgin. RECOMMENDATION It is recommended that the City Council execute the Cooperative Service Agreement with the Community Crisis Center, Inc. in an amount not to exceed $17, 787 .
