AN ORDINANCE
VACATING A PORTION OF A PUBLIC STREET
(Frazier Avenue)
WHEREAS, the public interest will be served by vacating a
portion of a public street in the City of Elgin, Kane County,
Illinois, as shown in Exhibit "A" attached hereto; and
WHEREAS, said property is not necessary to serve the
public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That a portion of a public street in the City
of Elgin, Kane County, Illinois, legally described as follows :
That part of Frazier Avenue lying between the
East line of Clifford Street and the Westerly bank
of the Fox River, located in Sadler' s Addition to
Elgin, in the City of Elgin, Kane County, Illinois .
be and the same is hereby vacated.
Section 2 . That a certified copy of this ordinance
together with a plat of said vacated right of way be filed
U0 with the Recorder of Deeds of Kane County, Illinois .

Section 3 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.

MEMORANDUM
TO: Mayor and Members of the City Council

SUBJECT: Frazier Avenue Right of Way
PURPOSE
To provide additional information regarding procedures for the
transfer of a portion of the Frazier Avenue right of way to the
Fox River Water Reclamation District (FRWRD) .

BACKGROUND
In January of this year, the City Council directed the staff to
proceed with the vacation of the Frazier Avenue right of way in
support of FRWRD's expansion of the North Plant facility. A
plat of vacation has been prepared and placed on the City
Council agenda under "other business. " It should be noted that
the vacation will transfer only the southern half of the right
of way to FRWRD, and that a subsequent action will be required
to convey the northern half of the right of way.
FINANCIAL IMPACT
As referenced in a January 1992 memorandum, the staff estimates
the land value of the Frazier Avenue right of way in the range
of $13,000 to $19,500. The cost for preparation of the plat of
vacation was $100.
RECOMMENDATION
Approve the vacation of the Frazier Avenue right of way and
direct the staff to take the necessary actions to convey the
north hal of t - • .t of way to FRWRD.
