RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
OOSTERBAAN & SONS CO. FOR THE PAINTING OF VARIOUS BUILDINGS
WHEREAS, the City of Elgin has heretofore entered into a
contract with Oosterbaan & Sons Co. for the painting of
various buildings; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 1,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code
Section 5 . 02 . 020B (6) the City Council hereby finds that an
exception to the requirements of the procurement ordinance is
necessary and in the best interests of the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Joyce A. Parker, City Manager, be and is
hereby authorized and directed to execute Change Order No. 1 ,
a copy of which is attached hereto and made a part hereof by
reference .

CHANGE ORDER NO. 1
This Change Order made and entered into this 14thday of April, 2000, by and between the City of
Elgin, an Illinois municipal corporation, and Oosterbaan & Sons Co.
ORIGINAL CONTRACT: Painting at Various City Owned Buildings
Invitation to Bid No. 99-129
Contract Date February 9, 2000
PROJECT NO. 3'79520
SCOPE: Add painting on the interior of the Elgin Public Museum, exterior of the
Parks and Recreation Office, and exterior at the Crocker Theater.
REASONS FOR CHANGE: The original section of the Public Museum was not
painted when the addition was constructed and needs to be done to complete the
interior. The exterior work on the Parks and Recreation Office is part of the facade
improvement project which had not been determined at the time of the painting bid.
Work at the Crocker is being done to improve the exterior appearance. The
circumstances said to necessitate the change of performance were not reasonably
foreseeable at the time the contract was signed, the change is germane to the
original contract as signed, and the change order as herein provided is in the best
interests of the city and authorized by law.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the contract
will be revised as follows:

SUBJECT: Painting Contract Change Order No. 1
PURPOSE
The purpose of this memorandum is to provide the Mayor and members
of the City Council with information to consider a change order to
the contract for painting at various city-owned buildings .
BACKGROUND
The City Council awarded a contract for the painting of various
city-owned buildings to Oosterbaan and Sons at the February 9, 2000
City Council meeting. Items identified by the subject change order
were not known when the contract was originally bid. The costs
associated with this change order are consistent with the low bid
costs approved on the February 9, 2000 contract .
During the construction of the new addition to the Elgin Public
Museum no painting work was done in the original section of the
building. In order to improve the appearance of the older section
against the new area, the remainder of the interior space needs to
be painted. This would include all painted walls ceilings and
trims in the main hall and under the balcony areas on the first
floor. In order to facilitate the reopening of the museum in July
2000, this painting needs to be completed within the next four
weeks .
The second area that would be added is for painting in relation to
the facade improvement project at the Parks and Recreation office.
Details of this project had not yet been determined at the time of
the painting bid. The work would include scraping, painting, and
priming of the windows on the second floor and priming and painting
of a new sign banner to be installed above the windows .

The third area is exterior painting of the front facade of the
Crocker Theater Which is being done to improve the exterior
appearance of the building. The work would include scraping, spot
priming and painting of the existing marquee and priming and
painting of the new finish that will be installed over the existing
stone tile facade. A copy of the change order is attached for your
information.

FINANCIAL IMPACT

VI Funding for this change order is available within the capital
budget Painting, project number 379503, and the Building
Maintenance Operating budget in Major Repair, account number 010-
3701-742 . 93-36.

Because this change order substantially changes the original
contract scope, approval is considered an exception to the
Procurement Ordinance and passage requires a two-thirds majority
vote.
ALTERNATIVES
None.
RECOMMENDATION 1
It is recommended that the Mayor and City Council approve the
change order to the contract with Oosterbaan and Sons of Posen for
a total amount of $28, 100 . 00
