S3-75 ENTITLED "AN ORDINANCE VACATING A PORTION OF DANIELS AVENUE" WHEREAS, on August 27, 1975 the City Council of the City of Elgin passed Ordinance No. S3-75 vacating a portion of Daniels Avenue; and WHEREAS, it appears that the legal description included in Section 1 of Ordinance No. S3-75 was incorrect due to an error in the plat of survey. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 1 of Ordinance No. S3-75 passed on August 27, 1975, be and is hereby amended to read as follows: "Section 1. That it is in the public interest that that part of Daniels Avenue platted in the City of Elgin and legally described as follows: That part of Lot 6 in Block 42 of A. J. Waldron's Subdivi- sion of Out Lot No. 1 of P. J. Kimball Jun's 3rd Addition to Elgin described as follows: Beginning at the Southwest corner of A. W. Booth's Subdivision, in the City of Elgin, being a point on the North line of Daniels Avenue; thence Southerly along the West line extended Southerly of A. W. Booth's Sub- division to the South line of Daniels Avenue; thence Westerly along said South line 97.07 feet to the Easterly right of way line of the Chicago and Northwestern Railway; thence Northwesterly along said Easterly right of way line, to the North line of Daniels Avenue; thence Easterly along said North line, 115.0 feet to the point of beginning, in the City of Elgin, Kane County, Illinois. be vacated and the same is hereby vacated for street purposes." Section 2. That a certified copy of this ordinance together with a corrected plat of that portion of. the public street vacated by this ordinance, shall be filed with the Recorder of Deeds, Kane County, Illinois, together with a certified copy of Ordinance S3-75, passed on August 27, 1975. Section 3. That this ordinance shall be effective from and after its passage in the manner provided by law. s/ Richard L. Verbic Richard L.
