HomeMy WebLinkAboutS5-77 Recorded Ordinance No. S5-77 AN ORDINANCE VACATING A PUBLIC STREET BETWEEN TODD FARM DRIVE AND SLEEPY HOLLOW ROAD NORTH OF BIG TIMBER ROAD WHEREAS, the public interest will be served by vacating a public street between Todd Farm Drive and Sleepy Hollow Road north of Big Timber Road in the City of Elgin, Kane County, Illinois; and WHEREAS, said property is not necessary to serve the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a public street between Todd Farm Drive and Sleepy Hollow Road north of Big Timber in the City of Elgin, Kane County, Illinois, legally described as follows: Commencing at the intersection of the West line of Todd Farm Drive as platted in the Sixth Addition to Century Oaks, • a subdivision of part of said Fractional Section 3, with the North line of Big Timber Road; thence Westerly along said North line of Big Timber Road, 650.3 feet for the place of beginning; thence continuing Westerly along said North line 66 feet to the East line of Lot l'in Big Timber Corner Unit No. 1,. a Subdivision of part of said West Half of Fractional Section 3, thence Northerly along said East line, being at right angles to said Northerly line of Big Timber Road 440 feet to the Northeast corner of said Lot 1; thence Easterly at right angles to said East line of Lot 1, 66 feet; thence Southerly at right angles to the last described course 440 feet to the place of beginning, in the City of Elgin, Kane County, Illinois. be and the same is hereby vacated. Section 2. That the City of Elgin does hereby reserve to itself and to any public utility company owning any public service for facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public service facilities and to maintain, renew, extend or construct or reconstruct any such public service facilities. Section 3. That a certified copy of this ordinance together with a plat of said vacated right of way be filed with the Recorder of Deeds of Kane County, Illinois. Section 4.
