City Clerk of the City of Elgin, in the Counties of Kane and
Cook in the State of Illinois, and that as such City Clerk I
am the keeper and custodian of the files and records of said
City of Elgin and the seal thereof.
I DO FURTHER CERTIFY that the attached is a full,
true, and correct copy of Ordinance No. S7-93 entitled "An
Ordinance Vacating Chamber Drive and Cook Circle in the Fox
Bluff Corporate Center" passed August 25, 1993, the original

AN ORDINANCE
VACATING CHAMBER DRIVE AND COOK CIRCLE IN THE
FOX BLUFF CORPORATE CENTER
WHEREAS, the City of Elgin is the owner of the property
commonly known as the Fox Bluff Corporate Center in the City
of Elgin, Kane County, Illinois; and
WHEREAS, as part of development efforts within the City
of Elgin the City recorded a plat of subdivision for the Fox
Bluff Corporate Center which included the creation and
dedication of streets therein, including Chamber Drive and
Cook Circle; and
WHEREAS, the City has agreed to a contract for the sale
of property within the Fox Bluff Corporate Center including
Chamber Drive and Cook Circle; and
WHEREAS, Chamber Drive and Cook Circle are no longer
necessary to serve the public and the public interests will be
served by vacating Chamber Drive and Cook Circle.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the public streets in the City of Elgin,
Kane County, Illinois, legally described as follows:
All of Chamber Drive and all of Cook Circle
lying in the Fox Bluff Corporate Center, being a
subdivision of part of Section 27, Township 41
North, Range 8, East of the Third Principal
Meridian, recorded as Document No. 92K59007, in the
City of Elgin, Kane County, Illinois .
be and the same are hereby vacated.
Section 2 . That all easements including all public
utility easements within said vacated Chamber Drive and Cook
`'- Circle be and the same are hereby vacated.
c Section 3 . That the 20 foot public utility easement
adjacent and parallel to said vacated Chamber Drive and Cook
c " Circle be and the same is hereby vacated, with the exception
of that portion of said 20 foot public utility easement in Lot
14 and the westerly 20 feet of Lot 13 in the Fox Bluff
Corporate Center which the City of Elgin does hereby reserve
to itself for facilities in, upon and under said retained
easement premises for the purposes of continuing or extending
any public service facility and to maintain, renew, extend or
construct or reconstruct any public service facilities .

Section 4 . That the 35 foot building line adjacent and
parallel to said vacated Chamber Drive and Cook Circle and be
and the same is hereby vacated.
Section 5 . That a certified copy of this ordinance
together with a plat of said vacated rights of way, easements
and building lines be filed with the Recorder of Deeds of Kane
County, Illinois .
Section 6 . That this ordinance shall be in full force
and effect upon the payment of compensation by the contract
purchaser as set forth in the pending contract to purchase the
said vacated streets and surrounding property.

SUBJECT: Fox Bluff Corporate Center: Vacation of
Chamber Drive and Cook Circle
PURPOSE
To present a request for vacation of Chamber Drive and
Cook Circle as platted for the Fox Bluff Corporate Center.
BACKGROUND
Fox Bluff Corporate Center was platted and recorded in
1992 . This plat of subdivision included provision for the
construction of Chamber Drive and Cook Circle, two cul-de-sacs
which would provide access to lots in the southeast corner of
the Corporate Center from Bowes Road. A stub of Chamber
Drive, approximately 280 feet was constructed as part of the
Bowes Road project. Olive Can, as part of their purchase,
wishes to take those lots adjacent to the location of these
streets. Olive Can's purchase would propose to include the
acreage now part of that dedicated right-of-way. This would
allow Olive Can full development of the property since con-
struction of the streets would be unnecessary.
FINANCIAL IMPACT
The vacation of Chamber Drive and Cook Circle will facil-
itate the purchase of 19 .2 acres of property by Olive Can in
the Fox Bluff Corporate Center.
RECOMMENDATION
It is recommended that the vacation of Chamber Drive and
Cook Circle be approved.
