(SEAL) 19 05 Ordinance No. S7-88 AN ORDINANCE VACATING A PORTION OF ETHELWYN STREET WHEREAS, the public interest will be served by vacating a portion of a public right of way in the City of Elgin, Kane County, Illinois, as shown in Exhibit "A" attached hereto; and WHEREAS, said property is not necessary to serve the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That a portion of a public right of way in the City of Elgin, Kane County, Illinois, legally described as follows: That part of the Ethelwyn Street right of way east of and adjacent to Lot 12 Block 17 Sadlers Addition to the City of Elgin, Kane County, Illinois. be and the same is hereby vacated. Section 2. That the City of Elgin does hereby reserve to itself and to any public utility company owning any public service for facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public service facilities and to maintain, renew, extend or construct or reconstruct any such public service facilities. Section 3. That a certified copy of this ordinance together with a plat of said vacated right of way be filed with the Recorder of Deeds of Kane County, Illinois. Section 4. May 27 , 1988 MEMORANDUM TO: Mayor and Members of the City Council FROM: City Manager SUBJECT: Street Vacation PURPOSE: This memorandum will provide the Mayor and Council with information to consider the vacation of a portion of an existing right-of-way. BACKGROUND: Attached is a copy of a portion of a plat on which is outlined a piece of property. Within that property are some street rights-of-way that are shown as being vacated. Lee Place was vacated in December 1956 and Ethelwyn Street south of Frazier was vacated in early 1961 (ordinance recorded at Kane County May 8 , 1961 as document 947997) . However, according to the Chicago Title Insurance Company they can find no ordinance of record vacating that part of Ethelwyn Place lying east of and adjacent to lot 12 . Our records (plat book) show the right-of-way of Lee and Ethelwyn to be vacated. It would appear that it was assumed that all of. Ethelwyn south of Frazier was to have been included in the 1961 ordinance. But for some reason it did not. That part of Ethelwyn lying east of lot 12 is land locked. It could serve nc public purpose in 1961 and can not now. We have received a request from Mr. Warren Strom to have the City vacate that part of Ethelwyn east of and adjacent to lot 12 . FINANCIAL IMPACT: The vacation of the right-of-way would place the property on the tax rolls .
