AN ORDINANCE
VACATING A PORTION OF FAIRWOOD COURT IN THE SIXTH ADDITION
TO CENTURY OAKS IN THE CITY OF ELGIN , KANE COUNTY , ILLINOIS .
WHEREAS , a certain portion of a public street in the
Sixth Addition to Century Oaks in the City of Elgin , Kane
County , Illinois , has never been improved , maintained or
used for street purposes , and
WHEREAS , the public interest will be subserved by the
vacation of the following described portion of said public
street , to-wit :
That portion of Fairwood Court , as platted in the
Sixth Addition to Century Oaks , being a subdivision
of part of Fractional Section 3 , Township 41 North ,
Range 8 East of the Third Principal Meridian , lying
within Lots 2 , 3 , 8 and 9 of the Resubdivision of
Lots 11 , 12 , 13 and part of Fai rwood Court in the
Sixth Addition to Century Oaks , being a subdivision
of part of said Fractional Section 3, in the City of
Elgin , Kane County , Illinois .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ELGIN , ILLINOIS :
Section 1 . That the following described portion of a
certain public street , as platted and located in the Sixth
Addition to Century Oaks , Kane County , Illinois , to-wit:
That portion of Fairwood Court , as platted in the
Sixth Addition to Century Oaks , being a subdivision
of part of Fractional Section 3 , Township 41 North ,
Range 8 East of the Third Principal Meridian , lying
within Lots 2 , 3 , 8 and 9 of the Resubdivision of
Lots 11 , 12 , 13 and part of Fairwood Court in the
Sixth Addition to Century Oaks , being a subdivision
of part of said Fractional Section 3 , in the City of
Elgin , Kane County , Illinois .
be , and the same hereby is , vacated for street purposes .
Section 2 . That the City of Elgin does hereby reserve to
itself and to any and all public utility companies owning any
public service facilities in any parts of said public street
vacated by this ordinance , full right of ingress and egress in
and from said street and an easement to go upon all or any
part of said street vacated by this ordinance for the purpose
of continuing , maintaining , reconstructing or extending any
such public service facilities which might be located thereon .

Section 3 . That a certified copy of this ordinance ,
together with a plat of portion of said public street vacated ,
be filed with the Recorder of Deeds of Kane County , Illinois .
Section 4 . That this ordinance shall be effective from
and after its passage , as provided by law , and shall be published
im pamphlet form by authority of the City Council .

Request from Elgin Y & C Cab Company to Increase Fares Granted
Vern Erlbacher of the Elgin Y & C Cab Company appeared before the Council with a re-
quest to increase taxi fares within the City. He presented a survey of rates being
charged by surrounding cities along with a request to change the present rates as
follows:
50Q Flag for 1st quarter mile
10Q For each additional quarter. mile
Extra passengers - Free
50c For deliveries
50c For more than three bags of groceries or laundry carried in cab
He stated that the new rates are requested in order to provide drivers with additional
income to help cover the increased cost of living and to help the company with the in-
creased costs of taxes and insurance.
Mayor Alft stated that other firms are not required to charge these rates, authorization
will merely set the maximum rate to be charged. Councilman Rauschenberger made a
motion, seconded by Councilman Tillery, authorizing the Corporation Counsel to prepare
a resolution providing for a change in rates. Yeas: Councilmen Barber, Rauschenberger,
Santanni, Tillery, and Mayor Alft. Nays: None.
Ordinance Passed to Permit the Reduction of the Minimum Off-Street
Parking Requirements for Federally Assisted Public Housing Projects
for the Elderly as an Authorized Variation Under the Zoning Ordinance
Councilman Barber made a motion, seconded by Councilman Rauschenberger to pass an
ordinance to permit the reduction of the minimum off-street parking requirements for
Federally assisted public housing projects for the elderly as an authorized variation
under the Zoning Ordinance. Yeas: Councilmen Barber, Rauschenberger, Santanni,
Tillery, and Mayor Alft. Nays: None.
PETITION TO VACATE A PORTION OF A PUBLIC STREET
IN SIXTH ADDITION TO CENTURY OAKS
TO THE MAYOR AND CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Now comes BIG TIMBER DEVELOPMENT CORPORATION, a Corporation of the State of
Illinois, and herewith petitions the City Council of the City of Elgin, Illinois,
to vacate a portion of a public street in Sixth Addition to Century Oaks, in the
City of Elgin, Kane County, Illinois, which portion was heretofore dedicated as a
public street as part of the original Plat of said Sixth Addition to Century Oaks,
which Plat was heretofore approved by the Council of the City of Elgin on the 28th
day of April, 1966, and which Plat was recorded in the Office of the Recorder of
Deeds of Kane County, Illinois, on August 10, 1966; that the legal description of
said portion of a public street herein sought to be vacated is as follows:
That portion of Fairwood Court, as platted in the Sixth Addition to
Century Oaks, being a subdivision of part of Fractional Section 3,
Township 41 North, Range 8, East of the Third Principal Meridian,
lying within Lots 2, 3, 8 and 9 of the Resubdivision of Lots 11, 12,
13 and part of Fairwood Court in the Sixth Addition to Century Oaks,
being a subdivision of part of said Fractional Section 3, in the City
of Elgin, Kane County, Illinois;
That the petitioner is the owner of all the real estate bordering and adjacent
to said portion of a public street herein sought to be vacated.
That said portion of a public street herein sought to be vacated is merely the
East and West portions of the cul de sac lying at the Southerly end of Fairwood
Court in said Sixth Addition to Century Oaks and lies outside the 66 foot right of
way of said street when extended southerly; that said Fairwood Court is to be
extended southerly, as set forth in the resubdivision of Lots 11, 12 and 13 and part
of Fairwood Court in said Sixth Addition to Century Oaks, which Plat of Resubdivision
was heretofore approved by the City Council.
That no public utilities or public service facilities or easements lie in said
portion of Fairwood Court herein sought to be vacated.
That the public interest will be subserved by vacating said portion of Fairwood
Court.
That attached hereto and made a part hereof by reference is a Plat of the por-
tion of a public street herein sought to be vacated.

That petitioner herein requests that the City Council of the City of Elgin,
Illinois, adopt an Ordinance passed by the affirmative vote of at least three-
fourths of the City Councilmen vacating the aforesaid portion of a public street,
as herein requested, in accordance with the Statutes of the State of Illinois in
such case made and provided.
