NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a portion of a public alley in the City of Elgin, Kane County, Illinois, legally described as follows: That part of "J.C. F W.H. Kimball's Addition", to the City of Elgin, Kane County, Illinois, being a subdivision in the Southwest Quarter of Section 14, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the intersection of the Southerly right-of-way line of South Street and the Westerly right-of-way line of Gertrude Street; thence Southwesterly along the Southerly right-of-way line of South Street for a distance of 415.8 feet to the Westerly most corner of Lot 4, Block 7 of J. C. F, W. H. Kimball's Addition; thence Southeasterly along the Southwesterly line of said Lot 4 for a distance of 165' to the Southerly most corner of said Lot 4, for a Point of Beginning; thence continuing Southeasterly along the last described course to the Westerly most corner of Lot 5, Block 7 of J.C. & W.H. Kimball's Addition; thence Northeasterly along the Northwesterly line of said Lot 5 for a distance of 55.0 feet; thence Northwesterly along a line parallel to the afore- mentioned Southwesterly line of Lot 4 to a point on the South- easterly line of said Lot 4; thence Southwesterly along said Southeasterly line for a distance of 55.0 feet to the point of beginning. be and the same is hereby vacated. • Section 2. That the City of Elgin does hereby reserve to itself and to any public utility company owning any public service for facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public service facilities and to maintain, renew, extend or construct or reconstruct any such public service facilities. Section 3. That a certified copy of this ordinance together with a plat of said vacated right of way be filed with the Recorder of Deeds of Kane County, Illinois. Section 4. The owner of the other property that fronts the same portion of the alley is Mr. Wesley Clabough of 182 Gertrude Street. Mr. Clabough was contacted and he is in favor of the City vacating the alley. This portion of the dedicated alley is 12 feet wide and 55 feet long and is grassy. It is not used as an alley. The remaining portion, approximately 210 feet long, goes in a northeasterly direction to Gertrude Street. It has a gravel base and provides access to a garage. Therefore, the gravel portion of the alley can not be vacated. Illinois Bell Telephone Company and Commonwealth Edison Company jointly own utility poles within the portion of the alley in question. They want the following clause included in the vacation ordinance: Commonwealth Edison Co. and Illinois Bell Telephone Company, its successors and assigns, are granted the right to construct, reconstruct, -add to, remove,operate, and maintain communication systems consisting of such poles, anchors, guys, wires, cables, conduits, terminals, manholes, and other fixtures as said Company may from time to time require, together with the right of access to the same in aforesaid described vacated alley or street. We believe that the best interests of the City of Elgin will be served by vacating the dedicated portion of the alley that is not used as such (the southwest 55 feet) . The City will be relieved of maintenance respon- sibility and liability and the right-of-way will be added to the tax roll. If vacated, the alley would be divided equally to the adjoining property owners. It is recommended that the southwestern most 55 feet length of alley between lots 4 and 5 in Block 7 of J.C.& W.H.
