AN ORDINANCE
ASSUMING JURISDICTION FOR SIXTY INCH STORM SEWER EXTENSION TO THE
OTTER CREEK STORM SEWER INSTALLATION
WHEREAS, the City of Elgin has designed and proposes to construct
a sixty inch storm sewer extension to the Otter Creek storm sewer
installation; and
WHEREAS, the storm sewer extension will be constructed primarily
within the right of way of Illinois Route 20; and
WHEREAS, the State has reviewed the plans for this storm sewer
extension and has approved same subject to the conditions that the City
of Elgin assume responsibility for constructing, maintaining and repair-
ing the storm sewer extension.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City hereby accepts full responsibility for the
construction, maintenance and repair of the sixty inch storm sewer exten-
sion to be constructed within the right of way of Illinois Route 20, as
shown on Exhibit 'A' which is attached hereto and made a part hereof.

SUBJECT: Otter Creek Drainage Improvements
Vacation and Acceptance of an Easement
PURPOSE: This memorandum will provide the Mayor and Council
with information to consider the subject vacation and dedication
of easements .
BACKGROUND: The Otter Creek Drainage Improvements were
completed in 1981 . The original plan called for the
channelization of the creek to be within an easement dedicated
by the owners of the Funk property.
Recently Funk Properties, Limited, has attempted to obtain
extended title insurance coverage. This coverage requires an
extensive survey and research of easements both recorded and
unrecorded. The survey showed that a portion of the drainage
ditch was out of the easement. The owners, Funk Properties,
Limited, have agreed to dedicate a new easement with the
condition that the old easement is vacated at the time that the
new easement is accepted by the City.
FINANCIAL IMPACT: The cost of preparing the necessary plat and
recording it with the Kane County Recorder is approximately
$300 .00 . These costs can be paid for out of the Engineering
Divisions budget for Architectural and Engineering Services .
RECOMMENDATION: It is recommended that the City Council direct
the staff to prepare the necessary resolutions for the vacation
and dedication of an easement for the Otter Creek Drainage
Improvements . Drawings showing the existing easement with the
drainage improvement shown and the proposed easement are
attached for your consideration.
