[SEAL) 1347(.1_6 FLED FOR RE:CORD KANE COUNIY, 'LL:. 1 3477 16 m5 DEC - "f '1 1: 45 • RECORDE; OF DEEDS • Ordinance No. S8-75 AN ORDINANCE VACATING PARK PROPERTY AT 45 RIVER BLUFF ROAD WHEREAS, property commonly known as 45 River Bluff Road was dedicated for public park purposes; and • WHEREAS, said property is not necessary to serve the public; and WHEREAS, the public interest will be subserved by vacating said property upon the terms and conditions contained herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the property located at 45 River Bluff Road, Elgin, Illinois, and legally described as follows: Public park abutting Lots 21 and 22 in Home in the Woods Addition to Elgin being a subdivision of part of the Northerly fractional quarter of Section 11, Township 41 North, Range 8 East of the Third Principal Meridian, in the City of Elgin, Kane County, Illinois, heretofore dedicated for park purposes, is hereby vacated. Section 2. That the vacation herein made is subject to the following conditions: A. Payment of the sum of $450.00 to the City of Elgin. B. Grant of a permanent easement to the City of Elgin of an area five feet wide for utility purposes adjacent to and inside the perimeter of the park as platted. Section 3. That a certified copy of this ordinance together with a plat of the park herein vacated shall be filed with the Recorder of Deeds, Kane County, Illinois. Section 4.
