HomeMy WebLinkAboutG45-25 Ordinance No. G45-25 AN ORDINANCE AMENDING CHAPTER 2.08 OF THE ELGIN MUNICIPAL CODE, AS AMENDED, ENTITLED "CITY COUNCIL," AND TITLE 3 OF THE ELGIN MUNICIPAL CODE, AS AMENDED, ENTITLED "BOARDS AND COMMISSIONS" WHEREAS, the city council of the City of Elgin has determined that it is desirable to provide for certain amendments to the city council rules regarding travel and expenses, electronic attendance at meetings, and the procedures for materials provided to city council members at a closed meeting under applicable provisions of the Illinois Open Meetings Act (5 ILCS 120/1 et seq.); and WHEREAS,the city council of the City of Elgin has further determined that it is desirable to provide for certain amendments relating to the appointment of city council members and members of the public to certain boards and commissions; and WHEREAS, the City of Elgin is a home rule unit pursuant to Article 7, Section 6, of the Illinois Constitution and as a home rule unit may exercise any power and perform any function pertaining to its government affairs; and WHEREAS, the city council rules of procedure relating to travel and expenses, electronic attendance at meetings, materials provided at closed meetings, and the appointment of persons to boards and commissions pertain to the government affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled "City Council,"be and is further amended by amending Section 2.08.060 thereof, to be entitled"Travel; expenses," and to read as follows: "2.08.060—Travel; expenses. A. Members of the city council shall adhere to the travel policy and conference and seminar guidelines applicable to city employees. Members of the city council that attend a conference or seminar on behalf of the city shall report back to the city council a summary of the conference or seminar at a subsequent city council meeting. B. In the event that the city incurs costs for a member of the city council to attend an event or similar function on behalf of the city and the city councilmember is not able to attend the event, such councilmember must notify the city of the councilmember's inability to attend the event at least five(5) business days prior to the event. If the councilmember does not so notify the city of the councilmember's inability to attend the event within five business (5) days of the event, the councilmember shall reimburse the city the amount that was paid by the city for the councilmember to attend the event or function 1 unless the inability to attend the event was due to personal illness or disability, illness or death of a family member, or an emergency of a similar nature, or unless such councilmember is able to transfer the ticket or invitation to another councilmember, a member of a board or commission, or an employee of the city that is able to attend the event." Section 2. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled "City Council," be and is further amended by amending subparagraph A of Section 2.08.065 thereof, entitled "Electronic attendance at meetings,"to read as follows: "A. Any member of the city council may attend any open meeting of the city council via electronic means provided that a quorum of the city council is physically present throughout such meeting and such attendance is in compliance with the provisions of this chapter and any applicable laws. Members of the city council may not attend closed meetings of the city council via electronic means. Section 3. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled "City Council," be and is further amended by amending subparagraph E of Section 2.08.065 thereof, entitled"Electronic attendance at meetings,"to read as follows: "E. The member participating electronically and other members of the city council must be able to communicate effectively, and members of the audience must be able to hear all communications at the meeting site. In addition, the member participating electronically must be visible via camera or video throughout the meeting. Before allowing electronic attendance at any meeting, the city council shall use equipment adequate to accomplish this objective at the meeting site or shall provide such equipment. Section 4. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled "City Council," be and is further amended by amending Section 2.08.080 thereof, entitled "Rules of procedure,"to add a new subparagraph GG to read as follows: "GG. Any materials that are provided to councilmembers at a closed meeting under applicable provisions of the Illinois Open Meetings Act(5 ILCS 120/1 et seq.)shall not be removed from the closed meeting." Section 5. That Chapter 2.08 of the Elgin Municipal Code, as amended, entitled "City Council," be and is further amended by amending Section 2.08.080 thereof, entitled "Rules of procedure,"to add a new subparagraph HH to read as follows: "HH. Recommendations to the city council for the appointment or reappointment of a person to a board or commission under this code shall be made by two (2)members of the city council, including the mayor, on a rotating basis. After two members of the city council make a recommendation for an appointment or reappointment to a board or commission, two different members of the city council shall be assigned 2 to make the next recommendation for the appointment or reappointment of a person to a board or commission." Section 6. That Chapter 3.12 of the Elgin Municipal Code, as amended, entitled "Human Relations Commission," be and is further amended by amending Section 3.12.030 thereof, entitled "Appointment of members; composition; term; salary,"to read as follows: "3.12.030. —Appointment of members; composition; term; salary. A. The human relations commission shall consist of seven (7) members appointed by the city council. Commission members shall be as broadly representative of the community as practically feasible, in such areas as race, color, religion, sex, national origin, age, ancestry,familial status,marital status,physical or mental disability,sexual orientation, gender identity,military status,unfavorable discharge from military service, education, welfare, labor, and management. There shall also be two (2) ex officio nonvoting members of the human relations commission who shall be the city manager and the chief of police of the city. B. Each member as appointed shall serve for a term of three (3) years; except that the terms of initial appointees under this section shall be staggered in such a manner so that the terms of four(4)members shall expire on the first Tuesday of May on each of three (3) successive years. All members of the commission shall continue in such capacity until their successor has been duly appointed and is acting. Any member appointed to fill a vacancy prior to the expiration of the term for which his predecessor was appointed shall serve for the remainder of such term. All members of this commission shall serve without compensation." Section 7. That Chapter 3.87 of the Elgin Municipal Code, as amended, entitled "Sustainability Commission," be and is further amended by amending Section 3.87.020 thereof, entitled "Members," to read as follows: "3.87.020. —Members. The Sustainability Commission shall be composed of nine(9)members to be appointed by the City Council. The terms of the members of the Sustainability Commission shall be for three (3) years. Appointments shall expire on June 1 in the anniversary year of the appointment of the member." Section 8. That all ordinances or parts of ordinance in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 9. That this ordinance shall be in full force and effect upon its passage and publication in the manner provided by law. David J.
